First respondent is the                  husband of first<\/p>\n<p>petitioner. The second respondent is the                   father-in-<\/p>\n<p>law and third respondent, sister-in-law. Annexure-A1<\/p>\n<p>FIR was registered on the basis of First Information<\/p>\n<p>Statement  furnished       by      first        petitioner    against<\/p>\n<p>respondents 1 to 3 for the offences under Sections<\/p>\n<p>323, 325 and 498-A read with Section 34 of Indian<\/p>\n<p>Penal Code. Defecto complainant               and the injured have<\/p>\n<p>jointly filed  this petition under Section 482 of Code<\/p>\n<p>of Criminal Procedure         to quash Annexure-A1 FIR and<\/p>\n<p>all other proceedings in the matter, contending that<\/p>\n<p>all the disputes    between petitioners with respondents<\/p>\n<p>1  to  3   were   subsequently            settled       evidenced by<\/p>\n<p>Annexure-II       agreement            which         discloses   that<\/p>\n<p>O.P.37\/2009 was filed by first petitioner against<\/p>\n<p>first respondent before the Family court and all the<\/p>\n<p>disputes   between them were amicably settled and<\/p>\n<p>CRMC 1520\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>petitioners have agreed to withdraw the   criminal case<\/p>\n<p>as well as the case pending before Family court.<\/p>\n<p>    2.    Learned counsel appearing for petitioners and<\/p>\n<p>respondents 1 to 3 and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>    3.    Learned counsel appearing for petitioners and<\/p>\n<p>respondents 1 to 3    submitted that offences involved<\/p>\n<p>are in respect of incidents occurred when there was<\/p>\n<p>matrimonial disputes between first petitioner and first<\/p>\n<p>respondent   and subsequently    all the disputes were<\/p>\n<p>resolved and first petitioner is now residing along<\/p>\n<p>with her husband\/first respondent and in the interest<\/p>\n<p>of justice,   criminal proceedings is to be quashed to<\/p>\n<p>preserve the matrimonial peace and cordiality.<\/p>\n<p>    4.    Learned counsel appearing for   respondents 1<\/p>\n<p>to  3  also  submitted   that  all  the  disputes  were<\/p>\n<p>resolved. The Public Prosecutor also submitted the<\/p>\n<p>same.\n<\/p>\n<p>    5.    In the light of the settlement of the disputes<\/p>\n<p>between the parties, no purpose will be served by<\/p>\n<p>proceeding with the investigation and later trial of<\/p>\n<p>the case as held by the Apex court in Madan Mohan Abbot<\/p>\n<p>v. State of Pubjab  (2008 (3) KLT 19) and B.S.Joshi  v.<\/p>\n<p>CRMC 1520\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>State of Haryana  (2003 (2) KLT 1062) it is not in the<\/p>\n<p>interest of justice to continue the proceedings when<\/p>\n<p>the matrimonial disputes were amicably settled and<\/p>\n<p>husband and wife are living together.<\/p>\n<p>    Petition is allowed.
