Information regarding inquiry and sanctioning of the loan Account 440730110000029 by\n          bank.\n      (Appellant claims to be Elder Brother of borrower and a party to the business premises.)\n\nReply of PIO:\nInformation not related with the appellant.\n\nGrounds for First Appeal:\nAppellant lucidly establishes relation with the borrower and property but information denied as third\nparty.\n\nOrder of the First Appellate Authority:\nInformation not related with the appellant.\n\nGrounds for Second Appeal:\nNo information provided to appellant also no hearing done over the first appeal filed by the appellant.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant : Absent;\n<\/p>\n<p>Respondent : Mr. B. N. Jha, PIO&amp; Dy. Zonal Manager on video conference from NIC-Patna Studio;\n<\/p>\n<p>       The appellant had sought information about customers of the bank. The Bank has denied the<br \/>\ninformation claiming exemption under Section 8(1)(e) of the RTI Act. Section 8(1)(e) of the RTI Act<br \/>\nexempts information which is held in a fiduciary capacity by the public authority.<br \/>\n Section 8 (1) (e) of the RTI Act exempts from disclosure &#8216;information available to a person in his<br \/>\nfiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants<br \/>\nthe disclosure of such information;&#8217;<\/p>\n<p>The traditional definition of a fiduciary is a person who occupies a position of trust in relation to<br \/>\nsomeone else, therefore requiring him to act for the latter&#8217;s benefit within the scope of that relationship. In<br \/>\nbusiness or law, we generally mean someone who has specific duties, such as those that attend a particular<br \/>\nprofession or role, e.g. doctor, lawyer, financial analyst or trustee. Another important characteristic of<br \/>\nsuch a relationship is that the information must be given by the holder of information who must have a<br \/>\nchoice,- as when a litigant goes to a particular lawyer, a customer chooses a particular bank, or a patient<br \/>\ngoes to particular doctor. An equally important characteristic for the relationship to qualify as a fiduciary<br \/>\nrelationship is that the provider of information gives the information for using it for the benefit of the one<br \/>\nwho is providing the information. All relationships usually have an element of trust, but all of them cannot<br \/>\nbe classified as fiduciary. Information provided in discharge of a statutory requirement, or to obtain a job,<br \/>\nor to get a license, cannot be considered to have been given in a fiduciary relationship.\n<\/p>\n<p>In the instant case very clearly a fiduciary relationship exists, since customers of a Bank come to it<br \/>\nbecause of the implicit trust they have; and they provide information to the Bank for their own benefit.<br \/>\nCustomers also have a choice of which bank they wish to approach. Hence unless a large public interest is<br \/>\nshown the information is exempted from disclosure.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The appeal is disposed.\n<\/p>\n<p>      The information sought by the Appellant is exempted under Section 8(1)(e) of the<br \/>\nRTI Act.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                        Shailesh Gandhi<br \/>\n                                                                                              Information Commissioner<br \/>\n                                                                                                     14 September 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
