SINGH, JUDGE.    \nDate: 17\/04\/2009 \n:J U D G M E N T :\n<\/pre>\n<p>Jammu and Kashmir Academy of Art,<br \/>\nCulture and Languages, Srinagar, (the Academy,<br \/>\nfor short), issued its Employment Notice No. ADME\/<br \/>\n12\/2003-04\/3099-3113 dated 22nd of September,<br \/>\n2003, through its Secretary, inviting<br \/>\napplications from the Permanent Residents of<br \/>\nJammu and Kashmir State, for selection against<br \/>\nvacant posts in the Academy, on its, Executive,<br \/>\nCultural, Teaching, Library, Technical and<br \/>\nEditorial Cadres. The posts so advertised included<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\ntwo posts of Cultural Officer for Leh and Kargil<br \/>\nOffice, in the Cultural Cadre. The qualification<br \/>\nprescribed therefor was:\n<\/p>\n<p>1.Post Graduation from a recognized University.\n<\/p>\n<p>2.Thorough knowledge of Cultural History of J&amp;K.\n<\/p>\n<p>3.Adequate knowledge of two regional languages.\n<\/p>\n<p>4.Thorough knowledge of Folk performing art<br \/>\ntraditions of the State.\n<\/p>\n<p>Applications accompanied by a postal order<br \/>\nof Rs.50\/-, for the posts including those of the<br \/>\nCultural Officer, were required to reach the<br \/>\nSecretary Jammu and Kashmir Academy of Art,<br \/>\nCulture and Languages, Lal Mandi, Srinagar<br \/>\nalong with attested copies of the:\n<\/p>\n<p>1. Academic and Professional qualifications;\n<\/p>\n<p>2. Age and health;\n<\/p>\n<p>3. State Subject;\n<\/p>\n<p>4. Experience<br \/>\non or before 31st October, 2003.<br \/>\nThose in Government Service, had to route<br \/>\ntheir applications through proper channel.<br \/>\nOut of forty four candidates found eligible to<br \/>\nseek consideration for the posts of Cultural<br \/>\nOfficers, only seventeen appeared for the interview<br \/>\non 20th of September, 2006 at Cultural Complex,<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\nLeh before the Selection Committee constituted by<br \/>\nthe President of the Academy, the Chief Minister<br \/>\nof the State, which comprised of the following<br \/>\nmembers:\n<\/p>\n<p>1. Secretary Academy Chairman\n<\/p>\n<p>2. Sh. Zaffar Ahmad<br \/>\nAddl. Secretary to<br \/>\nChief Minister Member.\n<\/p>\n<p>3. Sh. T. R. Sharma, Member.\n<\/p>\n<p>Addl. Secretary Academy.\n<\/p>\n<p>Jammu\n<\/p>\n<p>4. Mr. Zaffar Iqbal,<br \/>\nAddl. Secretary Academy<br \/>\nSrinagar Member.\n<\/p>\n<p>Dr. Janyang Gailson, Lecturer Central<br \/>\nInstitute of Buddhist Studies was co-opted by the<br \/>\nCommittee as Expert on the Selection Committee.<br \/>\nThe Committee, after evaluating the merit,<br \/>\nsuitability, experience and qualification of the<br \/>\ncandidates, recommended a panel of four persons<br \/>\nfor appointment to the post of Cultural Officer,<br \/>\nLeh.\n<\/p>\n<p><span class=\"hidden_text\">Shri Tsewang Paljore, selected at Serial No. 1<\/span><\/p>\n<p>of the panel was, accordingly, appointed as<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\nCultural Officer, Leh vide Academy Order No. 72<br \/>\nof 2006 dated 23-11-2006.\n<\/p>\n<p>Sonam Joldan and Sonam Chosjore, who too<br \/>\nhad appeared seeking consideration for selection<br \/>\nagainst the Advertised Post before the Selection<br \/>\nCommittee, have filed this writ petition seeking<br \/>\nquashing of Tsewang Paljores selection and<br \/>\nappointment, besides a command to the Academy<br \/>\nto appoint them as Cultural Officers.<br \/>\nQuestioning Tsewang Paljore, Respondent No.<br \/>\n6s selection and appointment as Cultural Officer,<br \/>\nLeh, the petitioners say that respondent no.1 and<br \/>\nits Selection Committee, had violated the<br \/>\nfundamental right of Equality before the Law and<br \/>\nequal protection of the laws by converting their<br \/>\nmerit into demerit, adopting arbitrary<br \/>\nmethodology for selection, rendering the whole<br \/>\nselection process unfair and a mere eye wash,<br \/>\ndesigned to favour respondent no. 6.