Justice M.SASIDHARAN NAMBIAR\n\n Dated :05\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n           ===========================\n            CRL.M.C.No.3053      OF 2009\n           ===========================\n\n      Dated this the 5th day of October,2009\n\n                        ORDER\n<\/pre>\n<p>    Petitioners are the accused in Crime No.222\/2008<\/p>\n<p>of Chandera Police Station registered for the offence<\/p>\n<p>under sections 3(1)X and XI of Scheduled Castes and<\/p>\n<p>Scheduled Tribes (Prevention of Atrocities )Act,1989<\/p>\n<p>on recording the First Information Statement of second<\/p>\n<p>respondent. The allegations in Annexure A1(a) First<\/p>\n<p>Information Statement is that fourth respondent had<\/p>\n<p>purchased a recharge coupon from the shop of the<\/p>\n<p>accused on 4.7.2008,  but the coupon did not have the<\/p>\n<p>number and  there was a dispute which was settled and<\/p>\n<p>the money paid was returned on 5.7.2008 and thereafter<\/p>\n<p>7.7.2008 at about 7.30  p.m fourth respondent went to<\/p>\n<p>the shop    to purchase recharge coupon and he was<\/p>\n<p>scolded uttering the caste name and on hearing about<\/p>\n<p>it, third respondent also went there along with the<\/p>\n<p>second respondent and they were also scolded uttering<\/p>\n<p>their caste name and petitioners thereby committed the<\/p>\n<p>offence under   Annexure A1 F.I.R.   This petition is<\/p>\n<p>filed under section 482 of Code of Criminal Procedure<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.3053\/2009              2<\/span><\/p>\n<p>to quash Annexure A1 F.I.R and the proceedings contending<\/p>\n<p>that    entire disputes with respondents 2 to 4 were settled<\/p>\n<p>amicably.        Annexure  A2   agreement  entered  into   by<\/p>\n<p>respondents 2 to 4 with the petitioners         settling the<\/p>\n<p>disputes and agreeing to file affidavit before this court<\/p>\n<p>was produced to establish the settlement.<\/p>\n<p>      2.    Respondents 2 to 4 appeared through a counsel and<\/p>\n<p>each of them filed separate affidavits stating that    entire<\/p>\n<p>disputes were amicably settled and they have no subsisting<\/p>\n<p>grievance against the petitioners and in such circumstance<\/p>\n<p>they have no objection for quashing the proceedings.<\/p>\n<p>      3.     Learned counsel appearing for the petitioners,<\/p>\n<p>respondents 2 to 4 and the learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>      4.     Annexure AII agreement along with the separate<\/p>\n<p>affidavits filed by respondents 2 to 4 establish that the<\/p>\n<p>entire    disputes   were  settled  amicably.    Annexure  A1<\/p>\n<p>establish     that    offence  is   purely  personal  against<\/p>\n<p>respondents 2 to 4.     In such circumstance, as held by the<\/p>\n<p>Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008(3)<\/p>\n<p>KLT 19, it is not in the interest of justice to continue<\/p>\n<p>the prosecution.\n<\/p>\n<p>      Petition is allowed.
