 AA 2. .0 Eirief facts of the case are:<\/p>\n
That on 09.06.2007 when deceased Raja was<\/p>\n
it  2 ._.i\u00a7go1ng on his bike on the extreme side of Bangalore ~<\/p>\n
Tumkur road in front of Preethisagar Hotel, near<\/p>\n
T. Dasarahalli a lorry bearing registration No.
\nTN–4l–9191 came from back side in a rash and<\/p>\n
negligent manner and dashed against him frorri<\/p>\n
as a result he sustained grievous injuries’,.”lIr1njediat_ely* <\/p>\n
he was taken to Ramaiah'””‘H’ospital.;  he i’<\/p>\n
succumbed to injuries on <\/p>\n
Parents and sister filed
\nBangalore seeking ._   \/ — and
\nthe Tribunal  all-fclolrnpensation of
\nRs.3,  Aggrieved by the
\n vthelgclalimants have preferred
\n of compensation.\n<\/p>\n
3.  t.here regarding the death of<\/p>\n
deceased the accident, negligence and liability<\/p>\n
  insurer of the offending vehicle, the only point<\/p>\n
 ._ ‘that”1’e’I_n_ains”‘for consideration is:<\/p>\n
‘ -.  VVhether the compensation. awarded by
\n” _ the Tribunal is just and reasonable or does it
\n“call for enhancement or reduction’?<\/p>\n
4. After hearing the learned Counsel appearing for
\nthe parties and perusing the judgment and awardof the<\/p>\n
Tribunal I am of the View that the compe-njsation<\/p>\n
awarded by the Tribunal is not just  <\/p>\n
is on the lower side and therefore’ it is dese’rVed’Vlto be 7<\/p>\n
enhanced.\n<\/p>\n
5. Deceased Raja was  at  tilne of his
\ndeath in the  post mortem
\nreport Ex P     and sister of
\ndeceased’     contention that
\ndeC\u20ac:a–se.d– p.m. by doing Mestri
\n claimant as PW 1 have
\nnot prod.:;ced\ufb02Vanyv_document in this regard. In the<\/p>\n
,_of pr’o'”vf–oi” income, considering his age as 21<\/p>\n
V  “time of his death in the accident and year<\/p>\n
l’of’laccide7i_1t’ his income could easily be assessed at<\/p>\n
 Rs.4\u00bb’.”:,Vt_)AiZ)0\/– p.m. As deceased was a bachelor 50% of<\/p>\n
  income has to be deducted towards his personal<\/p>\n
expenses. The multiplier has to be applied as per the<\/p>\n
age of his mother who is 40 years. The multiplier<\/p>\n
applicable to her age is 15. Accordingly, loss of
\ndependency works out to Rs.3,60,000\/~ (Rs.4,000\/- X
\n50% x 12 x 15) and it is awarded <\/p>\n
Rs.2,52,000\/- awarded by the Tribunal.   <\/p>\n
6. Rs. 16,400\/~ awarded tewa;-ds;hafspieai-fehafrgeeaand<\/p>\n
medical expenses, Rs.lE.l_0O.Q\/– awarded ALl’I’1dw\u20ac1’5\u20acaCl’1.f’<\/p>\n
heads of loss of love and V_affeCtion, lossopf estate and

just and proper and : theyi::do_:r1ovt _ call  interference.<\/p>\n
7. Thus  ‘are entitled for the following

2) .V Loss of love. 81 affection Rs. 15,000\/~
\n; l ” 3)  of estate Rs. 15,000\/–

\n_   _  funeral expenses Rs. 15,OOO\/–
\n”  _ 5)”  Hospital charges and
\n  Medical expenses Rs. l6,400\/-<\/p>\n
Total Rs. 44,21,400\/~<\/p>\n
  Accordingly the appeal is allowed in part. The<\/p>\n
  judgment and award of the Tribunal is modi\ufb01ed to the<\/p>\n
extend stated herein above. The claimants are entitled<\/p>\n
(5%-\n<\/p>\n

for a total compensation of Rs.4,21,400\/– as against
\nRs.3,18,400\/– awarded by the Tribunal with interest at<\/p>\n
