        Special Leave Petition (C) No.9489 of 2008 has been filed
\n  by   the   State   of   U.P.   against   the   interlocutory   order   dated
\n  04.04.2008 passed by the Division Bench of the Allahabad High
\n                                                 2<\/span><\/p>\n
Court, Lucknow Bench, Lucknow, in Writ Petition No. 3576 (M\/B)
\nof 2006 directing the State Government to maintain status quo
\nand not to raise any construction at any place which had been
\nnotified by the notices filed along with the affidavit dated
\n21.02.2008 of Shri Shankar Agarwal, the then Secretary, Housing,
\nGovernment of U.P..                On 21.04.2008, this Court while issuing
\nnotice       in     the     SLP     also     directed       stay        of    the     impugned
\ninterlocutory            order    dated    04.04.2008       passed       by    the    Division
\nBench of the Allahabad High Court, Lucknow Bench, Lucknow, and
\nfurther proceedings before the High Court in Writ Petition No
\n3576 (M\/B) of 2006.\n<\/p>\n
2.       Transfer Petitions Nos. 435-442 and 444 of 2008 have been
\nfiled by the State of U.P. for transferring to this Court Writ
\nPetitions Nos. 3576 (M\/B) of 2006, 3695 (M\/B) of 2006, 1368
\n(M\/B) of 2008, 8430 (M\/B) of 2007, 7357 (M\/B) of 2007, 9343
\n(M\/B) of 2007, 8782 (M\/B) of 2007, 2841 (M\/B) of 2008, and 3236
\n(M\/B) of 2006 pending before the Allahabad High Court, Lucknow
\nBench, Lucknow, on inter alia the ground that the question of
\nlaw raised in the writ petitions was the same as the one raised
\nin S.L.P. (C) 9489 of 2008.\n<\/p>\n
3.    On 08.09.2009, this Court passed orders in I.A. Nos. 65-66
\nof    2009    in     T.P.(C)       Nos.438       &   440    of     2008       recording   the
\nundertaking         on    behalf    of     the   State     of    U.P.    that    no    further
\nconstruction over the properties, which are subject-matter of
\nthe   writ        petitions      pending     before      the    Allahabad       High    Court,
\nLucknow Bench, Lucknow, would be made.                          Pursuant to reports in
\nthe newspapers that some work continued on the properties, this
\nCourt passed orders in I.A. Nos.65-66 of 2009 in T.P.(C) Nos.438
\n& 440 of 2008 directing that all activities of all manner and
\n                                                 3<\/span><\/p>\n
kinds, whether construction, repair or maintenance, shall stop
\nforthwith at all the construction sites covered by the previous
\norder of this Court and all the construction sites shall be
\nvacated of the entire workforce, excepting the watch and ward
\nstaff within six hours.\n<\/p>\n
4.        On    06.10.2009,          this     Court     further       passed       orders      in
\nI.A.Nos.65-66          of     2009     in     T.P.(C)     Nos.438      &     440     of     2008
\ninitiating the contempt proceedings against the Chief Secretary,
\nState of U.P., and directing notice to him to show-cause why he
\nshould not be proceeded against and punished for deliberate and
\nconscious violation of the undertaking given to this Court on
\n08.09.2009 and of the restraint order passed by this Court on
\n11.09.2009 and accordingly suo motu Contempt Petition (C) No.326
\nof 2009 has been registered.                     On 06.10.2009, this Court also
\npassed orders making the interim orders passed on 11.09.2009 in
\nI.A. Nos.65-66 of 2009 in T.P.(C) No.438 & 440 of 2008 absolute.\n<\/p>\n
5.   We have heard Mr. Harish N. Salve and Mr. R.N. Trivedi,
\nlearned     counsel          for    the     petitioners        and   Dr.     Abhishek       Manu
\nSinghvi, learned counsel for the respondents.\n<\/p>\n
6.   We        are     not        inclined     either     to      interfere         with       the
\ninterlocutory          order       dated     04.04.2008    passed      by     the    Division
\nBench of the Allahabad High Court, Lucknow Bench, Lucknow, in
\nWrit Petition No. 3576 (M\/B) of 2006 or to direct transfer of
\nthe writ petitions pending in the Allahabad High Court, Lucknow
\nBench, to this Court.                We, however, request the Chief Justice,
\nAllahabad       High       Court,     to     nominate     as    soon    as     possible        an
\nappropriate Bench to hear Writ Petition No. 3576 (M\/B) of 2006
\nalong   with         all    the    Writ     Petitions     which      were    sought       to   be
\n                                        4<\/span><\/p>\n
transferred to this Court by the Transfer Petitions (C) Nos.
