Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/10\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.4357 OF 2010\n           ---------------------------------------------\n           Dated         29th October, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>             Petitioner               was        convicted     and<\/p>\n<p>sentenced  in S.T.Nos.1172\/2003, 1409\/2003,<\/p>\n<p>1171\/2003, 1194\/2003, 1195\/2003, 1529\/2003,<\/p>\n<p>1522\/2003, 1521\/2003, 1173\/2003, 1536\/2003,<\/p>\n<p>1537\/2003 and 1538\/2003. He was sentenced<\/p>\n<p>to fine. Substantive                    sentence was only<\/p>\n<p>till rising of the Court. Case of the<\/p>\n<p>petitioner   is      that         as       he      has    been in<\/p>\n<p>custody for 54 days, direction is to be<\/p>\n<p>issued to the Magistrate not to direct the<\/p>\n<p>petitioner   to       undergo            imprisonment         till<\/p>\n<p>rising  of the Court.<\/p>\n<pre>\n\n       2.     Learned             counsel appearing for\n\nthe  petitioner        was heard.\n\n       3.     Learned             counsel              would argue\n\nCrmc 4357\/10\n<span class=\"hidden_text\">                           2<\/span>\n\n\nthat      the   sentence  shall  be   converted  to\n\n<\/pre>\n<p>concurrent sentence. Annexures-2 to 7 judgments<\/p>\n<p>in the appeals do not show that the sentences<\/p>\n<p>awarded       were   directed   to   be   undergone<\/p>\n<p>concurrently. If the petitioner has been in<\/p>\n<p>custody for at least      for one day in any of the<\/p>\n<p>cases for which        he was convicted,    learned<\/p>\n<p>Magistrate not to insist to undergo substantive<\/p>\n<p>sentence of imprisonment till rising of court<\/p>\n<p>in that case.
