..__The\u00abscomplainant initiated prosecution against the<\/p>\n
 .. respondent on the accusation that respondent had<\/p>\n
\u00ab”‘~._VVi:)o-r”rowed from him a sum of Rs.1,00,000\/- agreeing to<\/p>\n
*:repay the same, but failed. On persistent demands she<\/p>\n
made, issued cheque on 22.2.2002 for discharge of the<\/p>\n
liability but the cheque on presentation to the Bank on<\/p>\n

27.2.2002 was dishonoured. The statutory notice” issued<\/p>\n
in this regard was not compiied necessitating act_ion:~.._g’s*-..<\/p>\n
On presentation of the compiaint,__.–3V_:tHh’e”5.’E’ea’rh.ed,g<\/p>\n
jurisdictionai Magistrate took cognizanc_e”‘for–:’_the’-offence”. <\/p>\n
under Section 138 of the N.:;Actjfaha”rrssiuanfrnomacifthe<\/p>\n
accused-respondent. Thesrespondient put*u’p\u00a7jt’h.et”defence”<\/p>\n
of denial simpliciter p_necessiptat:i’ng =t_riai,..’dr-urivnnguvwhiciw, the
\ncompiainant examinedhims_eif{_a:s piaced reiiance
\non 10 documents  aiso examined
\nherseif _’–:whVo.:  The triai
\n” on record that the
\ncomptiiainanitiiit\u00e9adtin ,u’r1eqvu_ivo’ca| terms admitted that there
\nwas adrnoneyrViendir;i\u00a7:’:”—-.;iraV.nsaction between him and the<\/p>\n
husb’an.d of thegrespondent and that amount was stiii due<\/p>\n
.2 to; hi_mi_–_7~.Since the transaction of ioan between the<\/p>\n
 the husband of the respondent was<\/p>\n
su’bsis~tin’g}; the learned 3udge disbeiieved that the<\/p>\n
V ” compviainant wouid have again advanced Rs.1,00,000\/– to<\/p>\n
 respondent who was oniy a housewife. The<\/p>\n
“observation of the triai Judge to reach such a conclusion is<\/p>\n
found at para–7 of the impugned judgment. The second<\/p>\n
aspect noticed by the triai }udge was that the accused had<\/p>\n

denied signature on the document and she had “alleged<\/p>\n
that it was a forgery. The third aspect noticed bvy.V_th_4e’~~triai<\/p>\n
Eudge was that the husband of the accuse\u00a7d..”d”Li–.fih{i<\/p>\n
lifetime had obtained from he_rM.Mc_ertai_ri””‘b%an!<l*cheVques". <\/p>\n

trial Judge concluded that |o_el:iVca:i__inference. be that

\nwhen there was  repayment of
\nRs.4,00,Q_Q0\u00a7;t\u00a7'   Nurturing a doubt

appellant  ta.kenA"me"'.through the evidence on record as<\/p>\n
 'a'iso' S'ri.M…N.Neh'r'u}'V|earned counsel for the respondent.<\/p>\n
   uwas_j..urged before me by the appellant's counsel<\/p>\n
that ina~\\.Ii_ejw'lof certain presumptioris available in favour of<\/p>\n
 the conipiainant against the accused incorporated under<\/p>\n
 'S,ec{ions 118 and 139 of the N.I.Act, the burden was on<\/p>\n
it ___the accused to rebut the presumption. On the other<\/p>\n
hand, the trial Court has in its wisdom declined to raise<\/p>\n

presumption in favour of the complainant and has__in fact<\/p>\n
shifted the burden of proof on the complainant.  if<\/p>\n
7. In negation to it, learned counsel Srit.Ne.hru’__”wo:ul.d<\/p>\n
contend that existence of debt had to  ‘theft<\/p>\n
complainant with clinching evidencet1:”‘The\u00abscornph:lainan’t_ha’d<\/p>\n
failed to establish that thechequeins\u00e9pugneVd5Twga’sissued <\/p>\n
respect of ‘existing liability’.”V””‘e\u00bbl\u00a7l_’ere possesseioin  a cheque

\nagainst the accused.VH_’l’  -*i’t.Tw\u00a7avs’\u00ab’~~urged that the<\/p>\n
circumstance ‘in;g.ti\u00a79.ihic:h the”xaccuse–d=w.ais placed itself show<\/p>\n
that :’s_he–_ participating in the business
\nnor was’wi_n*nee’d_  ainy\u00e9rnoney as the husband was the<\/p>\n
pe.i{sontr.dea|ingwivth all business transaction.
\n” 2,8; E<eeping"i'n"'mind what is urged, I have examined<\/p>\n
    facts and the analysis of the trial Judge to<\/p>\n
re.cord,.acqfuitta|. The evidence on record as discussed<\/p>\n
 abo\\ieiV__is not in dispute, the cheque impugned is under the<\/p>\n
 's.ig:nature of the accused. The trial Judge compared the<\/p>\n
it ___signature on the cheque with the admitted signature of the<\/p>\n
accused. On such comparison, it opined that the<\/p>\n

to show that there was no existing debt or liabiiity as on
\nthe date of presentation, there is no reason why the
\npresumption under Section 139 of N.I.Act shouid no’t\u00bb,have<\/p>\n
been drawn. The trial Court instead of the<\/p>\n
evidence in the Eight of this provision has. to <\/p>\n
borrowed by the husband of res,pon:d,en;t”‘a,nd_,as it ‘<\/p>\n
discharged by his disbei\u00e9eved_evid\u00e9en_ce of theft co:rnp|a;in’ant:;n’<\/p>\n
Since the trial Court has  effect of
\npresumption under   Act, the
\nright course wouid be to the trial
\nCourt to  of being heard
\nand Z\ufb01gthenixgiftfo*1-._,ip’as’S<ped_itious disposal is desirabie. Besides, it is<\/p>\n
  there is element of possibie settiement<\/p>\n

'rim,_pug"ned judgment is set aside and the matter is<\/p>\n
C7-Jrfenaanded to the triaf Court for disposaf afresh according to<\/p>\n
