Suit No.1334 of 1985.\n<\/p>\n<p>The<br \/>\n\tfacts of the case in brief are that the applicants-original<br \/>\n\tplaintiffs instituted H.R.P. Suit No.1334 of 1985 in the Small<br \/>\n\tCauses Court, Ahmedabad, against the opponents- original defendants<br \/>\n\tto recover the possession of the suit premises and the arrears of<br \/>\n\trent as well as mesne profit, etc.  inter alia on the ground that<br \/>\n\tthe opponents carried out permanent structure and alteration in the<br \/>\n\trented suit premises without obtaining permission or consent of the<br \/>\n\tapplicant-Trust.\n<\/p>\n<p>2.1<br \/>\n  \tThe said suit ultimately came to be decreed partly by the trial<br \/>\nCourt vide judgment and decree dated 05th March 1992 and<br \/>\ndirected the opponents herein to hand over the vacant and peaceful<br \/>\npossession of the suit premises to the applicant-Trust before the<br \/>\nprescribed date and also to pay Rs.432\/- towards rent and also to pay<br \/>\nmesne profit from the date of filing of the suit till realisation of<br \/>\nthe possession of the suit premises and the costs of the suit.\n<\/p>\n<p>2.2\tBeing<br \/>\naggrieved by the said judgment and decree, the opponents-original<br \/>\ndefendants preferred Civil Appeal No.39 of 1992 before the Small<br \/>\nCauses Court at Ahmedabad. The lower Appellate Court after<br \/>\nappreciating the facts and circumstances of the case and the evidence<br \/>\nproduced on record as well as the impugned judgment and decree,<br \/>\nallowed the said appeal by reversing the impugned judgment and<br \/>\ndecree. Hence, present Revision Application.\n<\/p>\n<p>Mr.S.H.\n<\/p>\n<p>\tIyer, learned advocate for the applicant-Trust, has submitted that<br \/>\n\tthe lower Appellate Court has erred in interpreting the provisions<br \/>\n\tof Section 13(1)(b) of the Bombay Rents, Hotel and Lodging House<br \/>\n\tRates (Control) Act, 1947 (hereinafter referred to as &#8216;the Act&#8217;);<br \/>\n\tthat the lower Appellate Court has erred in holding that the<br \/>\n\tapplicants were required to prove the nature of construction as was<br \/>\n\tprevailing on the date on which the suit premises was let to the<br \/>\n\topponents; that the trial Court has rightly concluded that the<br \/>\n\tapplicants have proved that the opponents have erected permanent<br \/>\n\tstructure in the suit premises; that the lower Appellate Court has<br \/>\n\tfailed to appreciate the evidence of Shri Chimanbhai F. Chauhan at<br \/>\n\tExhibit 16 and that the lower Appellate Court has failed to<br \/>\n\tappreciate that the opponents have admitted in their pleadings that<br \/>\n\tthey have carried out certain repairs. In view of aforesaid, it is<br \/>\n\tprayed that present Revision Application may be allowed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned advocate for the<br \/>\n\tapplicants, averments made in the Revision Application and the<br \/>\n\tdocumentary evidence produced on record, including the impugned<br \/>\n\tjudgment and decree passed by the trial Court as well as the lower<br \/>\n\tAppellate Court, it transpires that the lower Appellate Court has<br \/>\n\tafter going through the pros and cons of the matter decided the<br \/>\n\tmatter and came to the impugned conclusion, which is just and<br \/>\n\tproper. It is pertinent to note that the lower Appellate Court has<br \/>\n\trightly observed in the impugned judgment and decree that in view of<br \/>\n\tthe admissions made by Shri Chimanlal Chauhan, who is the Trustee of<br \/>\n\tthe applicant-Trust, in the cross-examination that the Trust does<br \/>\n\tnot have any register to show as to how was the suit premises when<br \/>\n\tit was let out to the opponents. Further, he has also admitted that<br \/>\n\the does not have any personal knowledge about the previous situation<br \/>\n\tof the suit premises.\n<\/p>\n<p>4.1<br \/>\n  \tThe lower Appellate Court has also rightly appreciated the<br \/>\nevidence of Shri Kalidas Chauhan, who has stated that he was the rent<br \/>\ncollector of the suit premises from the years 1967 to 1980. He has<br \/>\nadmitted in his cross-examination that he does not know as to who is<br \/>\nthe tenant of the adjoining premises situated on the right-hand side<br \/>\nas well as left-hand side of the suit premises. Hence, it has been<br \/>\nrightly observed by the lower Appellate Court that the evidence of<br \/>\nboth these witnesses is not helpful to the applicants in proving<br \/>\ntheir case under Section 13(1)(b) of the Act.\n<\/p>\n<p>4.2\tThe<br \/>\nlower Appellate Court has rightly observed that the the notice issued<br \/>\nby the Ahmedabad Municipal Corporation under Section 260(1) of the<br \/>\nBombay Provincial Municipal Corporation Act can be used by the<br \/>\nlandlord as corroborative piece of evidence, but the same cannot be<br \/>\nconsidered as the exclusive evidence to prove the ingredients of<br \/>\nSection 13(1)(b) of the Act. The lower Appellate Court has rightly<br \/>\nobserved in the concluding paragraph that there is no evidence<br \/>\nwhatsoever about the previous situation of the suit premises.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, I am of the opinion that the<br \/>\n\tlower Appellate Court has assigned cogent and convincing reasons for<br \/>\n\tarriving at the impugned conclusion. Over and above the aforesaid<br \/>\n\treasons, I adopt the reasons assigned by the lower Appellate Court<br \/>\n\tand do not find any illegality much less any perversity in the<br \/>\n\tfindings recorded. I am in complete agreement with the findings<br \/>\n\trecorded by the lower Appellate Court. No case is made out to<br \/>\n\tinterfere with the findings recorded by the lower Appellate Court.<br \/>\n\tHence, present Revision Application deserves to be rejected.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, present Revision Application fails and is,<br \/>\n\taccordingly, rejected. Rule is discharged.
