CR No. 53 of 2009  registered with Talod police<br \/>\nstation, for the offence punishable under Sections  406, 420, 465,<br \/>\n467, 468 and 471 of Indian Penal Code.\n<\/p>\n<p>\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. I have considered the rival submissions and perused the<br \/>\naverments made in the application, role attributed to the applicant<br \/>\nwhich is reflected in the FIR at Annexure:A to the application as<br \/>\nwell as the order  passed by the coordinate Bench of this Court dated<br \/>\n28.1.2011 in Criminal Revision  Application No. 27 of 2011.<br \/>\nConsidering the aforesaid aspect as well as the role attributed to<br \/>\nthe applicant, provisions of Sections 406, 420, 465, 467, 468 and 471<br \/>\nof IPC, quantum of punishment, gravity of offence etc.,  I am of the<br \/>\nview that the applicant deserves to be enlarged on bail without<br \/>\ndiscussing the evidence in detail in the peculiar facts and<br \/>\ncircumstances of the case.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith I.CR No. 53 of 2009 registered at  Talod Police Station on<br \/>\nexecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of first week<br \/>\nof every English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt the<br \/>\ntrial, the Trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t(H.B.ANTANI,<br \/>\nJ.)<\/p>\n<p>pirzada\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Vinodbhai vs State on 1 July, 2011 Author: H.B.Antani, Gujarat High Court Case Information System Print CR.MA\/4757\/2011 3\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD CRIMINAL MISC.APPLICATION No. 4757 of 2011 ========================================================= VINODBHAI ISHWARBHAI PATEL &#8211;
