PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npresent application has been filed by the applicant for grant of<br \/>\nregular bail under sec. 439 of the Code of Criminal Procedure after<br \/>\nthe charge sheet is filed.\n<\/p>\n<p>2.\tThe<br \/>\napplicant-accused is charged with having committed offences under<br \/>\nsections 323, 326, 504, 506(2) and 114 of IPC for which FIR, being<br \/>\nC.R. No. I-43\/2010, has been registered with Rajula Police Station.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Haresh Joshi for learned advocate Mr. Prachhak for the<br \/>\napplicant submitted that the charge sheet is filed and the victim is<br \/>\ndischarged from the hospital and therefore the present application<br \/>\nmay be allowed. He submitted that the other co-accused has been<br \/>\nreleased as per the order passed in Criminal Misc. Application No.<br \/>\n10152 of 2010.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Mr. Nanavati resisted the application and submitted that the role<br \/>\nof the present applicant is different as it has been discussed in the<br \/>\nimpugned order. He submitted that considering the role attributed,<br \/>\nthe present application may not be entertained.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Mr. Joshi and learned APP Mr. Nanavati and<br \/>\nhaving considered the nature of offence, the role attributed and also<br \/>\nthe fact that charge sheet has now been filed and other co-accused<br \/>\nhas been released, the present application deserves to be allowed.\n<\/p>\n<p>6.\tThe<br \/>\napplication is accordingly allowed.  The applicant is ordered to be<br \/>\nreleased on bail in connection with C.R. No. I-43\/2010 registered<br \/>\nwith  Rajula Police Station,  on his executing a personal bond of Rs.<br \/>\n5,000\/- (Rupees Five Thousand only) with one solvent surety for the<br \/>\nlike amount to the satisfaction of the lower court and subject to the<br \/>\nfurther conditions that he shall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to<br \/>\ntry to tamper or pressurize the prosecution witnesses or complainant<br \/>\nin any manner;\n<\/p>\n<p>(c )\tnot<br \/>\nact in any manner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before the concerned Police Station on the first Monday<br \/>\nof every calendar month between 11.00 am to 2.00 pm till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the investigating officer and also to<br \/>\nthe court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower court having jurisdiction to try the case. It would<br \/>\nbe open to the trial court concerned to give time to furnish the<br \/>\nsolvency certificate, if prayed for.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute.
