Jammu and Kashmir Academy of Art,
\nCulture and Languages, Srinagar, (the Academy,
\nfor short), issued its Employment Notice No. ADME\/
\n12\/2003-04\/3099-3113 dated 22nd of September,
\n2003, through its Secretary, inviting
\napplications from the Permanent Residents of
\nJammu and Kashmir State, for selection against
\nvacant posts in the Academy, on its, Executive,
\nCultural, Teaching, Library, Technical and
\nEditorial Cadres. The posts so advertised included
\n2<\/span>
\ntwo posts of Cultural Officer for Leh and Kargil
\nOffice, in the Cultural Cadre. The qualification
\nprescribed therefor was:\n<\/p>\n
1.Post Graduation from a recognized University.\n<\/p>\n
2.Thorough knowledge of Cultural History of J&K.\n<\/p>\n
3.Adequate knowledge of two regional languages.\n<\/p>\n
4.Thorough knowledge of Folk performing art
\ntraditions of the State.\n<\/p>\n
Applications accompanied by a postal order
\nof Rs.50\/-, for the posts including those of the
\nCultural Officer, were required to reach the
\nSecretary Jammu and Kashmir Academy of Art,
\nCulture and Languages, Lal Mandi, Srinagar
\nalong with attested copies of the:\n<\/p>\n
1. Academic and Professional qualifications;\n<\/p>\n
2. Age and health;\n<\/p>\n
3. State Subject;\n<\/p>\n
4. Experience
\non or before 31st October, 2003.
\nThose in Government Service, had to route
\ntheir applications through proper channel.
\nOut of forty four candidates found eligible to
\nseek consideration for the posts of Cultural
\nOfficers, only seventeen appeared for the interview
\non 20th of September, 2006 at Cultural Complex,
\n3<\/span>
\nLeh before the Selection Committee constituted by
\nthe President of the Academy, the Chief Minister
\nof the State, which comprised of the following
\nmembers:\n<\/p>\n
1. Secretary Academy Chairman\n<\/p>\n
2. Sh. Zaffar Ahmad
\nAddl. Secretary to
\nChief Minister Member.\n<\/p>\n
3. Sh. T. R. Sharma, Member.\n<\/p>\n
Addl. Secretary Academy.\n<\/p>\n
Jammu\n<\/p>\n
4. Mr. Zaffar Iqbal,
\nAddl. Secretary Academy
\nSrinagar Member.\n<\/p>\n
Dr. Janyang Gailson, Lecturer Central
\nInstitute of Buddhist Studies was co-opted by the
\nCommittee as Expert on the Selection Committee.
\nThe Committee, after evaluating the merit,
\nsuitability, experience and qualification of the
\ncandidates, recommended a panel of four persons
\nfor appointment to the post of Cultural Officer,
\nLeh.\n<\/p>\n
Shri Tsewang Paljore, selected at Serial No. 1<\/span><\/p>\n
of the panel was, accordingly, appointed as
\n4<\/span>
\nCultural Officer, Leh vide Academy Order No. 72
\nof 2006 dated 23-11-2006.\n<\/p>\n
Sonam Joldan and Sonam Chosjore, who too
\nhad appeared seeking consideration for selection
\nagainst the Advertised Post before the Selection
\nCommittee, have filed this writ petition seeking
\nquashing of Tsewang Paljores selection and
\nappointment, besides a command to the Academy
\nto appoint them as Cultural Officers.
\nQuestioning Tsewang Paljore, Respondent No.
\n6s selection and appointment as Cultural Officer,
\nLeh, the petitioners say that respondent no.1 and
\nits Selection Committee, had violated the
\nfundamental right of Equality before the Law and
\nequal protection of the laws by converting their
\nmerit into demerit, adopting arbitrary
\nmethodology for selection, rendering the whole
\nselection process unfair and a mere eye wash,
\ndesigned to favour respondent no. 6.