<br \/>\nPetitioner No. 2 is stated to be a Gold<br \/>\nMedalist, possessing M.A and M.Phil Degrees and<br \/>\npresently engaged in Ph.D in Political Science,<br \/>\n<span class=\"hidden_text\">5<\/span><br \/>\nwhereas petitioner No.1 is stated to have done his<br \/>\nMasters Degree from Delhi University, besides<br \/>\npossessing Ph.D in Ladakhs Traditional Ties<br \/>\nwith Buddhist Tibet from Jawahar Lal Nehru<br \/>\nUniversity 2006 and M.Phil in Buddhist Tibet<br \/>\nCultural Ties with Ladakh and Mustang. He is<br \/>\nstated to have published papers titled Budhist<br \/>\nTibet Cultural Ties with Ladakh Tibetan Review,<br \/>\nNovember, 2003, two articles titled Relationship<br \/>\nbetween Ladakh and Buddhist Tibet Trade and<br \/>\nPilgrimage and Ladakh Traditional Ties with<br \/>\nBuddhist Tibet, Monastic Organization and<br \/>\nMonastic Education as a sustaining factor in<br \/>\nTibet Journal. He is further stated to have<br \/>\npresented paper on Ladakh\/Tibetan Cultural<br \/>\nties in the 10th International Association for<br \/>\nLadakh Studies, held in Oxford-2001 besides<br \/>\nparticipating in 2006 World Youth Care for Tibet-<br \/>\nTaiwan Forum.\n<\/p>\n<p>Projecting his activities in the Sports Field,<br \/>\npetitioner No.1 is stated to have been awarded<br \/>\nNational Awards i.e. Three Gold Medals in Tenth<br \/>\n<span class=\"hidden_text\">6<\/span><br \/>\nJunior and 8th Sub Junior National Archery<br \/>\nChampionship and also New National Record<br \/>\nHolder in the XXXVI National Shooting<br \/>\nChampionship Competition held in 1993.<br \/>\nPetitioners have indicated, in the Rejoinder to<br \/>\ntheir writ petition that the documents supplied by<br \/>\nthe Academy vide letter No. CA.PS\/2006-<br \/>\n2007\/961 dated 16.02.2007 reveal that Tsewang<br \/>\nPaljore, respondent No. 6, did not possess any<br \/>\nadditional qualification i.e. of possessing M.Phil or<br \/>\nPh.D Degrees and would possess only Masters<br \/>\nDegree, and that too, with the 2nd Division.<br \/>\nAccording to the petitioners, the three months<br \/>\nComputer Course Certificate and Certificate of<br \/>\nDiploma in Journalism produced by Respondent<br \/>\nNo. 6 could not be taken into consideration by the<br \/>\nSelection Committee because those had been<br \/>\nobtained after the cut-off date fixed in the<br \/>\nNotification and even otherwise would not qualify<br \/>\nthe respondent for the award of marks for<br \/>\npossessing Additional qualification according to<br \/>\nthe criteria fixed by the Selection Committee.\n<\/p>\n<p><span class=\"hidden_text\">7<\/span><\/p>\n<p>Petitioners have further indicated in their<br \/>\nrejoinder as to how had the Selection Committee<br \/>\nconverted their merit into demerit in omitting to<br \/>\naward them marks which they were entitled to,<br \/>\naccording to the criteria fixed for the purpose, and<br \/>\nthat the Selection Committee had allowed marks<br \/>\nunder the heads additional qualification, and<br \/>\npublished works to respondent No.6 which he<br \/>\nwas not otherwise entitled to, in terms of the<br \/>\ncriteria fixed by the Selection Committee.<br \/>\nElaborating their submissions, it is stated that<br \/>\nrespondent no.6 was not entitled to be awarded<br \/>\nfor the published works because he had NO<br \/>\npublished work to his credit when he had applied<br \/>\nseeking consideration for selection. Awarding of<br \/>\n24 marks under this head to respondent No. 6, by<br \/>\nthe Selection Committee, was thus unwarranted<br \/>\nand unjustified.