He further submitted that the particular<br \/>\n\tpremises from which the petitioner has been removed is not the<br \/>\n\tsubject matter of the suit nor it was subject matter of the appeal<br \/>\n\tand that therefore on the basis of the order passed in the appeal,<br \/>\n\tany action could not have been taken against the petitioner in<br \/>\n\trespect of the property which is not subject matter of the suit. It<br \/>\n\tis only to the aforesaid extent that the petition is restricted and<br \/>\n\tthat too for the reason that according to the petitioner&#8217;s<br \/>\n\tallegation the action is taken on the strength of the order passed<br \/>\n\tby the appellate Court.\n<\/p>\n<p>So<br \/>\n\tas to get this clarification from the respondent authority issue<br \/>\n\tNotice returnable on 29.9.2010. Direct<br \/>\n\tservice is permitted.\n<\/p>\n<p>It<br \/>\n\tis clarified that in view of the stipulation made by the learned<br \/>\n\tadvocate for the petitioner, petition is restricted to the aforesaid<br \/>\n\taspect only and petition, as declared by learned advocate, is not<br \/>\n\tpressed in respect of the Appellate Court&#8217;s order or trial Court&#8217;s<br \/>\n\torder. &#8221;\n<\/p>\n<p>2.\tThereafter<br \/>\non 22nd November 2010, the following order was passed:\n<\/p>\n<p>\t\t&#8220;The<br \/>\nfollowing order was passed by this Court (Coram : K.M.Thaker, J) on<br \/>\n13.9.2010 :\n<\/p>\n<p>&#8220;Mr.\n<\/p>\n<p>\tPrajapati, learned advocate for the petitioner after some argument<br \/>\n\thas submitted that he is restricting this petition and challenge in<br \/>\n\tthe petition only in respect of the action allegedly taken by the<br \/>\n\tauthority in respect of the property which is not subject matter of<br \/>\n\tthe suit and\/or appeal. Even today, Ms. Archana<br \/>\nAcharya has requested for time on the ground of complying with the<br \/>\norders of this court passed earlier.
