MUKHOPADHAYA)<\/p>\n<p>\tPrima<br \/>\nfacie, it appears that the learned Single Judge without noticing<br \/>\nrelevant facts of the petitioner&#8217;s case has passed impugned order<br \/>\ndated 16th July, 2009.  Further, from the judgment of<br \/>\nlearned Single Judge as quoted in the impugned order passed in<br \/>\nSpecial Civil Application No.3198 of 2004, it appears that the Court<br \/>\nwrongly interpreted Rule 492(1) of the Bombay Jail Manual and<br \/>\nCircular dated 25th September, 1972 that as per the said<br \/>\nRule and Circular it was not permissible to grant permission for<br \/>\ndevelopment of construction within 220 yards from the jail.\n<\/p>\n<p>\tPrima<br \/>\nfacie from the plain reading of the aforesaid Rule and Circular, it<br \/>\nappears that the discretion has been left with the I.G. Prison to<br \/>\ndecide on each application whether permission should be granted for<br \/>\nconstruction of building within 220 yards from the jail wall.\n<\/p>\n<p>\tIt<br \/>\nhas been brought to the notice of the Court that the case of the<br \/>\npetitioner has been rejected on presumption that Rule 492(1) of the<br \/>\nBombay Jail Manual and Circular dated 25th September, 1972<br \/>\ndo not permit any construction to be made within 220 yards from the<br \/>\njail wall.  It is also brought to the notice of the Court that on the<br \/>\nother hand permission of construction of other building just adjacent<br \/>\nto the boundary wall of the proposed jail namely  Vaibhav Flat<br \/>\nand  Sanjivani Flat  have been granted and such flats have been<br \/>\nconstructed.\n<\/p>\n<p>\tLearned<br \/>\nAGP appearing on behalf of the State prays and is allowed a week&#8217;s<br \/>\ntime to obtain instruction whether two flats in between the<br \/>\npetitioners plot and the proposed jail site namely  Vaibhav Flat<br \/>\nand  Sanjivani Flat  have been granted permission for<br \/>\nconstruction of such building.
