DAVE\n\t\t\n\t\n\n \n\nDate\n: 26\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I- 18 of 2011 with Mahila Police Station, Ahmedabad, for the<br \/>\noffences punishable under Sections 498-A, 323, 504, 406, 294(B) and<br \/>\n114 of the Indian Penal Code and under Sections 3 and 4 of the Dowry<br \/>\nProhibition Act.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel for the applicants submit that this a case where the husband<br \/>\nis subjected to cruelty due to conduct of the victim and version of<br \/>\nthe complainant is nothing but concoction of incidents.  On the<br \/>\ncontrary the applicant herein had to undergo mental agony because of<br \/>\nconduct on the part of the victim of defying all kinds of matrimonial<br \/>\nnorms. It is further submitted that all other co-accused have been<br \/>\nenlarged on bail except the applicants herein and by imposing<br \/>\nsuitable conditions, the applicants may be granted anticipatory bail.\n<\/p>\n<p>4.\tHeard<br \/>\nLearned APP for the respondent &#8211; State.\n<\/p>\n<p><span class=\"hidden_text\">4<\/span><\/p>\n<p>(a).\tLearned advocate for the complainant opposes grant of bail to<br \/>\nthe applicants.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, I am<br \/>\ninclined to grant anticipatory bail to the applicants.  This Court<br \/>\nhas also taken into consideration the law laid down by the Apex Court<br \/>\nin the case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors. Reported<\/a> in [2011]1 SCC 694, wherein<br \/>\nthe Apex Court reiterated the law laid down by the Constitutional<br \/>\nBench in the case of Shri Gurubaksh Singh Sibbia &amp; Ors.<br \/>\nReported in [1980]2 SCC 565.\n<\/p>\n<p>6.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>7.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicants herein being arrested pursuant to FIR being<br \/>\nCR No.I- 18 of 2011 with Mahila Police Station, Ahmedabad,  the<br \/>\napplicants shall be released on bail on furnishing a bond of<br \/>\nRs.10,000\/- (Rupees Ten Thousand only) each with one surety of like<br \/>\namount on following conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make themselves available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[b]\tshall remain<br \/>\npresent at concerned Police Station on  30th<br \/>\nApril, 2011 between 11:00 am to 2:00 pm:\n<\/p>\n<p>[c]\tshall not<br \/>\nhamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall at the<br \/>\ntime of execution of bond, furnish the address to the Investigating<br \/>\nOfficer and the Court concerned and shall not change the residence<br \/>\ntill the final disposal of the case or till further orders;\n<\/p>\n<p>[e] \twill not<br \/>\nleave India without the permission of the Court and, if is holding a<br \/>\nPassport, shall surrender the same before the trial Court immediately<\/p>\n<p>[f]\tIt would be<br \/>\nopen to the Investigating Officer to file an application for remand,<br \/>\nif he considers it just and proper and the concerned Magistrate would<br \/>\ndecide it on merits.\n<\/p>\n<p>[g]\tdespite this<br \/>\norder, it would be open for the Investigating Agency to apply to the<br \/>\ncompetent Magistrate, for police remand of the applicant. The<br \/>\napplicants shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicants,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>8.\tRule<br \/>\nmade absolute.