\n<\/p>\n<p>Perusal of the records made available by the<br \/>\nAcademy, and the material placed on the records<br \/>\nby the parties to the writ petition, indicate that<br \/>\nthe criterion fixed for evaluating the merit and<br \/>\n<span class=\"hidden_text\">8<\/span><br \/>\nsuitability of the candidates, for selection, against<br \/>\nthe post of Cultural Officers, was as follows:\n<\/p>\n<p>1. Qualification 10 Marks<br \/>\n(M.A. 1st Division 10 Marks 2nd Div. 8 Marks 3rd Div, 7 Marks)\n<\/p>\n<p>2. Additional Qualification 10 Marks<br \/>\n(M. Phil, Ph.D, Degree (two years), Diploma one year)\n<\/p>\n<p>3. Published work 10 Marks<br \/>\n(Book published)\n<\/p>\n<p>4. Viva-Voce 50 Marks<br \/>\n(10 marks to each member)<br \/>\nThe merit of the petitioners and respondent<br \/>\nNo. 6 which the Academys Selection Committee<br \/>\nhad evaluated, has been indicated in Academys<br \/>\nObjections\/Counter Affidavit as follows:<br \/>\nPerusal of the records further indicates that<br \/>\nrather than evaluating the merit of candidates out<br \/>\nof 10 marks earmarked for, Basic Qualification,<br \/>\nAdditional Qualification and Published Works, the<br \/>\nAcademy had taken the sum total of the<br \/>\nName of the candidate Qualification<br \/>\n10 marks<br \/>\nAdditional qualification<br \/>\n10 marks<br \/>\nPublished works<br \/>\n10 marks<br \/>\nViva voce<br \/>\n50 (10 marks for each<br \/>\nmember)<br \/>\nTotal<br \/>\nSonam Jaldon<br \/>\n(Petitioner No.1)<br \/>\n35 24 5 30 94<br \/>\nTsewang Paljor<br \/>\n(Respondent No. 6)<br \/>\n40 26 24 41 131<br \/>\nSonam Chosjor<br \/>\n(Petitioner No. 2)<br \/>\n40 13 4 13 70<br \/>\n<span class=\"hidden_text\">9<\/span><br \/>\nevaluation made by each member of the Selection<br \/>\nCommittee under these heads. This error,<br \/>\nhowever, may not affect the determination of the<br \/>\nissue which falls for consideration in this petition<br \/>\nas to whether or not the selection conducted by<br \/>\nthe Academy for the post of Cultural Officer was<br \/>\nvalid?, for the evaluation so made can be<br \/>\nconverted into requisite evaluation of each<br \/>\ncandidate out of the total marks earmarked for<br \/>\nsuch evaluation, by dividing the evaluation of the<br \/>\nCommittee, by five.\n<\/p>\n<p>When so done, the merit of the candidates<br \/>\nrelevant for the purpose of this petition would be<br \/>\nas follows:-\n<\/p>\n<p>Some more facts, appearing from the records<br \/>\nof the Academy, need to be noticed here.<br \/>\nName of the candidate Qualification<br \/>\n10 marks<br \/>\nAdditional qualification<br \/>\n10 marks<br \/>\nPublished works<br \/>\n10 marks<br \/>\nViva voce<br \/>\n50 (10 marks for each<br \/>\nmember)<br \/>\nTotal<br \/>\nSonam Jaldon<br \/>\n(Petitioner No.1)<br \/>\n7 4.8 5 30 46.8<br \/>\nTsewang Paljor<br \/>\n(Respondent No. 6)<br \/>\n8 5.2 4.8 41 59<br \/>\nSonam Chosjor<br \/>\n(Petitioner No. 2)<br \/>\n8 2.6 .08 13 24.4<br \/>\n<span class=\"hidden_text\">10<\/span><br \/>\nAlthough the Selection Committee had<br \/>\nadopted a specific criteria for evaluating the merit<br \/>\nand awarding marks to the candidates for<br \/>\nacquisition of Minimum prescribed qualification,<br \/>\nAdditional qualification, etc., yet rather than<br \/>\nfollowing the laid-down criteria, each member had<br \/>\nawarded marks to the candidates for Minimum<br \/>\nprescribed qualification, Additional qualification<br \/>\netc. according to his own assessment, which<br \/>\naction of theirs is incomprehensible, for, after<br \/>\nlaying down the criteria for awarding ten marks to<br \/>\nthose who had secured 1st Division in the<br \/>\nprescribed qualification of Post Graduation, eight<br \/>\nmarks to those who had acquired Post Graduation<br \/>\nwith 2nd Division and seven marks to those who<br \/>\nwere placed in the 3rd Division and likewise, ten<br \/>\nmarks on account of having acquired additional<br \/>\nqualification to only those who were holding<br \/>\nM.Phil, Ph.D, Degree with two years or Diploma<br \/>\nwith one year, no discretion was left to the<br \/>\nmembers to assess the merit of the candidates,<br \/>\naccording to their whims.\n<\/p>\n<p><span class=\"hidden_text\">11<\/span><\/p>\n<p>The marks awarded by each member to the<br \/>\npetitioners and the respondent under the above<br \/>\nreferred two heads, too differ, and arbitrary<br \/>\napproach appears to have been adopted by the<br \/>\nmembers in awarding marks under these two<br \/>\nheads to the candidates thereby hinting at<br \/>\narbitrary, irrational and unfair approach of the<br \/>\nmembers of the Selection Committee in assessing<br \/>\nthe merit of the candidates. One of the members<br \/>\nof the Selection Committee had gone to the extent<br \/>\nof even omitting to award any marks to petitioner<br \/>\nno.1 for his Additional qualification.