The first defendant is a partnership firm.<\/p>\n<p>Defendants 2 onwards are its partners. The last two<\/p>\n<p>among the defendants offered certain properties as<\/p>\n<p>security to support the facility of bank guarantee<\/p>\n<p>provided by the plaintiff for the business purposes of<\/p>\n<p>the 1st defendant.    The guarantee was executed in<\/p>\n<p>favour of the Cement Corporation of India.            That<\/p>\n<p>guarantee was invoked. Resultantly, the plaintiff was<\/p>\n<p>entitled to be paid the amount covered by the counter<\/p>\n<p>guarantee, Ext.A2. On refusal, notice was issued to the<\/p>\n<p>defendants including a claim for interest at 17.5% plus<\/p>\n<p>A.S.No.677 of 1994<\/p>\n<p>                            :: 2 ::\n<\/p>\n<p>1% penal interest. That demand was neither responded<\/p>\n<p>to nor satisfied.   The plaintiff sued. The defendants<\/p>\n<p>remained ex parte. The court below passed a decree<\/p>\n<p>for recovery of money, however, granting post-suit<\/p>\n<p>interest only at 6% per annum.\n<\/p>\n<p>           3. In this appeal by the plaintiff bank, the<\/p>\n<p>fundamental plea raised is that the court below acted<\/p>\n<p>illegally in refusing to grant post-suit interest at the<\/p>\n<p>pleaded rate i.e. 17.5% plus 1% penal interest.<\/p>\n<p>           4. The documents evidencing the transaction<\/p>\n<p>between the parties do not disclose any particular rate<\/p>\n<p>of interest. Notwithstanding that, the pleadings in the<\/p>\n<p>plaint show that the transaction is a commercial one.<\/p>\n<p>That is not refuted by the defendants. We also find that<\/p>\n<p>the court below did not state any reason restricting the<\/p>\n<p>rate of post-suit interest to be at 6%. Being a matter of<\/p>\n<p>A.S.No.677 of 1994<\/p>\n<p>                           :: 3 ::\n<\/p>\n<p>discretion, the court below ought to have reasoned its<\/p>\n<p>decision as to the rate of post-suit interest. The bank<\/p>\n<p>guarantee was obtained for a commercial purpose and<\/p>\n<p>in connection with the commercial transaction of the<\/p>\n<p>first defendant firm.  That having been invoked, the<\/p>\n<p>bank was entitled to treat counter guarantee as<\/p>\n<p>generating sufficient ground to make a claim for<\/p>\n<p>interest at commercial rate. Totality of the facts and<\/p>\n<p>circumstances have to be taken into account while<\/p>\n<p>exercising judicial discretion as regards the rate of<\/p>\n<p>interest to be awarded pending suit under Section 34 of<\/p>\n<p>the Code of Civil Procedure. We are supported in this<\/p>\n<p>view by the decision of the Division Bench of this Court<\/p>\n<p>in <a href=\"\/doc\/1315088\/\">Catholic Syrian Bank Limited v. N.V.Varkey and<\/p>\n<p>others<\/a> {1987(2) ILR Kerala 331}.
