The service stamp records.\n<\/p>\n<p>Reply of the Public Information Officer (PIO):<br \/>\nAll the information were provided in the hospital and would be provided on the hearing date.\n<\/p>\n<p>Grounds for the First Appeal:\n<\/p>\n<p>Unsatisfactory reply by the PIO.\n<\/p>\n<p>Order of the First Appellate Authority (FAA):<br \/>\nIt was requested to clarify and suggest as how to process the appeal application of Mr. Rajiv Kumar for its<br \/>\ndisposal.\n<\/p>\n<p>Grounds for the Second Appeal:\n<\/p>\n<p>Unsatisfactory and incomplete reply of the PIO.<br \/>\n Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Dr. Rajiv Kumar;\n<\/p>\n<p>Respondent: Dr. Amita Manaktala, ASPIO&amp; Dy. Medical Superintendent;\n<\/p>\n<p>        The appellant had sought inspection of a fairly large number of records for a two and half year<br \/>\nperiod, in which he has also stated, &#8220;I may please be advised as to how pen down by application so that<br \/>\nnothing could be refused to me&#8221;. The PIO responded that the application was vague and was not very<br \/>\nspecific the files which the appellant wanted to inspect. On a plain reading of the appellant&#8217;s application it<br \/>\ndoes appear as if it could be a very wide search and could be an endless inspection.\n<\/p>\n<p>The appellant has stated that he believes that the PIO was motivated by malafide and therefore he states<br \/>\nthat he should be given compensation and the penalty should be imposed on the PIO. The Commission<br \/>\ndoes not agree with the contentions of the appellant since it feels that the wordings used in the application<br \/>\nwere slightly vague and could have led to a believe that this could be a never ending inspection. The<br \/>\nappellant has given written submissions to the Commission to substantiate his claim for compensation and<br \/>\nawarding a penalty to the PIO for malafide denial of information which is taken on the record.\n<\/p>\n<p>The Commission has asked the appellant about the number of days he would need to inspect the records.<br \/>\nThe appellant who was working in the hospital earlier states that he will tell the PIO the exact records he<br \/>\nwants to inspect and the inspection will not taken more than two days.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The Commission directs the PIO to facilitate an inspection of the records identified<br \/>\nby the appellant from 25 October 2010 to 28 October 2010 from 10.30AM onwards.