\nPetitioner No. 2 is stated to be a Gold
\nMedalist, possessing M.A and M.Phil Degrees and
\npresently engaged in Ph.D in Political Science,
\n5<\/span>
\nwhereas petitioner No.1 is stated to have done his
\nMasters Degree from Delhi University, besides
\npossessing Ph.D in Ladakhs Traditional Ties
\nwith Buddhist Tibet from Jawahar Lal Nehru
\nUniversity 2006 and M.Phil in Buddhist Tibet
\nCultural Ties with Ladakh and Mustang. He is
\nstated to have published papers titled Budhist
\nTibet Cultural Ties with Ladakh Tibetan Review,
\nNovember, 2003, two articles titled Relationship
\nbetween Ladakh and Buddhist Tibet Trade and
\nPilgrimage and Ladakh Traditional Ties with
\nBuddhist Tibet, Monastic Organization and
\nMonastic Education as a sustaining factor in
\nTibet Journal. He is further stated to have
\npresented paper on Ladakh\/Tibetan Cultural
\nties in the 10th International Association for
\nLadakh Studies, held in Oxford-2001 besides
\nparticipating in 2006 World Youth Care for Tibet-
\nTaiwan Forum.\n<\/p>\n
Projecting his activities in the Sports Field,
\npetitioner No.1 is stated to have been awarded
\nNational Awards i.e. Three Gold Medals in Tenth
\n6<\/span>
\nJunior and 8th Sub Junior National Archery
\nChampionship and also New National Record
\nHolder in the XXXVI National Shooting
\nChampionship Competition held in 1993.
\nPetitioners have indicated, in the Rejoinder to
\ntheir writ petition that the documents supplied by
\nthe Academy vide letter No. CA.PS\/2006-
\n2007\/961 dated 16.02.2007 reveal that Tsewang
\nPaljore, respondent No. 6, did not possess any
\nadditional qualification i.e. of possessing M.Phil or
\nPh.D Degrees and would possess only Masters
\nDegree, and that too, with the 2nd Division.
\nAccording to the petitioners, the three months
\nComputer Course Certificate and Certificate of
\nDiploma in Journalism produced by Respondent
\nNo. 6 could not be taken into consideration by the
\nSelection Committee because those had been
\nobtained after the cut-off date fixed in the
\nNotification and even otherwise would not qualify
\nthe respondent for the award of marks for
\npossessing Additional qualification according to
\nthe criteria fixed by the Selection Committee.\n<\/p>\n
7<\/span><\/p>\n
Petitioners have further indicated in their
\nrejoinder as to how had the Selection Committee
\nconverted their merit into demerit in omitting to
\naward them marks which they were entitled to,
\naccording to the criteria fixed for the purpose, and
\nthat the Selection Committee had allowed marks
\nunder the heads additional qualification, and
\npublished works to respondent No.6 which he
\nwas not otherwise entitled to, in terms of the
\ncriteria fixed by the Selection Committee.
\nElaborating their submissions, it is stated that
\nrespondent no.6 was not entitled to be awarded
\nfor the published works because he had NO
\npublished work to his credit when he had applied
\nseeking consideration for selection. Awarding of
\n24 marks under this head to respondent No. 6, by
\nthe Selection Committee, was thus unwarranted
\nand unjustified.\n<\/p>\n
Perusal of the records made available by the
\nAcademy, and the material placed on the records
\nby the parties to the writ petition, indicate that
\nthe criterion fixed for evaluating the merit and
\n8<\/span>
\nsuitability of the candidates, for selection, against
\nthe post of Cultural Officers, was as follows:\n<\/p>\n
1. Qualification 10 Marks
\n(M.A. 1st Division 10 Marks 2nd Div. 8 Marks 3rd Div, 7 Marks)\n<\/p>\n
2. Additional Qualification 10 Marks
\n(M. Phil, Ph.D, Degree (two years), Diploma one year)\n<\/p>\n
3. Published work 10 Marks
\n(Book published)\n<\/p>\n
4. Viva-Voce 50 Marks
\n(10 marks to each member)
\nThe merit of the petitioners and respondent
\nNo. 6 which the Academys Selection Committee
\nhad evaluated, has been indicated in Academys
\nObjections\/Counter Affidavit as follows:
\nPerusal of the records further indicates that
\nrather than evaluating the merit of candidates out
\nof 10 marks earmarked for, Basic Qualification,
\nAdditional Qualification and Published Works, the
\nAcademy had taken the sum total of the
\nName of the candidate Qualification

\nevaluation made by each member of the Selection
\nCommittee under these heads. This error,
\nhowever, may not affect the determination of the
\nissue which falls for consideration in this petition
\nas to whether or not the selection conducted by
\nthe Academy for the post of Cultural Officer was
\nvalid?, for the evaluation so made can be
\nconverted into requisite evaluation of each
\ncandidate out of the total marks earmarked for
\nsuch evaluation, by dividing the evaluation of the
\nCommittee, by five.\n<\/p>\n
When so done, the merit of the candidates
\nrelevant for the purpose of this petition would be
\nas follows:-\n<\/p>\n

\nAlthough the Selection Committee had
\nadopted a specific criteria for evaluating the merit
\nand awarding marks to the candidates for
\nacquisition of Minimum prescribed qualification,
\nAdditional qualification, etc., yet rather than
\nfollowing the laid-down criteria, each member had
\nawarded marks to the candidates for Minimum
\nprescribed qualification, Additional qualification
\netc. according to his own assessment, which
\naction of theirs is incomprehensible, for, after
\nlaying down the criteria for awarding ten marks to
\nthose who had secured 1st Division in the
\nprescribed qualification of Post Graduation, eight
\nmarks to those who had acquired Post Graduation
\nwith 2nd Division and seven marks to those who
\nwere placed in the 3rd Division and likewise, ten
\nmarks on account of having acquired additional
\nqualification to only those who were holding
\nM.Phil, Ph.D, Degree with two years or Diploma
\nwith one year, no discretion was left to the
\nmembers to assess the merit of the candidates,
\naccording to their whims.\n<\/p>\n
11<\/span><\/p>\n
The marks awarded by each member to the
\npetitioners and the respondent under the above
\nreferred two heads, too differ, and arbitrary
\napproach appears to have been adopted by the
\nmembers in awarding marks under these two
\nheads to the candidates thereby hinting at
\narbitrary, irrational and unfair approach of the
\nmembers of the Selection Committee in assessing
\nthe merit of the candidates. One of the members
\nof the Selection Committee had gone to the extent
\nof even omitting to award any marks to petitioner
\nno.1 for his Additional qualification.