<br \/>\nRecords further indicate that respondent<br \/>\nNo.6 did not possess any Additional qualification<br \/>\nat the time when he had applied for consideration<br \/>\nagainst the advertised post, and had produced<br \/>\ndocuments evidencing acquisition of Additional<br \/>\nqualification of a three months Basic Computer<br \/>\nCourse at Leh on 31st June, 2005 from SIPA<br \/>\nCOMPUTER CENTRE and Post Graduate Diploma<br \/>\nin Journalism issued on 25th May, 2004 by<br \/>\nMANAGEMENT STUDIES PROMOTION INSTI12<br \/>\nTUTE, NEW DELHI, during the currency of the<br \/>\nSelection Process BUT admittedly much after 31st<br \/>\nOctober, 2003, the date prescribed as such in the<br \/>\nadvertisement notice, for receipt of testimonials.<br \/>\nIn view of the above mentioned factual<br \/>\nposition emerging from the records, it becomes<br \/>\napparent that the members of the Selection<br \/>\nCommittee had failed to follow the laid-down<br \/>\ncriteria for awarding marks to the candidates for<br \/>\npossessing Basic qualification, Additional<br \/>\nqualification and Published work, to assess their<br \/>\nmerit and suitability for the advertised post. Such<br \/>\ncourse adopted by the Selection Committee in not<br \/>\nfollowing the laid-down criteria for assessing the<br \/>\nmerit of the candidates, in the absence of any<br \/>\njustifiable cause for deviating from the laid-down<br \/>\ncriteria, projected during the hearing of the<br \/>\npetition, is nothing but stark arbitrariness.<br \/>\nThe action of the Selection Committee in<br \/>\ntaking into consideration the qualifications<br \/>\nacquired by respondent No.6 after the cut-off date<br \/>\nof 31st October, 2003 and awarding marks to him<br \/>\n<span class=\"hidden_text\">13<\/span><br \/>\nfor such qualifications, without providing any<br \/>\nopportunity to other candidates of referring to<br \/>\ntheir Additional qualifications, if any, possessed<br \/>\nduring the currency of the Selection Process,<br \/>\noffends Article 14 of the Constitution of India.<br \/>\nTaking into consideration the biased<br \/>\napproach of the Selection Committee in evaluating<br \/>\nrespondent No.6s merit against the laid-down<br \/>\ncriterion, and awarding him marks much more<br \/>\nthan the one which he would have been entitled to<br \/>\nin terms of the criterion, and omitting to award<br \/>\nmarks to the candidates, which they were entitled<br \/>\nto, in terms of the laid-down criterion, clearly<br \/>\ndemonstrates unfair and arbitrary approach of the<br \/>\nCommittee, in assessing the merit of the eligible<br \/>\ncandidates and preparing the panel of candidates<br \/>\nfor selection against the post of the Cultural<br \/>\nOfficer, Leh leading to the issuance of Academy<br \/>\nOrder No.72 of 2006 dated 23.11.2006 appointing<br \/>\nrespondent No.6 as Cultural Officer, Leh.<br \/>\nFor all what has been said above, Tsewang<br \/>\nPaljor, respondent No.6s Selection, found to be in<br \/>\n<span class=\"hidden_text\">14<\/span><br \/>\nviolation of the laid-down criteria, is held to be<br \/>\narbitrary and in violation of Article 14 of the<br \/>\nConstitution of India.\n<\/p>\n<p>The Writ petition, therefore, succeeds, and is<br \/>\naccordingly allowed quashing Academys Selection<br \/>\nPanel for the post of Cultural Officer, Leh and<br \/>\nsetting aside the Selection and Appointment of<br \/>\nTsewang Paljor, respondent No.6 against the<br \/>\npost of Cultural Officer, Leh notified for Selection<br \/>\nby the Jammu and Kashmir Academy of Art,<br \/>\nCulture and Languages, Srinagar vide<br \/>\nEmployment Notice No. ADM-E\/12\/2003-<br \/>\n04\/3099-3113 dated 22nd of September, 2003.<br \/>\nAcademy to bear the litigation expenses of the<br \/>\npetitioners, which are assessed at Rs.10,000\/-.<br \/>\n(J.P.
