Balachandran, J.\n             -------------------------\n             W.P(C)No.32415 of 2008 H\n             -------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Plaintiff is the petitioner.     The prayer in<\/p>\n<p>this writ petition is to declare that Exhibit P4<\/p>\n<p>order passed by the court below on I.A.No.3034\/08<\/p>\n<p>in O.S.No.575\/08 is illegal and to set aside the<\/p>\n<p>same and to direct the court below to dispose of<\/p>\n<p>the suit O.S.No.575\/08 on merits.\n<\/p>\n<p>    2.  The suit was instituted by the petitioner<\/p>\n<p>against the respondents for a decree of permanent<\/p>\n<p>prohibitory  injunction   restraining   them   from<\/p>\n<p>terminating the franchisee agreement otherwise than<\/p>\n<p>by due process of law and in strict compliance with<\/p>\n<p>the terms of the agreement and from restricting,<\/p>\n<p>controlling,  revising,  stopping  or  in  any  way<\/p>\n<p>denying any of the services, facilities or products<\/p>\n<p>of  the  respondent  company  to   the  petitioner\/<\/p>\n<p>plaintiff,  including  the   products  yet  to   be<\/p>\n<p>released by Idea Cellular Services.\n<\/p>\n<p><span class=\"hidden_text\">WPC 32415\/08                2<\/span><\/p>\n<p>     3.    Respondents, on entering appearance in the<\/p>\n<p>court below, filed I.A.No.3034\/08 praying for the<\/p>\n<p>dispute involved in the suit being referred to<\/p>\n<p>arbitration as per clause 15(1) of the Franchise<\/p>\n<p>Agreement.    Exhibit P3 counter was filed thereto by<\/p>\n<p>the petitioner and the court below, vide Exhibit P3<\/p>\n<p>order, referred the parties to arbitration.<\/p>\n<p>     4.    It is vehemently contended before me by the<\/p>\n<p>learned counsel for the petitioner\/plaintiff that<\/p>\n<p>the franchisee agreement had expired, though they<\/p>\n<p>are continuing as before in continuation of the<\/p>\n<p>franchisee     agreement  and   that  therefore,  the<\/p>\n<p>arbitration clause in the franchisee agreement is<\/p>\n<p>not applicable.     The contention is not tenable as<\/p>\n<p>the suit itself was filed basing on the rights of<\/p>\n<p>the petitioner on the franchisee agreement, copy of<\/p>\n<p>which was produced as Item No.1 in the list of<\/p>\n<p>documents annexed to the plaint.    Though this Court<\/p>\n<p>directed the petitioner to produce the franchise<\/p>\n<p>agreement, the said agreement is not produced and<\/p>\n<p><span class=\"hidden_text\">WPC 32415\/08               3<\/span><\/p>\n<p>today,     a  photostat copy   of  the  agreement  is<\/p>\n<p>submitted before me for perusal.\n<\/p>\n<p>     5.     Clause 15(1) of the said agreement deals<\/p>\n<p>with settlement of dispute.    It is that clause that<\/p>\n<p>is   extracted    in  Exhibit  P2  petition  by   the<\/p>\n<p>respondents.     If the said provision for settlement<\/p>\n<p>of dispute in the franchise agreement is acted<\/p>\n<p>upon,    reference  of  the  dispute  to  arbitration<\/p>\n<p>cannot be found fault with.     All the same, counsel<\/p>\n<p>for the petitioner has advanced an argument that<\/p>\n<p>under     Section   8(2)  of   the  Arbitration   and<\/p>\n<p>Conciliation Act, an application referred to in<\/p>\n<p>Section 8(1) of the Act (Exhibit P2 in the instant<\/p>\n<p>case)    shall   not  be  entertained unless   it  is<\/p>\n<p>accompanied     by  original  agreement  or  a   duly<\/p>\n<p>certified copy thereof.    The said provision applies<\/p>\n<p>only in cases where the agreement is not already<\/p>\n<p>produced before the court. In the instant case, the<\/p>\n<p>franchise agreement, which contains the arbitration<\/p>\n<p>clause    is   produced by  the  petitioner\/plaintiff<\/p>\n<p><span class=\"hidden_text\">WPC 32415\/08              4<\/span><\/p>\n<p>himself along with the suit and therefore, the<\/p>\n<p>petitioner\/plaintiff     cannot      dispute     the<\/p>\n<p>authenticity of the said agreement. In such event,<\/p>\n<p>there is no necessity to comply with Section 8(2)<\/p>\n<p>of the Act by the respondents, who filed Exhibit P2<\/p>\n<p>petition.    Reference to arbitration by the court<\/p>\n<p>below, vide Exhibit P5 order, in the circumstances,<\/p>\n<p>is in order and cannot be faulted.
