Justice M.SASIDHARAN NAMBIAR\n\n Dated :18\/01\/2007\n\n O R D E R\n                   M.SASIDHARAN NAMBIAR,J.\n\n\n\n                   ------------------------------------------\n\n                   W.P.(C) .NO.13198   OF  2006\n\n                   ------------------------------------------\n\n\n                    Dated   18th    January   2007\n\n\n\n\n                            J U D G M E N T\n<\/pre>\n<p>                 Petitioner            is         the         judgment         debtor.\n<\/p>\n<p>Respondents   1   to   5   are   decree   holders   and   6th<\/p>\n<p>respondent   the   auction   purchaser   in   O.S.342\/99   on   the<\/p>\n<p>file   of   Munsiff   court,   Tirur.   Towards   realisation   of<\/p>\n<p>decree debt respondents   1 to 5 filed E.P.71\/2003, for<\/p>\n<p>attachment of the property of the petitioner. Property<\/p>\n<p>was   sold   in   court   auction   sale   and     purchased   by   6th<\/p>\n<p>respondent.   When       the   execution     petition   was   posted<\/p>\n<p>for   confirmation   of   sale,   judgment   debtor   filed   this<\/p>\n<p>petition   under   Article   227   of   Constitution   of   India<\/p>\n<p>contending   that   total   extent   of   property   sold   in   E.P<\/p>\n<p>is   63   cents   and   for   realisation   of   decree   debt   it   is<\/p>\n<p>not   necessary   to   sell   the   entire   property   and<\/p>\n<p>executing   court  under  Rule  64  of  Order  XXI  of  Code  of<\/p>\n<p>Civil   Procedure   has   to   sell   only   that   portion   of<\/p>\n<p>attached   property,   which   is   necessary   to   realise<\/p>\n<p>decree   debt   and   as   it   was   not   considered   executing<\/p>\n<p>court   has   no   jurisdiction   to   direct   sale   of   the<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>property and executing court is bound to consider the<\/p>\n<p>question   before   confirmation   of   sale.   According   to<\/p>\n<p>petitioner   he   apprehends   that   if     that   objection   is<\/p>\n<p>taken before executing court that may not be accepted<\/p>\n<p>and therefore this petition is filed to set aside the<\/p>\n<p>sale   and   to   permit   petitioner   to   pay   the   decree   debt<\/p>\n<p>in instalments.\n<\/p>\n<p>      2.    Learned counsel appearing for petitioner and<\/p>\n<p>respondents were heard.\n<\/p>\n<p>      3.      Learned   counsel   appearing   for   petitioner<\/p>\n<p>relying on the Division Bench ruling of this court in<\/p>\n<p>Gnan Das   v. Paulin Moraes   (1998 (2)   KLT 88)  argued<\/p>\n<p>that before directing sale executing court is bound to<\/p>\n<p>consider   the   mandate   provided   under   Rule   64   and   if<\/p>\n<p>that has not been complied, it is a ground which could<\/p>\n<p>be taken in an application filed under Rule 90 to set<\/p>\n<p>aside the sale.\n<\/p>\n<p>      4.    Question   is   whether   petitioner   is   entitled<\/p>\n<p>to   approach   this   court   to   set   aside     the   sale,   when<\/p>\n<p>petitioner   has   a   remedy     provided   under   Rule   90   of<\/p>\n<p>Order XXI of the Code. Even as per the decision relied<\/p>\n<p>on   by   the   learned   counsel   appearing   for   petitioner,<\/p>\n<p>the contention raised by petitioner could be urged and<\/p>\n<p>if urged is to be considered by executing court in an<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>application filed under Rule 90 of order XXI.  For the<\/p>\n<p>reason that petitioner apprehends that executing court<\/p>\n<p>may   not   accept   the   contention,   is   not   a   ground   to<\/p>\n<p>approach   this   court   before   approaching   the   executing<\/p>\n<p>court.   This   petition   is     disposed   with   liberty   to<\/p>\n<p>petitioner   to   file   an   application   under   Rule   90   of<\/p>\n<p>Order XXI of Code to set aside the sale raised all the<\/p>\n<p>contentions raised  herein.  Petitioner   can  also raise<\/p>\n<p>the   contention   before   the   executing   court   before<\/p>\n<p>confirming   the   sale.
