Judge, Ahmedabad (Rural) at Narod in Civil Misc.<br \/>\nApplication No.110\/1978 dated 30.04.1977 whereby, the said<br \/>\napplication was allowed.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel for the appellant has fairly conceded that he would not be in<br \/>\na position to challenge the impugned order on merits and has<br \/>\nrequested the Court that since the dispute between the parties is<br \/>\npending since 1977 and the appellants are of very old age, they may<br \/>\nbe permitted to reside at the premises in question during their<br \/>\nlife-time on appropriate terms and conditions that may be imposed by<br \/>\nthis Court.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel for the respondents submitted that he has no objections if<br \/>\nonly the appellants herein, who are of very old age, are permitted to<br \/>\nreside at the premises in question during their lifetime on such<br \/>\nconditions as this Court may deem fit.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Since learned counsel for the appellants has not<br \/>\nchallenged the impugned order on merits, this Court is not discussing<br \/>\nthe order in detail and accordingly, confirms the same. However,<br \/>\nconsidering the facts and circumstances of the case and since the<br \/>\nrespondents have no objection if only the appellants are permitted to<br \/>\nreside at the premises during their lifetime, it is observed that the<br \/>\nappellants herein shall be permitted to reside at the premises in<br \/>\nquestion on their submitting an Undertaking before this Court within<br \/>\na period of four weeks from today to the effect that they will not<br \/>\ntransfer, alienate, mortgage or create any third party right\/interest<br \/>\nin the property in question during their lifetime and that they will<br \/>\nalso not induct any third party in the suit premises. It is also made<br \/>\nclear that such Undertaking shall also contain an express declaration<br \/>\nby the appellants that their legal heirs will not claim any tenancy<br \/>\nrights in the suit premises. It is clarified that the aforesaid<br \/>\narrangement shall continue only during the lifetime of the appellants<br \/>\nand it shall cease to exist thereafter. Consequently, the impugned<br \/>\norder passed by the Court below is modified to the above extent.<br \/>\nHowever, the orders passed by the authorities below are not<br \/>\ndisturbed.
