No.31989 of 2010\n                        SATYENDRA RAI, SON OF TARACHAND RAI\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>3.   26.03.2011              Heard learned counsels for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                             The petitioner seeks anticipatory bail in a case<\/p>\n<p>                  instituted for the offence under Sections 147, 148, 323, 341,<\/p>\n<p>                  325, 379 and 307 of the Indian Penal Code.\n<\/p>\n<p>                             Considering that the occurrence took place on<\/p>\n<p>                  account of land dispute and it was a case of free fight for which<\/p>\n<p>                  a counter case was also instituted and simple injury had been<\/p>\n<p>                  sustained by the injured, in the event of surrender of the<\/p>\n<p>                  petitioner, named above, within three weeks from today in<\/p>\n<p>                  connection with Isuapur P.S. Case No. 59 of 2009, G.R. No.<\/p>\n<p>                  3848 of 2009, he shall be released on anticipatory bail on<\/p>\n<p>                  furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                  sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>                  Judicial Magistrate, Saran at Chapra, subject to conditions as<\/p>\n<p>                  laid down under Section 438(2) Cr. P.C., and (i) That one of the<\/p>\n<p>                  bailors will be a close relative of the petitioner, who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioner. The bailors will undertake to furnish information to<\/p>\n<p>                  the court about any change in the address of the petitioner,<\/p>\n<p>                  (ii)That the petitioner shall undertake to be represented on the<\/p>\n<p>                  first date after cognizance and in case he fails to do so, his bail<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        bond will be liable to be cancelled, (iii) That the bailor shall also<\/p>\n<p>        state on affidavit that he will inform the court concerned if the<\/p>\n<p>        petitioner is implicated in any other case of similar nature after<\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>        on the ground of misuse, (iv)That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given<\/p>\n<p>        date and be present on date fixed for charge and if he fails to<\/p>\n<p>        do so on two given dates and delays the trial in any manner, his<\/p>\n<p>        bail will be liable to be cancelled for reasons of misuse, and (v)<\/p>\n<p>        That the petitioner will be well represented on each date and if<\/p>\n<p>        he fails to do so on two consecutive dates, his bail will be liable<\/p>\n<p>        to be cancelled.\n<\/p>\n<\/p>\n<p>                                   ( Anjana Prakash, J.)<br \/>\nS.Ali\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Satyendra Rai vs State Of Bihar on 26 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
