Justice S.S.SATHEESACHANDRAN\n\n Dated :11\/01\/2011\n\n O R D E R\n                S.S.SATHEESACHANDRAN, J.\n                    -------------------------------\n                    R.S.A.NO.624 OF 2009\n                  -----------------------------------\n          Dated this the 11th day of January, 2011\n\n                        J U D G M E N T\n<\/pre>\n<p>     The appeal is directed against dismissal of first appeal by<\/p>\n<p>the lower appellate court, consequent to the abatement of such<\/p>\n<p>appeal on default of the appellant to take steps for impleading<\/p>\n<p>the legal heirs of the 2nd respondent, who had passed away<\/p>\n<p>pending the first appeal. Suit was one for redemption and it was<\/p>\n<p>decreed in favour of the plaintiff, the 1st respondent before the<\/p>\n<p>lower appellate court. On the death of the 1st respondent, the 2nd<\/p>\n<p>respondent was impleaded as his legal heir in such appeal. That<\/p>\n<p>2nd   respondent     had     also     passed       away; but, the<\/p>\n<p>appellants\/defendants in the suit did not take appropriate steps<\/p>\n<p>in time, but moved a petition later to set aside the abatement<\/p>\n<p>condoning the delay. The application moved by the appellants<\/p>\n<p>for setting aside the abatement having been dismissed by the<\/p>\n<p>lower appellate court and appeal dismissed by that court as<\/p>\n<p><span class=\"hidden_text\">R.S.A.NO.624\/2009               2<\/span><\/p>\n<p>abated, as if a second appeal would lie, the present appeal has<\/p>\n<p>been preferred. The remedy available to the appellants in such a<\/p>\n<p>case is to impeach the order passed under Rule 9 of Order XXII<\/p>\n<p>of the Code of Civil Procedure by way of an appeal as provided<\/p>\n<p>under Order XLIII Rule 1 (k) of the CPC.      Realising that the<\/p>\n<p>second appeal is not entertainable, the learned counsel for the<\/p>\n<p>appellants sought for permission to withdraw the appeal, without<\/p>\n<p>prejudice to his right to take recourse to the appropriate<\/p>\n<p>proceedings for challenging the adverse decision rendered<\/p>\n<p>against him by the court below. The learned counsel requested<\/p>\n<p>for a grace period of one month to prefer the appeal against the<\/p>\n<p>order of the court below as provided by law.       On the facts<\/p>\n<p>presented, as I find nothing to hold that there was lack of bona<\/p>\n<p>fide on the part of the appellant though the appeal had been<\/p>\n<p>presented without taking and considering due notice of the<\/p>\n<p>provisions of the law the appellants are accorded permission to<\/p>\n<p>prefer an appeal against the adverse order rendered by the court<\/p>\n<p>below within a period of one month from the date of this<\/p>\n<p>judgment.
