Advocate for respondents 1<\/pre>\n<p>to 4.\n<\/p>\n<p>        Shri Shailendra Samaiya,Counsel for respondent no.5.<br \/>\n        Learned     counsel   for   petitioner   submitted   that    the<br \/>\ncontroversy involved in this case is squarely covered by an order<br \/>\nof this Court in W.P.No.1361\/09 M\/s Chandrama Construction<br \/>\nCompany Vs. M.P. Rajya Krishi Vipran Sangh &amp; others in<br \/>\nwhich the learned Single Judge of this Court considering the<br \/>\ncontroversy held thus:-\n<\/p>\n<blockquote><p>               &#8220;The petitioner by way of present petition<br \/>\n        challenges the action of respondents            who are<br \/>\n        deducting the royalty from bill of the petitioner despite<br \/>\n        the fact that he is not the owner of the Mine and is only<br \/>\n        a contractor, who purchases the material from the<br \/>\n        open market.\n<\/p><\/blockquote>\n<blockquote><p>                It is contended that the said action of the<br \/>\n        respondents is contrary to the law as laid down in<br \/>\n        W.P.No. 2535\/2003 <a href=\"\/doc\/99933010\/\">(M\/s Ravi Construction<br \/>\n        Company V. State of M.P. and others<\/a>) wherein it was<br \/>\n        held that contractor engaged in construction work<br \/>\n        cannot be insisted to produce &#8220;No Objection<br \/>\n        Certificate&#8221; issued from the Office of the Collector<br \/>\n        (Mining), if they are not holder of mining lease and are<br \/>\n        purchasing material from open market.\n<\/p><\/blockquote>\n<blockquote><p>               Learned counsel appearing for respondents<br \/>\n        does not dispute that the issue in respect of furnishing<br \/>\n        the &#8220;No Objection Certificate&#8221; from Office of the<br \/>\n        Collector(Mining) by the contractor engaged in<br \/>\n        construction work have been settled at rest in number<br \/>\n        of judgments delivered by this Court. Accordingly it is<br \/>\n        submitted that the petition may be disposed of by the<br \/>\n        observation made in W.P.No.6266\/2006 (M\/s<br \/>\n        K.P.Singh      Bhadoria      V.     M.P.Rural      Road<br \/>\n        Development Authority Bhopal).\n<\/p><\/blockquote>\n<blockquote><p>               Having considered the submissions put forth by<br \/>\n        respective counsels and keeping in view the judgments<br \/>\n        rendered by this court in earlier given cases W.P.No.<br \/>\n        2535\/2003 <a href=\"\/doc\/99933010\/\">(M\/s Ravi Construction Company V.<br \/>\n        State of M.P. and others<\/a>), W.P.No.6266\/2006 (M\/s<br \/>\n                          W.P.No.6215\/2010<\/p>\n<p>      Rahuldev Usrete                  State of M.P. And others.\n<\/p><\/blockquote>\n<blockquote><p>     <a href=\"\/doc\/124331494\/\">K.P.Singh Bhadoria V. M.P. Rural Road<br \/>\n     Development Authority Bhopal) and W.P.7954\/2008<br \/>\n     (M\/s Sunil Kumar Jain V. State of M.P. &amp;<\/a> 4 others)<br \/>\n     the present petition is disposed of with the following<br \/>\n     directions:\n<\/p><\/blockquote>\n<blockquote><p>        &#8220;(i) The State Government shall clear the bills<br \/>\n        of the petitioner submitted in connection with<br \/>\n        execution of the contract in question without<br \/>\n        insisting upon producing no dues certificate<br \/>\n        from the collector or any other authority with<br \/>\n        regard to payment of royalty for the minerals<br \/>\n        consumed. However, the State Government<br \/>\n        can insist upon production of bills with regard<br \/>\n        to purchase of mineral and in case the bill is<br \/>\n        not available an affidavit indicating the manner<br \/>\n        in which and the place or source from where<br \/>\n        the mineral is purchased. This affidavit can be<br \/>\n        used by the State Government for verification<br \/>\n        and for taking further action for clearing the<br \/>\n        bills.