For bail, I<br \/>\n\thave heard Mr.Ashish Dagli, learned advocate for the applicant and<br \/>\n\tMr.K.C.Shah, learned APP in this behalf. After hearing the<br \/>\n\tsubmissions made by Mr.Ashish Dagli and after going through the<br \/>\n\tjudgment on record, it appears that accused no.1 and accused no.5<br \/>\n\thas caused injury to the victim and the victim has got fracture in<br \/>\n\tthis behalf and that has been proved by the medical certificate of<br \/>\n\tdoctor.\n<\/p>\n<p>In<br \/>\n\tview of the same, bail to accused no.1 and accused no.5 is refused.<br \/>\n\tHowever, bail to accused nos.2, 3 and 4 are granted on their<br \/>\n\texecuting bond of Rs.5,000\/- (Rupees  five thousand only) each with<br \/>\n\tone solvent surety of the  like amount each to the satisfaction of<br \/>\n\tthe lower Court and subject to the conditions that they shall,<\/p>\n<p>a)\tnot<br \/>\n\t take  undue  advantage  of  their liberty or abuse their liberty;\n<\/p>\n<p>b)<br \/>\n\t\tnot leave the local limits of  State  of  Gujarat without  the<br \/>\n\tprior  permission  of the concerned Sessions Judge.\n<\/p>\n<p>c)<br \/>\n\t\tfurnish  the address of his residence to the I.O and also to the<br \/>\n\tCourt at the time of execution of  the bond and shall  not  change<br \/>\n\tthe  residence without prior permission of this Court;\n<\/p>\n<p>d)<br \/>\n\t\tsurrender  their  Passports, if any, to the lower court within a<br \/>\n\tweek;\n<\/p>\n<p>If<br \/>\n\t breach  of  any  of  the  above conditions is committed, the<br \/>\n\tconcerned Sessions Judge will be free to issue warrant or take<br \/>\n\tappropriate action in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court  having  jurisdiction to try the case.  It<br \/>\n\twould be open to the trial court concerned  to give time to furnish<br \/>\n\tthe solvency  certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute qua accused nos.2, 3 and 4.  Rule is made<br \/>\n\tdischarged qua accused nos.1 and 5.  Direct service is permitted.<br \/>\n\tCriminal Misc. Application No.4666 of 2007 is disposed of<br \/>\n\taccordingly.\n<\/p>\n<p>It<br \/>\n\tmay be noted that incident occurred in the year 1999 and conviction<br \/>\n\tis of 5\/1\/2007.  During the trial, they were on bail.\n<\/p>\n<p>For<br \/>\n\ttemporary bail of accused no.1, Criminal Misc.
