APP (SJ) No.974 of 2008\n                                         MUNNA\n                                          Versus\n                                   STATE OF BIHAR\n                                        -----------\n<\/pre>\n<pre>6.   01 .4.2011                 I.A.No. 655 of 2011\n\n                                Appellant     Munna, who stands convicted for\n\n<\/pre>\n<p>                  committing offences under Sections 147,148,323, 304 read with<\/p>\n<p>                  Section 149 of the Indian Penal Code and was directed to suffer<\/p>\n<p>                  rigorous imprisonment for ten years on account of committing<\/p>\n<p>                  the offences under Section 304\/149 of the Penal Code, has filed<\/p>\n<p>                  the present interlocutory application with a prayer to suspend his<\/p>\n<p>                  conviction as ordered by the Additional Sessions Judge, Fast<\/p>\n<p>                  Track Court No. 8, Purnia by his judgment and order dated<\/p>\n<p>                  13.8.2008 and 19.8.2008, respectively, in Sessions Case No. 280<\/p>\n<p>                  of 2005\/ Tr. No.128 of 2008.\n<\/p>\n<p>                                It was contended on behalf of the appellant that the<\/p>\n<p>                  case arises out of a rivalry between families of two persons who<\/p>\n<p>                  were past and present Mukhiyas on the day of occurrence and<\/p>\n<p>                  the appellant being son of an Ex-Mukhiya has falsely been<\/p>\n<p>                  implicated in this case. It was contended that the appellant is<\/p>\n<p>                  desirous of contesting the ensuing elections for Mukhiya-ship<\/p>\n<p>                  and there being no straightjacket formula for considering this<\/p>\n<p>                  issue, this Court should consider the right of the petitioner to<\/p>\n<p>                  contest the elections as the wishes of a citizen.<\/p>\n<p>                                There are two decisions of this Court &#8211; one<\/p>\n<p>                  reported in 2009(2) P.L.J.R. 650 Rajesh Ranjan alias Pappu<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Yadav Vs. State of Bihar through C.B.I. and the other<\/p>\n<p>unreported decision which was passed on a similar petition<\/p>\n<p>bearing I.A. No. 1522 of 2010 in Cr. Appeal No. 358 of<\/p>\n<p>2008(D.B.) on 30.9.2010. The scope and ambit of the powers of<\/p>\n<p>an appellate court under Section 389(1) Cr. P.C. has been<\/p>\n<p>discussed broadly in    the unreported order    of the Division<\/p>\n<p>Bench to which I was also a party in paragraph 6 which runs as<\/p>\n<p>under:\n<\/p>\n<blockquote><p>         Section 389(1) Cr.P.C. empowers appellate court to<br \/>\n         order that execution of sentence or order appealed<br \/>\n         against be suspended and also, if any convicted<br \/>\n         person is in confinement that he be released on bail<br \/>\n         or his own bond. Sub-section(2)of that Section<br \/>\n         entitles the High Court also to exercise that power<br \/>\n         in case of an appeal by a person convicted by a sub-<br \/>\n         ordinate court. It is too well known to be pointed<br \/>\n         out that if there could not be any conviction, there<br \/>\n         could not be any question of passing any sentence<br \/>\n         and, as such, the order of sentence is consequential<br \/>\n         to the order of conviction. As such, the word<br \/>\n         \u201eorder&#8217; which appears after the words \u201eexecution<br \/>\n         of sentence&#8217; being conjuncted by \u201eor\u201f refers to an<br \/>\n         order of conviction. As soon as an accused is<br \/>\n         granted bail and he is released from custody, the<br \/>\n         order of sentence could be said to be suspended<br \/>\n         automatically as the person is released and he could<br \/>\n         no longer be said to be serving out the sentence<br \/>\n         which was directed to be served by him on being<br \/>\n         inflicted upon him. But, the effect of his conviction<br \/>\n         remains, till it is suspended. A subsisting order of<br \/>\n         conviction may entail many disqualifications upon a<br \/>\n         convicted person. If the conviction is suspended, the<br \/>\n         effect of such an order is not only that the sentence<br \/>\n         is automatically stayed as in that situation the<br \/>\n         convicted person has necessarily to be released<br \/>\n         from custody but also that the disqualification<br \/>\n         arising out of the order of conviction may<br \/>\n         temporarily be erased entitling the convict to<br \/>\n         contest an election. He is also precluded from<br \/>\n         serving out the sentence and, thereby, his sentence<br \/>\n         also stands suspended. It may, as such, be noted that<br \/>\n         suspending the order of conviction is a very serious<br \/>\n         judicial business and the order in that behalf may<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>          not as ordinarily be granted as the Court is<br \/>\n          approached. The