Upon<br \/>\ncompleting nine years of the service on the post of Senior Clerk, he<br \/>\nwas granted benefit of first higher pays scale of Rs. 5000-8000 on<br \/>\nthe post of Head Clerk. Lastly he was drawing pay scale of Rs.<br \/>\n5600\/-. On 07.04.2004, the applications for the post of Jailor (Group<br \/>\nII) were invited for the post of Jailor and after due process of<br \/>\nselection, the appointment to the post of Jailor (Group- II) has been<br \/>\ngiven to the petitioner in the pay scale of Rs.4500-7000\/-. The pay<br \/>\nscale on the petitioner at the time of promotion was  Rs. 5600\/- in<br \/>\nthe pay scale of Rs. 5000-8000\/-, but the same was not protected to<br \/>\nthe petitioner upon his appointment on the post of Jailor (Group II).<br \/>\nThe petitioner made representation to the respondent authorities. The<br \/>\npetitioner was informed that the benefit of pay protection cannot be<br \/>\ngranted to the petitioner as he was not appointed on a post carrying<br \/>\nequal or higher pay scale. Hence, this petition.\n<\/p>\n<p>3.0\tIn<br \/>\nview of Rule 11 of the Gujarat Civil Service Rules (Pay), 2002, the<br \/>\npetitioner had made representation which came to be turned down. The<br \/>\ndate of the appointment of the petitioner is 11.06.2004 and his<br \/>\nrepresentation was rejected on 08.06.2009 i.e after nine years.\n<\/p>\n<p>4.0\tThe<br \/>\nappointment of the petitioner as Jailor was on ad-hoc basis and on<br \/>\nprobation of two years vide order dated 11.06.2004. It is the<br \/>\ncontention of the petitioner that he was informed that the<br \/>\nrepresentation of the petitioner dated 04.12.2007 cannot be accepted<br \/>\nin view of the decision of the Government dated 26.05.2009. Being<br \/>\naggrieved by the action of the respondent authorities of not granting<br \/>\nthe benefit of pay protection to the petitioner on being appointed to<br \/>\nthe post of Jaior (Group II) from the post of Senior Clerk in the<br \/>\nservice of the State Government, the petitioner has filed the present<br \/>\npetition.  Learned advocate for the petitioner submitted that in view<br \/>\nof his earlier service, pay scale of Rs. 5000\/- should have been<br \/>\nconsidered.\n<\/p>\n<p>5.0\tLearned<br \/>\nadvocate for the petitioner further contended that as per Clause 5 of<br \/>\nthe appointment order dated 11.06.2004, it is clearly stated that the<br \/>\nGovernment Resolution regarding the appointment of the Government<br \/>\npublished from time to time shall be applicable.\n<\/p>\n<p>6.0\tMr.\n<\/p>\n<p>Raval, learned Assistant Government Pleader has submitted that Rule<br \/>\n23  of the Gujarat Civil Services Rules (Pay), 2002 is applicable<br \/>\nwhich reads as under:\n<\/p>\n<p>\tRule<br \/>\n23: Pay on new appointments<\/p>\n<p><span class=\"hidden_text\">\t(1)<\/span><br \/>\nWhere the Government employee is selected for\tappointment to a<br \/>\nservice or cadre or post under the\tGovernment through the Gujarat<br \/>\nPublic Service\tCommission, Centralized Recruitment Scheme or<br \/>\nany\tother method approved by the Government and if the\tservice<br \/>\nrendered prior to and after such selection is\tcontinuous and the<br \/>\nappointment is on a higher post as\tcompared to the pay scale of the<br \/>\npost on which the\temployee was working prior to his appointment<br \/>\nbefore\tselection, his pay shall be fixed as per Rule 13.\n<\/p>\n<p>\tExplanation:\n<\/p>\n<p>For this purpose the service shall be\ttreated as continuous one even<br \/>\nif there is a physical\tbreak not exceeding twenty four hours.\n<\/p>\n<p>\tNote<br \/>\n1 If the new appointment is in the same station, for\tthe purpose of<br \/>\ncomputing &#8216;physical break&#8217; (of more than\ttwenty four hours), Sunday<br \/>\nand\/or a Public Holiday\tdeclared by the State Government shall be<br \/>\nexonerated.