Interlocutory Application No. 4548 of 2011.<br \/>\n                                   The delay of 216 days occurred in filing the Letters<br \/>\n                      Patent Appeal is condoned.\n<\/p>\n<p>                                   Interlocutory Application stands disposed of.<br \/>\n                                   Re. Letters Patent Appeal No. 993 of 2011.<br \/>\n                                   Feeling aggrieved by the order dated 13th August 2010<br \/>\n                      made by the learned single Judge in above CWJC No. 12069 of<br \/>\n                      2010, the respondent no. 6 has preferred the present Appeal.\n<\/p>\n<p>                                   Learned Advocate Mr. Gyanand Roy has appeared for<br \/>\n                      the appellant. He has submitted that the respondent no. 1 herein<br \/>\n                      had filed above CWJC No. 12069 of 2010 against the judgment<br \/>\n                      and order dated 27th April 2010 passed by the District Teacher<br \/>\n                      Employment Appellate Authority, Purnea on appeal preferred by<br \/>\n                      the present appellant. The appellant, therefore, was a necessary<br \/>\n                      party to the writ petition. The appellant was impleaded as<br \/>\n                      respondent no. 6 in the writ petition. However, the impugned order<br \/>\n                      was made without affording opportunity of hearing to the<br \/>\n                      appellant. No notice was issued upon the appellant.\n<\/p>\n<p>                                   The facts stated hereinabove are not disputed.<br \/>\n                                   The impugned order dated 13th August 2010 having been<br \/>\n                      made in violation of principles of natural justice, the same requires<br \/>\n                      to be set aside.\n<\/p>\n<p>                                   Appeal is allowed. The impugned order dated 13th<br \/>\n                      August 2010 made by the learned single Judge in above CWJC<br \/>\n                      No. 12069 of 2010 is set aside.\n<\/p>\n<p>                                   CWJC No. 12069 of 2010 is revived and remitted to the<br \/>\n<span class=\"hidden_text\"> 3            Patna High Court LPA No.993 of 2011 (3) dt.06-09-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                   3\/3<\/span><\/p>\n<p>                      learned single Judge for hearing and decision afresh.\n<\/p>\n<p>                                   Learned Advocate Mr. Gyanand Roy appearing for the<br \/>\n                      appellant assures the Court that he shall file Vakalatnama on<br \/>\n                      behalf of the respondent no. 6 in the writ petition within two<br \/>\n                      weeks from today. He shall also appear before the learned single<br \/>\n                      Judge as and when the matter is notified. No notice against the<br \/>\n                      respondent no. 6 is, therefore, necessitated.\n<\/p>\n<p>                                   The respondent no. 6 will file counter affidavit, if any,<br \/>\n                      within three weeks from today.\n<\/p>\n<p>                                   Parties will bear their own cost.\n<\/p>\n<p>                                                             (R.M.
