\nway of present petition, the petitioner has prayed for direction to
\nrespondent authorities to protect the pay of the petitioner, on his
\nappointment as Jailor (Group-II) vide appointment order dated
\n11.06.2004 which the petitioner was getting while working as Senior
\nClerk and also to direct the respondent authorities to grant
\nconsequential benefits to the petitioner.\n<\/p>\n
2.0\tThe
\npetitioner joined the service under the administration of the
\nInspector General of Prisons and in due course the petitioner was
\npromoted on the post of Senior Clerk in the year 1990. Upon
\ncompleting nine years of the service on the post of Senior Clerk, he
\nwas granted benefit of first higher pays scale of Rs. 5000-8000 on
\nthe post of Head Clerk. Lastly he was drawing pay scale of Rs.
\n5600\/-. On 07.04.2004, the applications for the post of Jailor (Group
\nII) were invited for the post of Jailor and after due process of
\nselection, the appointment to the post of Jailor (Group- II) has been
\ngiven to the petitioner in the pay scale of Rs.4500-7000\/-. The pay
\nscale on the petitioner at the time of promotion was  Rs. 5600\/- in
\nthe pay scale of Rs. 5000-8000\/-, but the same was not protected to
\nthe petitioner upon his appointment on the post of Jailor (Group II).
\nThe petitioner made representation to the respondent authorities. The
\npetitioner was informed that the benefit of pay protection cannot be
\ngranted to the petitioner as he was not appointed on a post carrying
\nequal or higher pay scale. Hence, this petition.\n<\/p>\n
3.0\tIn
\nview of Rule 11 of the Gujarat Civil Service Rules (Pay), 2002, the
\npetitioner had made representation which came to be turned down. The
\ndate of the appointment of the petitioner is 11.06.2004 and his
\nrepresentation was rejected on 08.06.2009 i.e after nine years.\n<\/p>\n
4.0\tThe
\nappointment of the petitioner as Jailor was on ad-hoc basis and on
\nprobation of two years vide order dated 11.06.2004. It is the
\ncontention of the petitioner that he was informed that the
\nrepresentation of the petitioner dated 04.12.2007 cannot be accepted
\nin view of the decision of the Government dated 26.05.2009. Being
\naggrieved by the action of the respondent authorities of not granting
\nthe benefit of pay protection to the petitioner on being appointed to
\nthe post of Jaior (Group II) from the post of Senior Clerk in the
\nservice of the State Government, the petitioner has filed the present
\npetition.  Learned advocate for the petitioner submitted that in view
\nof his earlier service, pay scale of Rs. 5000\/- should have been
\nconsidered.\n<\/p>\n
5.0\tLearned
\nadvocate for the petitioner further contended that as per Clause 5 of
\nthe appointment order dated 11.06.2004, it is clearly stated that the
\nGovernment Resolution regarding the appointment of the Government
\npublished from time to time shall be applicable.\n<\/p>\n
6.0\tMr.\n<\/p>\n
Raval, learned Assistant Government Pleader has submitted that Rule
\n23  of the Gujarat Civil Services Rules (Pay), 2002 is applicable
\nwhich reads as under:\n<\/p>\n
\tRule
\n23: Pay on new appointments<\/p>\n
\t(1)<\/span>
\nWhere the Government employee is selected for\tappointment to a
\nservice or cadre or post under the\tGovernment through the Gujarat
\nPublic Service\tCommission, Centralized Recruitment Scheme or
\nany\tother method approved by the Government and if the\tservice
\nrendered prior to and after such selection is\tcontinuous and the
\nappointment is on a higher post as\tcompared to the pay scale of the
\npost on which the\temployee was working prior to his appointment
\nbefore\tselection, his pay shall be fixed as per Rule 13.\n<\/p>\n
\tExplanation:\n<\/p>\n
For this purpose the service shall be\ttreated as continuous one even
\nif there is a physical\tbreak not exceeding twenty four hours.\n<\/p>\n
\tNote
