THE OFFICER-IN-CHARGE OF GANDHI MAIDAN POLICE\n                             STATION, PATNA.\n                               -----------\n<\/pre>\n<p>2   18.01.2011                    Heard learned counsel for the petitioner<\/p>\n<p>                 and the State.\n<\/p>\n<p>                                  A supplementary affidavit has been filed.<\/p>\n<p>                                  The grievance of the petitioner is that on<\/p>\n<p>                 account of institution of Gandhi Maidan P.S. Case No. 108<\/p>\n<p>                 of 2009 against the accused persons for the offences under<\/p>\n<p>                 Sections 406, 467, 468, 471 and 120B of the Indian Penal<\/p>\n<p>                 Code. The accused persons of the said case continuously<\/p>\n<p>                 giving the threats with dire consequences to the petitioner<\/p>\n<p>                 including the kidnapping. However, the police, even after<\/p>\n<p>                 receiving such offence which discloses commission of<\/p>\n<p>                 cognizable offence the case is not being registered and the<\/p>\n<p>                 petitioner is getting continuous threats to withdraw the<\/p>\n<p>                 aforesaid police case. However, learned counsel submits<\/p>\n<p>                 that on account of the aforesaid inaction\/refusal by the<\/p>\n<p>                 police to register the case, petitioner has not filed any<\/p>\n<p>                 complaint in the Court of Chief Judicial Magistrate, Patna.<\/p>\n<p>                                  Learned counsel appearing on behalf of the<\/p>\n<p>                 State submits that considering the submissions of the<\/p>\n<p>                 parties it appears that in case the information of the<br \/>\n              petitioner given to the police in a cognizable offence and<\/p>\n<p>             police refuses to register the case it will be open for the<\/p>\n<p>             petitioner    either    to    approach    the    concerned<\/p>\n<p>             Superintendent of Police, Patna or to file a regular<\/p>\n<p>             complaint before the Court of Chief Judicial Magistrate<\/p>\n<p>             and   as such in the present writ application, I am not<\/p>\n<p>             inclined to interfere with the matter.\n<\/p>\n<p>                             The writ application stands disposed of.<\/p>\n<pre>Amrendra\/-                                  (Shailesh Kumar Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Bablu Kumar vs State Of Bihar &amp;Amp; Ors on 18 January, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
