No.27597 of 2011\n                                   Madan Mohan Sinha\n                                           Versus\n                                   The State Of Bihar\n                                         -----------\n<\/pre>\n<p>3.   28.09.2011               Heard learned counsel for the petitioner and learned<\/p>\n<p>                  Additional Public Prosecutor for State.\n<\/p>\n<p>                              Petitioner is one of the named accused in this 18 years<\/p>\n<p>                  case and apprehends his arrest.\n<\/p>\n<p>                              Submission is that earlier during investigation petitioner<\/p>\n<p>                  was granted privilege under Section 438 Cr. P.C. by the Court of<\/p>\n<p>                  learned Sessions Judge itself in the year 1994. Privilege was extended<\/p>\n<p>                  from time to time. Ultimately, finding no material showing any<\/p>\n<p>                  apprehension of being apprehended, application for anticipatory bail<\/p>\n<p>                  was ultimately rejected being infructuous, even the petitioner<\/p>\n<p>                  subsequent to the aforesaid order of learned Sessions Judge, was<\/p>\n<p>                  present before the Court below but his application intimating such<\/p>\n<p>                  affairs was only kept on record nothing more could be done. Much,<\/p>\n<p>                  thereafter, Police submitted charge sheet and cognizance was taken as<\/p>\n<p>                  early as in the year 2001 but at no point of time petitioner was ever<\/p>\n<p>                  noticed. Consequently, he took no step, but he has subsequently been<\/p>\n<p>                  declared absconder against which one Cr. Misc. No. 40243 of 2010<\/p>\n<p>                  under Section 482 Cr. P.C. seeking quashing of order declaring him<\/p>\n<p>                  absconder is preferred which is still pending before a bench of this<\/p>\n<p>                  Court. The petitioner deserves the privilege of anticipatory bail which<\/p>\n<p>                  has been refused by the learned Sessions Judge on the ground of its<\/p>\n<p>                  being not maintainable since earlier he has availed the privilege. The<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>         learned Additional Public Prosecutor also objected the prayer mainly<\/p>\n<p>         on the ground that earlier in pursuance of the privilege granted by the<\/p>\n<p>         Sessions Judge the petitioner surrendered before the Court below,<\/p>\n<p>         released on bail which was extended from time to time, but ultimately<\/p>\n<p>         disposed of.\n<\/p>\n<p>                     Considering the facts and circumstances, especially<\/p>\n<p>         petitioner availing the privilege of bail till his prayer for anticipatory<\/p>\n<p>         bail before learned Sessions Judge was finally disposed of, being<\/p>\n<p>         infructuous finding no material to show any reason for, he may be<\/p>\n<p>         taken into custody. Prayer for anticipatory bail under Section 438<\/p>\n<p>         Cr. P.C. is not maintainable accordingly disposed of. However, in the<\/p>\n<p>         event of petitioner surrendering before the Court below within a<\/p>\n<p>         fortnight and seek regular bail, the Court below shall consider the<\/p>\n<p>         prayer on its own merit including the facts that earlier petitioner was<\/p>\n<p>         granted the privilege and the circumstances under which his prayer<\/p>\n<p>         was found infructuous and also whether at any point of time he was<\/p>\n<p>         served with any notice either personal, or through his counsel, after<\/p>\n<p>         order taking cognizance.\n<\/p>\n<p>                     With the aforesaid observation this application stands<\/p>\n<p>         disposed of.\n<\/p>\n<\/p>\n<p>                                   (Akhilesh Chandra, J.)<\/p>\n<p>Saif\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Madan Mohan Sinha vs The State Of Bihar on 28 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
