SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nquashing and setting aside the impugned order dated 31\/01\/2011 passed<br \/>\nby respondent no. 2-the competent authority under the Gujarat<br \/>\nProvisions of Disqualification of Members of Local Authorities for<br \/>\nDefection Act in exercise of powers under Section 3(a) &amp; (b) read<br \/>\nwith Rule 8 disqualifying the petitioner as Member of Kukavav-Valiya<br \/>\nPanchayat.\n<\/p>\n<p>2.\tThe<br \/>\nonly submission made by Shri Ravani, learned advocate appearing on<br \/>\nbehalf of the petitioner is that as such the alleged whip issued by<br \/>\nthe President of the Bharatiya Janata Party was not served upon the<br \/>\npetitioner.  However, it is to  be noted that and as so observed in<br \/>\nthe impugned order in paragraph 4 that even at the time of election<br \/>\non 15\/11\/2010 whip were issued and declared by the respective parties<br \/>\nand necessary entries were also made in the proceedings, and,<br \/>\ntherefore, it cannot be said that there was no whip issued by the<br \/>\nPresident of the Bhartiya Janata Party and\/or the petitioner was not<br \/>\nmade aware of any whip issued by the party of which he belonged to.<br \/>\nThe learned advocate appearing on behalf of the petitioner is not in<br \/>\na position to dispute the above.
