RAJOUN, DISTRICT-BANKA. .\n                                    Versus\n                             THE STATE OF BIHAR .\n                                  -----------\n<\/pre>\n<p>2.   28.02.2011                Heard learned counsel for the petitioner and<\/p>\n<p>                     learned counsel for the State.\n<\/p>\n<p>                                   The petitioner is in custody since 18.7.2009 in<\/p>\n<p>                     relation to Rajoun P.S. Case No. 85 of 2009 instituted under<\/p>\n<p>                     Section 302\/34 of the Indian Penal Code.\n<\/p>\n<p>                                   It alleged by the informant, who is the sister-in-<\/p>\n<p>                     law of the petitioner that on the fateful day, the petitioner along<\/p>\n<p>                     with his wife assaulted informant&#8217;s husband, who is the own<\/p>\n<p>                     brother of petitioner, because of which he died on the spot.<\/p>\n<p>                                   Learned counsel for the petitioner states that the<\/p>\n<p>                     trial has started, some witnesses have been examined. From<\/p>\n<p>                     records, it appears that the bail of the wife of petitioner was<\/p>\n<p>                     rejected by this Court on 30.10.2009 vide order in Cr. Misc.<\/p>\n<p>                     Case No. 36061 of 2009.\n<\/p>\n<p>                                    In view of the fact that the trial has already<\/p>\n<p>                     commenced, I am not inclined to interfere in this matter at this<\/p>\n<p>                     stage. However, I direct the trial court being the court of<\/p>\n<p>                     Additional Sessions Judge, fast Track Court-III, Banka, who<\/p>\n<p>                     immediately takes steps to expedite the trial as in view of the<\/p>\n<p>                     nature of allegation that there does not appear to be along with<\/p>\n<p>                     list of prosecution witnesses, the court shall take all expeditious<\/p>\n<p>                     steps to see that the trial is concluded within six months from<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>            today in case, it is not so concluded, petitioner would be at<\/p>\n<p>            liberty to renew his prayer for bail before the trial court.<\/p>\n<pre>Devendra\/                                        ( Navaniti Prasad Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ramdeo Rajak vs The State Of Bihar on 28 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