\n1 If the new appointment is in the same station, for\tthe purpose of
\ncomputing ‘physical break’ (of more than\ttwenty four hours), Sunday
\nand\/or a Public Holiday\tdeclared by the State Government shall be
\nexonerated.\n<\/p>\n
\tNote
\n2: IF the new appointment involves movement from \tone station to
\nanother, for the purpose of computing\t‘physical break’ (of more than
\ntwenty four hours) the\tmaximum period to cover actual journey
\ninclusive of\tSunday and\/or a Public Holiday declared by the
\nState\tGovernment shall be executed.\n<\/p>\n
\tNote
\n2 : If the new appointment involves movement from \tone station to
\nanother, for the purpose of computing \t‘Physical break’ (of more than
\ntwenty four hours) the \tmaximum period to cover actual journey
\ninclusive of \tSunday and\/or a Public Holiday declared by the State
\n\tGovernment shall be executed.\n<\/p>\n
\t(2)\tThe
\nprovisions of Sub-rule (1) shall not apply in the\tcase of a
\nGovernment employees in the case of a\tGovernment employee who is so
\nappointed after a\tphysical break exceeding twenty four hours
\nfollowing\tresignation, removal, dismissal or discharge on\treduction
\nof establishment or after invalidation out of\tservice. Such an
\nappointment amounts to a fresh\tappointment.\n<\/p>\n
\tThe
\nG.C.S (Pay) Rules, 2002, Rule 13 reads as under:\n<\/p>\n
\tRule
\n13: Fixation of pay on appointment to another post \tnot involving
\nassumption of duties or responsibilities of \tgreater importance.\n<\/p>\n
\t\tWhere
\na Government employee holding a post in\tsubstantive, temporary or
\nofficiating capacity, is\tappointed in a substantive, temporary or
\nofficiating\tcapacity to another post including an ex-cader post
\nand\tappointment to the new post does not involve\tassumption of duties
\nor responsibilities of greater\timportance than those attached to the
\nold post, his initial \tpay shall be fixed as under:\n<\/p>\n
\t(a)\tif
\nthere is a stage in the time scale of the new post \twhich is equal to
\nhis pay in the pay scale of the old post, \the shall draw pay at that
\nstage;\n<\/p>\n
\t(b)\tif
\nthere is no such stage, he shall draw pay at the\tstage next below his
\npay in the pay scale of the old post \tplus personal pay equal to the
\namount of difference;\n<\/p>\n
\t(c)
\nin either of these two cases, he shall continue to draw \tthat pay
\nuntil such time as he would have received an\tincrement in the time
\nscale of the old post or till he\twould earn an increment in the time
\nscale of the new\tpost, whichever is earlier;\n<\/p>\n
\t(d)\tif
\nthe minimum of the time scale of the new post is\thigher than his pay
\nin the old post, he shall draw that\tminimum as initial  pay.\n<\/p>\n
7.0\tLearned
\nAGP has submitted that the petitioner is not entitled to the other
\nscale inasmuch as appointment order was very clear on this aspect it
\nis stipulated by the decision of the Apex Court reported in case of
\nU.P. State Cement Corporation Ltd. and others
\nversus B.K. Tiwari reported
\nin 1998 (2) SCC 542.\n<\/p>\n
8.0\tFrom
\na perusal of Rule 23, it is obvious that the petitioner cannot take
\nany protection from the same. The petitioner was appointed by order
\ndated 11.06.2004 in the pay scale of Rs. 4500-7000\/-. The petitioner
\nhas been departmentally recruited as a Jailor ( Group- II). The pay
\nscale and conditions are mentioned in the said order which has been
\naccepted by him and having accepted the same, it is not open to the
\npetitioner to challenge the same. Further, the petitioner was serving
\nas a Senior Clerk and that is not the feeder cadre of Jailor (Group-
\nII) post. In that view of the matter, there was no reason to protect
\nthe pay scales when the petitioner was appointed on the said post.\n<\/p>\n
9.0\tIn
\nthe premises aforesaid, I do not find any merits in the petition. The
\nsame is therefore, rejected. Notice is discharged with no order as to
\ncosts.\n<\/p>\n
