Agarwal, J. <\/p>\n<p> 1. By this petition, under Section 439 and 482 of<br \/>\nthe Code of Criminal Procedure, 1973 (for short<br \/>\n&#8220;Cr.P.C.&#8221;) read with Section 18 of Juvenile Justice Act,<br \/>\n1986 (hereinafter &#8220;the Act&#8221;), petitioner is seeking<br \/>\nquashing of the order dated 9th August, 2000 passed by<br \/>\nthe Juvenile Justice Court, Delhi or in the alternative<br \/>\nbail in the case FIR No. 15\/2000 under Sections<br \/>\n376\/363\/341\/34 IPC P.S. Malviya Nagar.\n<\/p>\n<p> 2. Brief facts are that on 12th January, 2000<br \/>\npetitioner was arrested in the above noted case and was<br \/>\nsent to judicial custody. He moved an application that<br \/>\nhe was less than 16 years of age and was juvenile. In<br \/>\nsupport of his submission he produced a school leaving<br \/>\ncertificate showing his date of birth as 14th August,<br \/>\n1986. Prosecution contested the same. The Juvenile<br \/>\nCourt acting under Section 32 of the Act decided to hold<br \/>\nan enquiry to find out whether the petitioner was<br \/>\njuvenile or not. Prosecution in support of its case<br \/>\nexamined CW-1 Dr. Rajneesh Juneja, Radiologist, HRH<br \/>\nHospital who deposed that he had examined the X-ray.<br \/>\nplates of the petitioner which were taken for the<br \/>\npurpose of determining his bone age and opined that his<br \/>\nage is between 18 to 21 years. The petitioner examined<br \/>\nCW-2 Kallan, Asstt. Teacher, from Prathmik Vidhlaya,<br \/>\nFatehpur, U.P. who produced the school record and<br \/>\nstated that on 31st July, 1991 the petitioner was<br \/>\nadmitted in the school and his date of birth was<br \/>\nrecorded as 14th August, 1986. His name was removed<br \/>\nfrom the school on 9th May, 1996 and he proved the<br \/>\nschool leaving certificate. Petitioner has also<br \/>\nexamined CW-3, his father, who stated that his age was<br \/>\naround 50-60 years; that he has 7 children (5 daughters<br \/>\nand 2 sons), and that petitioner is his youngest child.<br \/>\nHowever, he was not able to tell the date of birth of<br \/>\nany of his children. He only stated that petitioner was<br \/>\nborn before a day of Independence Day. He did not<br \/>\nremember the date of birth or the age of the petitioner<br \/>\nand stated that the school teacher had written the date<br \/>\nof birth of the petitioner on admission form himself and<br \/>\nhe had only put his signatures on the admission form.<br \/>\nOn the basis of the above material, the learned court,<br \/>\nrejected the contention of the petitioner that he was<br \/>\nless than 16 years of age and held:\n<\/p>\n<p>  &#8220;However, in the present case, there is<br \/>\nenough material throwing doubt on the<br \/>\nentries in the school record. The<br \/>\nadmission form is signed by the father of<br \/>\nthe delinquent but he has stated that he<br \/>\ndoes not know the age or the date of<br \/>\nbirth of the delinquent. When asked, he<br \/>\nstated that year was mentioned by the<br \/>\nschool teacher himself while filling up<br \/>\nthe admission form of the delinquent. He<br \/>\nfurther stated that he only singed on the<br \/>\nadmission form and rest of the form was<br \/>\nfilled by the school teacher. He has<br \/>\nclearly stated in the court that he did<br \/>\nnot tell the date of birth in the school<br \/>\nand it was written by the school teacher<br \/>\nhimself. As the school teacher himself<br \/>\nhas written the date of birth as per the<br \/>\nfather of the delinquent, therefore, the<br \/>\nsame can not be believed as it is also<br \/>\nnot the defense of the delinquent that<br \/>\nthe school teacher was related to him.