2. The facts o0f.e.th\u00e9;–case  {ail within the<\/p>\n
narrow comp’ass- are that’ t11e”‘j;i\u20ac~titiofner was working<\/p>\n

\nComoany. from 6.3.2000 and was<\/p>\n
co1jafi_rmed”iri’ serviee  1.4.2001. Thereafter. it is the<\/p>\n
   of the petitioner that he was removed from the<\/p>\n
 ” 1.4.2002 by taking his letter of<\/p>\n
 _ ihdustrial dispute by going before the<\/p>\n
re.sigrIvatiofI’1A0by force. The petitioner then raised the

0′ Officer and uitimately the matter was referred by the<\/p>\n
~7:Government to the Labour Court for adjudication<\/p>\n
under Section 10 of the Industrial Disputes Act. The<\/p>\n

Labour Court dismissed the claim of the petitioner by<\/p>\n
holding that, as the petitioner had resigned <\/p>\n
services, the question of the employer terra’.ina.ting” H<\/p>\n
services does not arise.\n<\/p>\n
8. Having heardgthe petitioner’s”icoiinself. in <\/p>\n
regard to the grounds  ‘petition and
\nafter going through “VCourt, it
\nis noticed that thevgfrom the job
\nwith effect:   Vlitiiereafter he also
\nreceiygedv   by his employer in
\nthe  Rs’. 19,803\/~ and the cheque
\nwas   happily accepting the<\/p>\n
aforesaid amount, the petitioner contended before the<\/p>\n
\u00bb itlonsiideraition Officer that he was forcibly removed<\/p>\n
H ‘–tr.orn–se?-mice by asking him to give the letter of<\/p>\n
resignation.\n<\/p>\n
4. Learned Presiding Officer of the Labour<\/p>\n
  ___\u00a7C0urt, after going through the material placed before<\/p>\n
him, found that not only the petitioner resigned from<\/p>\n
3\/<\/p>\n
the services on his own free volition, but he also<\/p>\n
accepted the amount which was sent to him by way<\/p>\n
of cheque and if at ali the resignation was
\nby force, nothing prevented the  .
\nraising the issue in this regard_betv_vfeerr “1  ” ”
