       All these writ petitions are filed by<\/p>\n
the Managing Director of the Kerala State Road<\/p>\n
Transport    Corporation          {for       short  ‘the<\/p>\n
Corporation’} challenging similar orders passed<\/p>\n
by the Labour Court.       Suffice if the contentions<\/p>\n
in W.P.(C)No.23598\/08 are referred to.<\/p>\n

       2. The first respondent was an employee<\/p>\n
of the Corporation and he retired from service<\/p>\n
on 31.03.2004.    He filed a claim petition under<\/p>\n
Section 33(2) of the Industrial Disputes Act<\/p>\n
before the Labour Court claiming his dues under<\/p>\n
the General Provident Fund account, along with<\/p>\n
interest.  Ext.P1 claim petition in this regard<\/p>\n
was  opposed   by     the    Corporation       and Ext.P2<\/p>\n
objections   were       filed.       Essentially,    the<\/p>\n
objection taken up was that the claim made by<\/p>\n
the claimant before the Labour Court is on the<\/p>\n
strength of the wage revision, as contemplated<\/p>\n
vide agreement dated 13.4.1999 and that the<\/p>\n
Corporation have approached the Government to<\/p>\n
W.P.(C).NO.23598\/08 & Con. cases.<\/p>\n
                      :: 2 ::\n<\/p>\n
\ngive financial aid.  The Labour Court considered<\/p>\n
the  objections  and  rightly    noted  that  the<\/p>\n
Corporation has not disputed the correctness of<\/p>\n
the claim made by the claimant.      But the only<\/p>\n
plea  is   that   its   financial    position  is<\/p>\n
precarious and it is not possible to undertake<\/p>\n
more  liability   and  the    Corporation   cannot<\/p>\n
derogate from the right of the claimant, which<\/p>\n
he is otherwise entitled to, by way of pay<\/p>\n
revision arrears relatable to the period of<\/p>\n
1997.  Ext.P4 order passed by the Labour Court<\/p>\n
has been challenged by the petitioner.<\/p>\n
       3. I heard learned standing counsel for<\/p>\n
the Corporation and learned counsel for the<\/p>\n
first respondent.\n<\/p>\n
       4. There is no serious dispute regarding<\/p>\n
the entitlement of the claimant to receive the<\/p>\n
amount as prayed for in Ext.P1 application.     It<\/p>\n
has to be noted that the claim relates to<\/p>\n
arrears  of  wages,   which    the  employee  was<\/p>\n
entitled to, on the strength of the pay revision<\/p>\n
agreement of year 1997.     In such circumstances,<\/p>\n
there is no error whatsoever in the view taken<\/p>\n
by the Labour Court.  I do not find any grounds<\/p>\n

\nto interfere with the order passed by the Labour<\/p>\n
Court.\n<\/p>\n
       5.   Learned counsel for the Corporation<\/p>\n
submits   that   the   Corporation   is   facing<\/p>\n
considerable financial difficulties and it is<\/p>\n
this reason which has essentially prompted the<\/p>\n
Corporation to challenge the order of the Labour<\/p>\n
Court.    Learned  counsel   prays for  time  to<\/p>\n
satisfy the order passed by the Labour Court and<\/p>\n
points out that steps are in contemplation to<\/p>\n
satisfy the claim.\n<\/p>\n
       6. In the facts and circumstances, while<\/p>\n
affirming the order passed by the Labour Court,<\/p>\n
it is made clear that the Corporation shall be<\/p>\n
permitted to pay the amount, as per the award of<\/p>\n
the Labour Court, within a period of four months<\/p>\n
from today.\n<\/p>\n
       Writ petitions are disposed of, subject<\/p>\n
to the above directions.\n<\/p>\n<\/p>\n
