They have been<\/p>\n<p>directed by the respondents to pay electricity charges under LT VII A<\/p>\n<p>Tariff.   According to the petitioner, the petitioner is liable to pay<\/p>\n<p>electricity charges only under LT VIA Tariff. The petitioner submits<\/p>\n<p>that the position of law in that respect has been declared in favour of<\/p>\n<p>the petitioner in the decision of <a href=\"\/doc\/949903\/\">Bro. Joseph Antony v. Kerala State<\/p>\n<p>Electricity Board<\/a> [2009(3) KLT 1022].\n<\/p>\n<p>      2.    I have heard the standing counsel appearing for the<\/p>\n<p>respondents also. The standing counsel could not dispute the fact that<\/p>\n<p>the issue involved is covered in favour of the petitioner in the above<\/p>\n<p>said decision. But the standing counsel pointed out that that decision<\/p>\n<p>has been stayed by the Supreme Court in an SLP filed by the KSEB and<\/p>\n<p>therefore, the same cannot be relied upon to give the petitioner the<\/p>\n<p>same relief.\n<\/p>\n<p>      3. A Division Bench of this Court has, in <a href=\"\/doc\/62161\/\">Abdul Rahiman v.<\/p>\n<p>District Collector, Malappuram and<\/a> another [2009 (4) KHC 283<\/p>\n<p>(DB)] held that even when a decision of a Division Bench of this Court<\/p>\n<p>is stayed by the Supreme Court, the law declared by the Division<\/p>\n<p>Bench in that decision is binding on the Single Judges of this Court and<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>the Single Judges are bound to follow the ratio of that decision in<\/p>\n<p>identical cases. That being so, notwithstanding the fact that the above<\/p>\n<p>said decision has been stayed by the Supreme Court, I am bound to<\/p>\n<p>dispose of this writ petition in terms of the ratio of that decision.<\/p>\n<p>Accordingly this writ petition is allowed.     The impugned bills are<\/p>\n<p>quashed. It is declared that the petitioner is liable to pay electricity<\/p>\n<p>charges only under LT VIA Tariff.