\n<\/p>\n<p>\tNote<br \/>\n2: IF the new appointment involves movement from \tone station to<br \/>\nanother, for the purpose of computing\t&#8216;physical break&#8217; (of more than<br \/>\ntwenty four hours) the\tmaximum period to cover actual journey<br \/>\ninclusive of\tSunday and\/or a Public Holiday declared by the<br \/>\nState\tGovernment shall be executed.\n<\/p>\n<p>\tNote<br \/>\n2 : If the new appointment involves movement from \tone station to<br \/>\nanother, for the purpose of computing \t&#8216;Physical break&#8217; (of more than<br \/>\ntwenty four hours) the \tmaximum period to cover actual journey<br \/>\ninclusive of \tSunday and\/or a Public Holiday declared by the State<br \/>\n\tGovernment shall be executed.\n<\/p>\n<p>\t(2)\tThe<br \/>\nprovisions of Sub-rule (1) shall not apply in the\tcase of a<br \/>\nGovernment employees in the case of a\tGovernment employee who is so<br \/>\nappointed after a\tphysical break exceeding twenty four hours<br \/>\nfollowing\tresignation, removal, dismissal or discharge on\treduction<br \/>\nof establishment or after invalidation out of\tservice. Such an<br \/>\nappointment amounts to a fresh\tappointment.\n<\/p>\n<p>\tThe<br \/>\nG.C.S (Pay) Rules, 2002, Rule 13 reads as under:\n<\/p>\n<p>\tRule<br \/>\n13: Fixation of pay on appointment to another post \tnot involving<br \/>\nassumption of duties or responsibilities of \tgreater importance.\n<\/p>\n<p>\t\tWhere<br \/>\na Government employee holding a post in\tsubstantive, temporary or<br \/>\nofficiating capacity, is\tappointed in a substantive, temporary or<br \/>\nofficiating\tcapacity to another post including an ex-cader post<br \/>\nand\tappointment to the new post does not involve\tassumption of duties<br \/>\nor responsibilities of greater\timportance than those attached to the<br \/>\nold post, his initial \tpay shall be fixed as under:\n<\/p>\n<p>\t(a)\tif<br \/>\nthere is a stage in the time scale of the new post \twhich is equal to<br \/>\nhis pay in the pay scale of the old post, \the shall draw pay at that<br \/>\nstage;\n<\/p>\n<p>\t(b)\tif<br \/>\nthere is no such stage, he shall draw pay at the\tstage next below his<br \/>\npay in the pay scale of the old post \tplus personal pay equal to the<br \/>\namount of difference;\n<\/p>\n<p>\t(c)<br \/>\nin either of these two cases, he shall continue to draw \tthat pay<br \/>\nuntil such time as he would have received an\tincrement in the time<br \/>\nscale of the old post or till he\twould earn an increment in the time<br \/>\nscale of the new\tpost, whichever is earlier;\n<\/p>\n<p>\t(d)\tif<br \/>\nthe minimum of the time scale of the new post is\thigher than his pay<br \/>\nin the old post, he shall draw that\tminimum as initial  pay.\n<\/p>\n<p>7.0\tLearned<br \/>\nAGP has submitted that the petitioner is not entitled to the other<br \/>\nscale inasmuch as appointment order was very clear on this aspect it<br \/>\nis stipulated by the decision of the Apex Court reported in case of<br \/>\nU.P. State Cement Corporation Ltd. and others<br \/>\nversus B.K. Tiwari reported<br \/>\nin 1998 (2) SCC 542.\n<\/p>\n<p>8.0\tFrom<br \/>\na perusal of Rule 23, it is obvious that the petitioner cannot take<br \/>\nany protection from the same. The petitioner was appointed by order<br \/>\ndated 11.06.2004 in the pay scale of Rs. 4500-7000\/-. The petitioner<br \/>\nhas been departmentally recruited as a Jailor ( Group- II). The pay<br \/>\nscale and conditions are mentioned in the said order which has been<br \/>\naccepted by him and having accepted the same, it is not open to the<br \/>\npetitioner to challenge the same. Further, the petitioner was serving<br \/>\nas a Senior Clerk and that is not the feeder cadre of Jailor (Group-<br \/>\nII) post. In that view of the matter, there was no reason to protect<br \/>\nthe pay scales when the petitioner was appointed on the said post.\n<\/p>\n<p>9.0\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petition. The<br \/>\nsame is therefore, rejected.