exceptional nature of an order<br \/>\n          suspending the conviction of a convict, may be<br \/>\n          gathered from this fact that the provision mandates<br \/>\n          the appellate court to record reasons in writing for<br \/>\n          suspending the order of conviction. What, therefore,<br \/>\n          implies is that if the appellate court is not inclined<br \/>\n          to suspend the conviction of a person under Section<br \/>\n          389(1) Cr.P.C. then also it may be all the more<br \/>\n          necessary for the appellate court to record reasons<br \/>\n          of refusing the prayer because it might ultimately be<br \/>\n          continuing the disqualification which the convicted<br \/>\n          person might have incurred on account of being<br \/>\n          visited with an order of conviction. The above<br \/>\n          aspect on the scope and ambit of Section 389 (1)<br \/>\n          Cr.P.C. was considered by this Court while<br \/>\n          considering a similar prayer in Rajesh Ranjan alias<br \/>\n          Pappu Yadav Vs. State of Bihar through CBI<br \/>\n          reported in 2009(2) P.L.J.R 650.&#8221;<\/p><\/blockquote>\n<p>          It is true that there is no direct allegation against the<\/p>\n<p>present petitioner of dealing any blow but his participation as<\/p>\n<p>one of the members of the unlawful assembly armed with<\/p>\n<p>deadly weapon, like a firearms, has been upheld by the trial<\/p>\n<p>court. As such, he has also been held guilty under Sections<\/p>\n<p>304\/149 of the Penal Code.         The scope of this Court\u201fs<\/p>\n<p>jurisdiction under Section 389(2) Cr. P.C. is not as broad as it<\/p>\n<p>has while deciding an appeal as for consideration of the<\/p>\n<p>prayer of the present nature, the Court has simply to consider<\/p>\n<p>the evidence in the manner as could be suggestive of<\/p>\n<p>sufficiency of material on participation. That appears<\/p>\n<p>discussed by the learned trial Judge in his judgment and<\/p>\n<p>considering that it could not be said that the findings were<\/p>\n<p>completely erroneous or such as could be permitting this<\/p>\n<p>Court to direct suspension of the conviction of the petitioner<br \/>\n<span class=\"hidden_text\">                        4<\/span><\/p>\n<p>as prayed for.\n<\/p>\n<p>          Besides, as regards the contention of the appellant<\/p>\n<p>that he is desirous of contesting the ensuing elections for<\/p>\n<p>Mukhiya-ship, simply being desirous of contesting election<\/p>\n<p>may not be sufficient to entitle a person to an order in his<\/p>\n<p>favour suspending his conviction. This Court has already<\/p>\n<p>pointed out in Rajesh Ranjan alias Pappu Yadav(Supra) that<\/p>\n<p>contesting election may not be a ground for allowing the<\/p>\n<p>prayer of the present nature as it may not entail an irreversible<\/p>\n<p>consequence upon a person like the petitioner. While so doing<\/p>\n<p>this Court had pointed out that &#8220;Fighting an election may be a<\/p>\n<p>democratic right of a citizen but his wishes of being elected in<\/p>\n<p>the election cannot be categorized as any of his rights. In<\/p>\n<p>politics, one could not say that his position is irreversible. A<\/p>\n<p>person could be holding the highest office of the executive one<\/p>\n<p>day but by sheer change in political circumstances, he might be<\/p>\n<p>finding himself out of that position and as a mere Member or<\/p>\n<p>even as no Member of the House of any legislature or<\/p>\n<p>Parliament. Likewise, one could have won and could have been<\/p>\n<p>elected as a Member of the Parliament in one particular election,<\/p>\n<p>but in the other, he might not be winning the elections or the<\/p>\n<p>worst of the possibility could be that if he is affiliated to any<\/p>\n<p>particular political party, then that party may not consider him to<\/p>\n<p>be fit for being fielded as its candidate in any constituency.<\/p>\n<p>Thus, the plea of irreversible consequence appears of no benefit<\/p>\n<p>to the appellant. Injustice could not be said to be inflicted upon<br \/>\n<span class=\"hidden_text\">                               5<\/span><\/p>\n<p>        any one merely because the court has a definite opinion on a<\/p>\n<p>        particular issue under the special facts and circumstances of the<\/p>\n<p>        case rather the court could be justified in passing a particular<\/p>\n<p>        order.&#8221;\n<\/p>\n<p>                   In addition to the above, in the same order rendered<\/p>\n<p>        in Cr. Appeal No. 358 of 2008) (D.B.) on I.A. No. 1522 of<\/p>\n<p>        2010 after having considered all the relevant decisions on<\/p>\n<p>        constitutional provisions, this Court recorded that suspending<\/p>\n<p>        the order of sentence may be watering down the constitutional<\/p>\n<p>        provision not only on exercising right of adult franchise of the<\/p>\n<p>        citizen but also on contesting an election.\n<\/p>\n<p>                  For the foregoing reasons, I am not inclined to<\/p>\n<p>        allow the present interlocutory application and thereby to<\/p>\n<p>        direct suspension of the conviction of the appellant.
