We have heard<br \/>\nlearned counsel for the both the sides for final disposal of the<br \/>\npetition.\n<\/p>\n<p>3.\tIt<br \/>\nis not in dispute that by judgment dated 13.10.2010 annexed at<br \/>\nAnnexure-H, CESTAT allowed the appeal of the petitioners. In the said<br \/>\norder, the Tribunal made following observations :-\n<\/p>\n<p>&#8221; As such having held that the appellant was compelled by the<br \/>\nRevenue not to cross utilize such credit, as a result of which they<br \/>\nhave to pay the duty out of PLA, it has to be held that the refund of<br \/>\nsuch credit is required to be made in cash, on success of their<br \/>\nclaim, as the appellant is not in a position now to such cross<br \/>\nutilization because of the provisions of Cenvat Credit Rules, 2002.\n<\/p>\n<p>7.\tHaving answered the above legal issues in favour of the assessee,<br \/>\nwe find that there is some factual disputes as regards the<br \/>\nutilisation of AED (T&amp;TA) credit towards payment of basic excise<br \/>\nduty as also in respect of AED(GSI) and also in respect of the period<br \/>\ninvolved. Commissioner (Appeals) has observed that the period to<br \/>\nwhich accumulated credit is sought to be refunded is from 1997-2000<br \/>\nwhereas the notice placing the assessee under embargo was issued<br \/>\nsubsequently, the appellant in their memo of appeal has shown the<br \/>\ndisputed period as April 2000 to June 2001. For verification of the<br \/>\nfactual decisions, we set aside the impugned order and remand the<br \/>\nmatter to the original adjudicating authority for doing the needful,<br \/>\nin the light of the law declared on the disputed legal issues. The<br \/>\nappeal is disposed off in above manner.&#8221;\n<\/p>\n<p>4.\tIt<br \/>\nis  not in dispute that this is the second round of litigation and<br \/>\npreviously the petitioners had succeeded right upto the level of the<br \/>\nTribunal. It is the case of the petitioners that despite such orders<br \/>\nin their favour, the respondents are not processing the refund claim<br \/>\nof the petitioners without any justifiable grounds.\n<\/p>\n<p>5.\tCounsel<br \/>\nfor the respondents had previously pointed out that against the<br \/>\njudgment of the Tribunal dated 13.10.2010, the department had<br \/>\npreferred an appeal.\n<\/p>\n<p>6.\tWe<br \/>\nhad accordingly taken up the appeal for admission hearing today. By a<br \/>\nseparate order passed today, we have admitted the appeal. However, we<br \/>\nfind that in cognate matters, reliance on which was placed by the<br \/>\nrespondents and which are pending before this Court, no stay has been<br \/>\ngranted. In OJCA No.149 of 2011 in Tax Appeal No. 607 of 2011<br \/>\ndepartment has moved an application for stay and the same has not<br \/>\nbeen granted.\n<\/p>\n<p>7.\tUnder<br \/>\nthe circumstances, subject to outcome of the Tax Appeal No. 607 of<br \/>\n2011, respondents would have to proceed further and process the<br \/>\nrefund claim of the petitioners in terms of the order passed by the<br \/>\nTribunal dated 13.10.2010.
