DENESAN, J.\n\n\n\n             = = = = = = = = = = = = = === = =\n\n                 W.P.(C)  No. 1903 OF 2006 B\n\n             = = = = = = = = = = = = ==== = = =\n\n\n\n             Dated this the  20th October, 2006\n\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     The   petitioner   had   registered   his   name   with   the<\/p>\n<p>Employment   Exchange,   Kozhikode   in   1987.     According   to<\/p>\n<p>him,   he   belongs   to   Mannan   community   which   is   included<\/p>\n<p>in the list of Scheduled Castes in the State of Kerala.\n<\/p>\n<p>He   has   crossed   the   age   of   45   years   and     possesses<\/p>\n<p>I.T.C. (Plumber) Trade passed in 1981.   For some time,<\/p>\n<p>he   could   not   take   steps   to   renew   the   registration.\n<\/p>\n<p>When   he   approached   the   authorities   requesting   to   renew<\/p>\n<p>his   registration   and   to   sponsor   his   name   for   suitable<\/p>\n<p>employment,   the   authorities   did   not   take   timely   action<\/p>\n<p>and finally he had to approach this Court for reliefs.\n<\/p>\n<p>This Court as per Ext. P6 judgment passed on 17-8-2004<\/p>\n<p>directed   the   2nd      respondent,   viz.,   the   District<\/p>\n<p>Employment   Officer,   Kozhikode   to   look   into   Ext.   P3<\/p>\n<p>representation   filed   by   the   petitioner   on   17-10-2001<\/p>\n<p>with   notice   to   the   petitioner   and   to   set   right   the<\/p>\n<p><span class=\"hidden_text\">WPC No.  1903\/06                             -2-<\/span><\/p>\n<p>illegality,   if   any,   committed.     Pursuant   to   Ext.   P6,<\/p>\n<p>the     petitioner     submitted   Ext.   P7   representation   on<\/p>\n<p>25-11-2004   before   the   4th  respondent   complaining   that<\/p>\n<p>the   appointments   made   through   the   Employment   Exchange<\/p>\n<p>were         overlooking         the         legitimate         claim         of         the<\/p>\n<p>petitioner.     Having   not   received   any   reply   to   Ext.   P7<\/p>\n<p>representation, he has filed this writ petition.\n<\/p>\n<p>        2.   Learned   Govt.   Pleader,   on   instruction,   submits<\/p>\n<p>that   the   2nd     respondent   has   issued   notice   to   the<\/p>\n<p>petitioner   directing   him   to   appear   before   the   2nd<\/p>\n<p>respondent   on   19-10-2004,   the   petitioner   responded   to<\/p>\n<p>the notice, at the time of hearing he was told that he<\/p>\n<p>should   produce   certificate   from   the   Tahildar   having<\/p>\n<p>jurisdiction   over   the   area   where   the   petitioner   had<\/p>\n<p>been   residing   showing   that   he   belongs   to   Mannan<\/p>\n<p>community;   but   the   petitioner   has   not   so   far   produced<\/p>\n<p>the   requisite   certificate   and   therefore   further   action<\/p>\n<p>has   not   been   taken   on   the   representation   of   the<\/p>\n<p>petitioner.  The case of the respondent is that due  to<\/p>\n<p>the   laches   on   the   part   of   the   petitioner,   further<\/p>\n<p>proceedings   could   not   be   pursued   on   the   grievance   of<\/p>\n<p>the petitioner.   Govt. Pleader submits that it is open<\/p>\n<p><span class=\"hidden_text\">WPC No.  1903\/06                  -2-<\/span><\/p>\n<p>to the petitioner to produce the caste certificate from<\/p>\n<p>the   Tahsildar  within  a  reasonable  time,  in  which  case,<\/p>\n<p>the   2nd  respondent   will   take   appropriate   action   in<\/p>\n<p>accordance with law.\n<\/p>\n<p>      3.   Having   regard   to   the   above   good   gesture   shown<\/p>\n<p>by the 2nd respondent despite the lethargy or failure on<\/p>\n<p>the   part   of   the   petitioner   in   not   producing   the<\/p>\n<p>requisite   certificate,   the   petitioner   shall   take<\/p>\n<p>immediate   action   to   obtain   the   certificate,   if   he   is<\/p>\n<p>eligible and produce the same before the 2nd  respondent<\/p>\n<p>within a period of two months from today.   If any such<\/p>\n<p>certificate is produced, the 2nd respondent will be free<\/p>\n<p>to   close   the   concerned   file   for   want   of   response   from<\/p>\n<p>the petitioner.\n<\/p>\n<p>      The writ petition is disposed of as above.\n<\/p>\n<p>                                                   K.K.