<br \/>\nIt seems that the father of the<br \/>\ndelinquent knew only to sign and is not<br \/>\naware of the date of birth or the age of<br \/>\nany of his children. Therefore, he only<br \/>\nsigned the admission form and rest of the<br \/>\ndetails were filled up by the teacher.<br \/>\nIn these circumstances, the date of birth<br \/>\nas mentioned in the school register<br \/>\ncannot be believed as the same was not<br \/>\nfilled up by the parents himself neither<br \/>\nthe same has been stated to the teacher<br \/>\nby the father. The teacher has stated<br \/>\nthe year himself.&#8221;\n<\/p>\n<p> Revision petition filed by the petitioner<br \/>\nagainst the said order was dismissed by the Addl.<br \/>\nSession Judge. This order has been challenged before<br \/>\nthis court.\n<\/p>\n<p> 3. Learned counsel for the petitioner argued that<br \/>\nwhile determining the age of a child the liberal<br \/>\napproach should be adopted and that the evidence of CW-1<br \/>\nDr. Rajneesh Juneja is only an opinion evidence and it<br \/>\ncould not be preferred over the date of birth recorded<br \/>\nin the School showing his date of birth. He argued that<br \/>\npetitioner&#8217;s father Mr. Matroo is an illiterate person<br \/>\nand merely because he was not able to give the date of<br \/>\nbirth of the petitioner or of his other children could<br \/>\nbe the ground for preferring the opinion\/evidence of<br \/>\ndoctor over the school leaving certificate. In support<br \/>\nof his submission reliance was placed on the Supreme<br \/>\nCourt&#8217;s decision in  Bhoop Singh v. State of U.P., 1989<br \/>\nSCC (Cr.) 486 and Full Bench decision of the Patna High<br \/>\nCourt in in  Krishna Bhagwan v. State of Bihar, 1991<br \/>\nCRI.L.J. 1283. Learned APP for the State argued to the<br \/>\ncontrary.\n<\/p>\n<p> 4. I have considered the rival contentions.<br \/>\nThere can be no dispute about the principles of law laid<br \/>\ndown by the Supreme Court. In this case, entries in the<br \/>\nschool leaving certificate were not rejected merely on<br \/>\nthe ground that parents understate the age of the<br \/>\nchildren at the time of admission to School, but on<br \/>\ndifferent grounds. The Juvenile court on the basis of<br \/>\nthe material on record appreciated the evidence and<br \/>\ndeclined to accept the evidence of the father of the<br \/>\npetitioner. The reasoning adopted by the Court while<br \/>\nrejecting entries in the School Leaving Certificate is<br \/>\nin accordance with the well established principles of<br \/>\nlaw. I find no illegality or impropriety in the<br \/>\nimpugned order so as to warrant interference at this<br \/>\nstage. Facts of the judgments relied upon by learned<br \/>\ncounsel for the petitioner were entirely different which<br \/>\nare not applicable to the facts of case at hand. The<br \/>\ncontention of the petitioner that he was a juvenile is<br \/>\ntherefore rejected.\n<\/p>\n<p> 5. Learned counsel for the petitioner also argued<br \/>\nthat assuming the petitioner is not a juvenile; he is a<br \/>\nyoung boy of impressionable age; after completion of<br \/>\ninvestigations, challan has already been filed; that<br \/>\npetitioner has a good case on merits and there is every<br \/>\nlikelihood of his being acquitted; if he remains in the<br \/>\ncompany of hard-core criminals in Jail, his entire life<br \/>\nmay be spoiled, therefore, he be released on bail. He<br \/>\nis in custody for more than two years. The Learned APP<br \/>\nfor the State does not contest these facts.\n<\/p>\n<p> 6. In the facts and the circumstances of this<br \/>\ncase, petitioner is ordered to be released on bail on<br \/>\nhis furnishing personal bond in the sum of Rs. 10,000\/-<br \/>\nwith one surety in the like amount to the satisfaction<br \/>\nof the trial court.\n<\/p>\n<p> 7.