\n<\/p><\/blockquote>\n<blockquote><p>        (ii) Amount of royalty, if any, recovered from<br \/>\n        the bills of the petitioner, shall be refunded to<br \/>\n        the petitioner on the petitioner filing the bill or<br \/>\n        the affidavit as indicated hereinabove. In case<br \/>\n        petitioner is unable to produce the bill or the<br \/>\n        affidavit as indicated hereinabove, liberty is<br \/>\n        granted to the petitioner to represent the<br \/>\n        matter before the State Government pointing<br \/>\n        out the inability in producing the bills or the<br \/>\n        affidavit and it would be for the State<br \/>\n        Government to consider the representation<br \/>\n        and take such steps as may be permissible or<br \/>\n        proper for clearing the bills in the given set of<br \/>\n        circumstances as may be indicated by the<br \/>\n        petitioners&#8221;.\n<\/p><\/blockquote>\n<blockquote><p>     In result the petition is allowed to the extent above.<br \/>\n    However no costs.&#8221;<\/p><\/blockquote>\n<p>      It is submitted that in view of the aforesaid order, this matter<br \/>\nmay be disposed of finally.\n<\/p>\n<p>      As controversy involved in this case is squarely covered by<br \/>\nthe order in   M\/s Chandrama Construction Company (supra)<br \/>\n                           W.P.No.6215\/2010<\/p>\n<p>      Rahuldev Usrete                   State of M.P. And others.\n<\/p>\n<p>and we do not find any reason to differ with the reasonings and<br \/>\ndirections issued by the learned Single Judge, we dispose of this<br \/>\npetition with following directions:-\n<\/p>\n<p>(1)    The petitioner shall either furnish the bills of purchase of<br \/>\nminerals from authorized dealer or an affidavit disclosing the<br \/>\nsource from where petitioner purchased minerals, which were<br \/>\nused in the construction work.\n<\/p>\n<p>(2)    The respondents authorities if are satisfied with the bills<br \/>\nproduced by the petitioner may process the bills, but in case of any<br \/>\ndoubt, respondents authorities may insist the petitioner to file an<br \/>\naffidavit in support of its contention in respect of purchase of<br \/>\nminerals from the open market by the bills.<br \/>\n(3)    In case the petitioner is unable to produce the bills for the<br \/>\npurchase of the minerals or the royalty receipt in this regard,<br \/>\nrespondents authorities shall insist the petitioner to file an affidavit<br \/>\npointing out specifically the manner in which minerals were<br \/>\npurchased, disclosing particulars of the person from whom the<br \/>\nminerals were purchased. On filing of the affidavit, the authorities<br \/>\nshall be within their right to verify the aforesaid facts. They can<br \/>\nalso verify the facts from the record of the Mining Department of<br \/>\nthe concerned district.\n<\/p>\n<p>(4)    On completion of the aforesaid process, the respondents<br \/>\nshall clear the bills of the petitioner submitted in connection with<br \/>\nthe execution of the works contract and the amount of royalty, if<br \/>\nany recovered from the bills, shall be released in favour of the<br \/>\npetitioner.\n<\/p>\n<p>(5)    In case, the authorities are not satisfied with the contention<br \/>\nof petitioner or on verification, facts are not found correct then they<br \/>\nshall pass a reasoned order in rejecting the contention of<br \/>\npetitioner.\n<\/p>\n<p>(6)    If the petitioner fails to produce the bills\/affidavit as<br \/>\nindicated hereinabove, the petitioner may represent his case to the<br \/>\n                               W.P.No.6215\/2010<\/p>\n<p>            Rahuldev Usrete                State of M.P. And others.\n<\/p>\n<p>      concerned authority showing his inability to produce the bills or<br \/>\n      affidavit and it shall be for the State Government or authority to<br \/>\n      consider the representation and pass a suitable order in that<br \/>\n      regard.\n<\/p>\n<p>            No order as to costs.