\n435-442   and   444   of   2008   and   we   request   the   Bench   of   the
\nAllahabad High Court so nominated to hear and dispose of all
\nthese matters within a period of four months from the date of
\nconstitution of the Bench.\n<\/p>\n
7.   We had called upon the Chief Secretary, Government of U.P.,
\nto file an affidavit indicating the cleaning, maintenance and
\nrepair work which need to be done during the pendency of the
\nwrit petitions before the High Court and an affidavit has been
\nfiled by Shri V.K. Sharma, Acting Chief Secretary, Government of
\nU.P., along with the list of works that need to be done in the
\ndifferent project sites.          We have perused the list annexed to
\nthe affidavit of the Acting Chief Secretary, Government of U.P.,
\nbut we are not inclined to permit the State Government of U.P.
\nto carry out all the items of work mentioned in the list annexed
\nas Annexure-I.    Instead, we direct that until the writ petitions
\nare disposed of by the Bench of the Allahabad High Court to be
\nnominated by the Chief Justice, the interim orders which were
\npassed by this Court on 11.09.2009 in I.A. Nos. 65-66 of 2009 in
\nT.P.(C) Nos.438 & 440 of 2008 and which were made absolute on
\n06.10.2009 will continue to be in force.          During the pendency of
\nthe Writ Petitions in the High Court, the State Government may,
\nhowever, carry out the following works at the different project
\nsites listed in Annexure-I to the Affidavit of the Acting Chief
\nSecretary, Government of U.P.:\n<\/p>\n
 “KANSHIRAM SMARAK STHAL, JAIL ROAD, LUCKNOW
\n Entrance Plaza
\n Stone waste is lying at some places on the outer side of the
\n building; need to be removed.\n<\/p>\n
                                       5<\/span><\/p>\n
     Parking Place<\/p>\n
     Broken stone    heaps   are   lying   at   some   places;   need     to   be
\n     removed.\n<\/p>\n
     Site Development<\/p>\n
     There are some temporary construction and labour hutment which
\n     are required to be removed.\n<\/p>\n
     The saplings of the trees and grass have dried up at some
\n     places. New Saplings and grass are required to be planted.\n<\/p>\n
     The leakages in the water supply line are visible at some
\n     places; need to be rectified immediately.\n<\/p>\n
     The unutilized     construction   materials       are   required    to    be
\n     removed.\n<\/p>\n
     RAMABAI AMBEDKAR MAIDAN (RALLY GROUND)<\/p>\n
     The unutilized building material and scaffoldings from the area
\n     behind stand to be removed.\n<\/p>\n
     DR. BHIMRAO AMBEDKAR STHAL<\/p>\n
     There are leakages in the water supply line at some places
\n     which need to be plugged immediately.\n<\/p>\n
     Some saplings planted in the campus have dried up and hence are
\n     required to be replaced.\n<\/p>\n
     There are some temporary constructions            and   labour     hutments
\n     which are required to be removed.\n<\/p>\n
     The unutilized     construction   materials       are   required    to    be
\n     removed.”\n<\/p>\n
8.     In suo motu Contempt Petition (C) No.326 of 2009, we have
\nperused the reply filed by the Chief Secretary, State of U.P., to
\nthe suo motu notice of contempt and we find that there has been
\nno construction of any kind after 11.09.2009.                 We, therefore,
\n                                      6<\/span><\/p>\n
discharge the suo motu notice of contempt issued to the Chief
\nSecretary, Government of U.P.\n<\/p>\n
9.   With this order, the Special Leave Petition, the Transfer
\nPetitions   and   the   Contempt   Petition   stand   disposed   of.   The
\ninterim order dated 21.04.008 passed by this Court in Special
\nLeave Petition (C) No.9489 of 2008 is vacated.             No costs.    We
\nclarify that this order will not affect the proceedings in any
\nother Special Leave Petition or Civil Appeals pending in this
\nCourt.\n<\/p>\n
