The<br \/>\npresent appellant-accused  has been convicted for the offence under<br \/>\nSection 376 of the Indian Penal Code and sentenced to undergo<br \/>\nrigorous imprisonment for seven years and a fine of Rs.20,000=00. In<br \/>\ndefault of payment of fine, to suffer further simple imprisonment for<br \/>\none year.\n<\/p>\n<p>\tShort<br \/>\nfacts of the prosecution case are that a complaint bearing I-CR<br \/>\nNo.272-2005 was registered with the Gandhinagar Section-21 Police<br \/>\nStation on 24.10.2005 for the offence punishable under Section 376 of<br \/>\nthe Indian Penal Code. It is the say of the prosecution that the<br \/>\ncomplainant Devikaben Lasubhai Garasiya was staying with her husband<br \/>\nand family members in a Government premises at Gandhinagar as some<br \/>\nrepairing work was going on in the said premises. Prior to 25 days of<br \/>\nthe date of filing of the complaint, the complainant was present in<br \/>\nthe said premises and in the midnight at about 2:00 am to 2:30 am the<br \/>\nappellant-accused entered into the said premises and committed rape<br \/>\non the complainant-prosecutrix against her will and consent. The<br \/>\ncomplainant had opposed and resisted the said act of the present<br \/>\nappellant-accused. However, the present appellant-accused had run<br \/>\naway from the said place and he could not be traced out. Thereafter,<br \/>\ncomplaint was lodged at Gandhinagar Sector 21 Police Station and<br \/>\ninvestigation was carried out by the Investigating Officer.<br \/>\nStatements were also recorded and then after charge-sheet was filed<br \/>\nagainst the present appellant-accused for the offence under<br \/>\npunishable under Section 376 of the Indian Penal Code.\n<\/p>\n<p>\tThe<br \/>\nprosecution has examined six witnesses, namely, the<br \/>\ncomplainant-prosecutrix Devikaben Lasubhai Garasiya vide Exh.9;<br \/>\nLalsinh Motibhai Garasiya, brother-in-law of the<br \/>\ncomplainant-prosecutrix vide Exh.11; Dr.Dipeshbhai M.Patel, Medical<br \/>\nOfficer vide Exh.17; Bashirahmed Dosbhai Vora, P.S.I. Sola High Court<br \/>\nPolice Station vide Exh.20; Raisinh Pratapsinh Chauhan, A.S.I. vide<br \/>\nExh.21 and Chakarkhan Fatehkhan Baloch, P.S.I. and Investigating<br \/>\nOfficer, Sector 21 Police Station vide Exh.22.\n<\/p>\n<p>\tIn<br \/>\nsupport of the prosecution case, the prosecution has also produced<br \/>\ndocumentary evidence as under:\n<\/p>\n<p>Exh.10\tComplainant<br \/>\nDevikaben&#8217;s complaint.\n<\/p>\n<p>Exh.16\tMedical<br \/>\nexamination of the accused.\n<\/p>\n<p>Exh.18\tMedical<br \/>\ncertificate of physical examination \t\tof the prosecutrix.\n<\/p>\n<p>\t\tPanchnama<br \/>\nof the place of the offence.\n<\/p>\n<p>\t\tPanchnama<br \/>\nof the body of the prosecutrix.\n<\/p>\n<p>\t\tPanchnama<br \/>\nof the body of the accused.\n<\/p>\n<p>\t\tPanchnama<br \/>\nof the seizure of &#8216;chaniya&#8217; of the \t\tprosecutrix.\n<\/p>\n<p>\t\tPanchnama<br \/>\nof the seizure of clothes of the \t\taccused.\n<\/p>\n<p>Exh.23\tNote<br \/>\nabout sending of muddamal.\n<\/p>\n<p>Exh.24\tNote<br \/>\nabout receipt of muddamal.\n<\/p>\n<p>Exh.25\tReport.\n<\/p>\n<p>\tThereafter,<br \/>\nstatement under Section 313 of the Code of Criminal Procedure was<br \/>\nrecorded by the learned Judge and after hearing both the parties at<br \/>\nlength, the learned Judge pronounced the judgment convicting the<br \/>\npresent appellant-accused for the said offence.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel Mr.Mukesh Dave appointed by the Legal Aid committee<br \/>\nfor the appellant-accused. He has submitted that he is not arguing<br \/>\nthis matter on merits. Simply he is arguing the matter on the quantum<br \/>\nof sentence. Mr.Dave has submitted that no doubt the act of the<br \/>\npresent appellant-accused was antisocial and immoral but, the learned<br \/>\nJudge has not considered the defence of the appellant-accused. He has<br \/>\nread over the evidence of the prosecutrix as well as the witnesses<br \/>\nand has vehemently submitted that the place of the offence which the<br \/>\nprosecutrix has shown is the place where she had been staying with<br \/>\nher husband and her in-laws and it is not possible for a person to<br \/>\ncommit offence under Section 376 at the said place. He has also<br \/>\ncontended that this is a clear case of consent, which the learned<br \/>\nJudge has not considered. On merits, Mr.Dave has simply contended<br \/>\nthat looking to the period which the present appellant-accused has<br \/>\nundergone, the Appeal is required to be allowed partly and the<br \/>\npresent appellant-accused is required to be set at liberty.\n<\/p>\n<p>\tLearned<br \/>\nAPP Mr.Parikh has produced the jail report and has contended that the<br \/>\npresent appellant-accused has undergone more than 50% of the sentence<br \/>\nperiod. On the question of consent, Mr.Parikh has relied upon the<br \/>\nevidence of the prosecutrix. However, on the question of considering<br \/>\nthe period which the present appellant-accused has undergone, he is<br \/>\nunable to say anything.\n<\/p>\n<p>\tLooking<br \/>\nto the age of the present appellant-accused and looking to the facts<br \/>\nand circumstances of the case and considering the fact that 50% of<br \/>\nthe sentence period which the present appellant-accused has already<br \/>\nundergone, I am of the opinion that the present Appeal deserves to be<br \/>\nallowed partly.\n<\/p>\n<p>\tOn<br \/>\nthe facts and in the circumstances of the case, this Appeal is partly<br \/>\nallowed. The Judgment and order<br \/>\nof conviction and sentence dated 3rd<br \/>\nApril 2006 passed in Sessions Case No.6 of 2006 by the learned<br \/>\nSessions Judge, Gandhinagar, convicting the appellant-accused under<br \/>\nSection 376 of the Indian Penal Code is hereby confirmed. However,<br \/>\nthe order of sentence<br \/>\nsentencing the appellant-accused to undergo Rigorous Imprisonment for<br \/>\nseven years for the aforesaid offence is hereby modified and reduced<br \/>\nto the extent that the sentence, which the appellant-accused has<br \/>\nalready undergone, be treated as the sentence. Rest of the impugned<br \/>\njudgment is unaltered.