\nRecords further indicate that respondent
\nNo.6 did not possess any Additional qualification
\nat the time when he had applied for consideration
\nagainst the advertised post, and had produced
\ndocuments evidencing acquisition of Additional
\nqualification of a three months Basic Computer
\nCourse at Leh on 31st June, 2005 from SIPA
\nCOMPUTER CENTRE and Post Graduate Diploma
\nin Journalism issued on 25th May, 2004 by
\nMANAGEMENT STUDIES PROMOTION INSTI12
\nTUTE, NEW DELHI, during the currency of the
\nSelection Process BUT admittedly much after 31st
\nOctober, 2003, the date prescribed as such in the
\nadvertisement notice, for receipt of testimonials.
\nIn view of the above mentioned factual
\nposition emerging from the records, it becomes
\napparent that the members of the Selection
\nCommittee had failed to follow the laid-down
\ncriteria for awarding marks to the candidates for
\npossessing Basic qualification, Additional
\nqualification and Published work, to assess their
\nmerit and suitability for the advertised post. Such
\ncourse adopted by the Selection Committee in not
\nfollowing the laid-down criteria for assessing the
\nmerit of the candidates, in the absence of any
\njustifiable cause for deviating from the laid-down
\ncriteria, projected during the hearing of the
\npetition, is nothing but stark arbitrariness.
\nThe action of the Selection Committee in
\ntaking into consideration the qualifications
\nacquired by respondent No.6 after the cut-off date
\nof 31st October, 2003 and awarding marks to him
\n13<\/span>
\nfor such qualifications, without providing any
\nopportunity to other candidates of referring to
\ntheir Additional qualifications, if any, possessed
\nduring the currency of the Selection Process,
\noffends Article 14 of the Constitution of India.
\nTaking into consideration the biased
\napproach of the Selection Committee in evaluating
\nrespondent No.6s merit against the laid-down
\ncriterion, and awarding him marks much more
\nthan the one which he would have been entitled to
\nin terms of the criterion, and omitting to award
\nmarks to the candidates, which they were entitled
\nto, in terms of the laid-down criterion, clearly
\ndemonstrates unfair and arbitrary approach of the
\nCommittee, in assessing the merit of the eligible
\ncandidates and preparing the panel of candidates
\nfor selection against the post of the Cultural
\nOfficer, Leh leading to the issuance of Academy
\nOrder No.72 of 2006 dated 23.11.2006 appointing
\nrespondent No.6 as Cultural Officer, Leh.
\nFor all what has been said above, Tsewang
\nPaljor, respondent No.6s Selection, found to be in
\n14<\/span>
\nviolation of the laid-down criteria, is held to be
\narbitrary and in violation of Article 14 of the
\nConstitution of India.\n<\/p>\n
The Writ petition, therefore, succeeds, and is
\naccordingly allowed quashing Academys Selection
\nPanel for the post of Cultural Officer, Leh and
\nsetting aside the Selection and Appointment of
\nTsewang Paljor, respondent No.6 against the
\npost of Cultural Officer, Leh notified for Selection
\nby the Jammu and Kashmir Academy of Art,
\nCulture and Languages, Srinagar vide
\nEmployment Notice No. ADM-E\/12\/2003-
\n04\/3099-3113 dated 22nd of September, 2003.
\nAcademy to bear the litigation expenses of the
\npetitioners, which are assessed at Rs.10,000\/-.
