\u00a0He\u00a0added\u00a0that\u00a0the\u00a0RTI\u00a0Application\u00a0too\u00a0is\u00a0being\u00a0forwarded\u00a0to\u00a0<\/p>\n<p>      SHOs\u00a0 for \u00a0 action\u00a0 taken\u00a0 report.\u00a0 \u00a0 The\u00a0 Station\u00a0House\u00a0 Officer,\u00a0 PS\u00a0 Nihal\u00a0Vihar\u00a0in\u00a0 his\u00a0letter\u00a0dt.7.1.11\u00a0<\/p>\n<p>      addressed\u00a0to\u00a0SDM(Punjabi\u00a0Bagh)\u00a0stated\u00a0the\u00a0following:<\/p>\n<p>      &#8216;&#8230;.Complainant\u00a0Shri\u00a0Ajay\u00a0Kumar&#8230;..\u00a0has\u00a0given\u00a0a\u00a0no.\u00a0of\u00a0complaint\u00a0and\u00a0enquiry\u00a0was\u00a0conducted\u00a0into \u00a0<\/p>\n<p>      matter\u00a0by\u00a0various\u00a0I.O\u00a0and\u00a0all\u00a0were\u00a0filed\u00a0as\u00a0no\u00a0cognizable\u00a0offence\u00a0is\u00a0found\u00a0to\u00a0be\u00a0made\u00a0out.\u00a0\u00a0The\u00a0shop \u00a0<\/p>\n<p>      of\u00a0complainant\u00a0is\u00a0situated\u00a0near\u00a0his\u00a0residence.\u00a0\u00a0There\u00a0is\u00a0no\u00a0notice\u00a0or\u00a0seal\u00a0on\u00a0this\u00a0shop\u00a0and\u00a0the\u00a0same\u00a0is \u00a0<\/p>\n<p>      locked.\u00a0\u00a0It\u00a0was\u00a0locked\u00a0by\u00a0the\u00a0complainant\u00a0and\u00a0he\u00a0is\u00a0not\u00a0opening\u00a0the\u00a0same.\u00a0\u00a0There\u00a0is\u00a0no\u00a0hinderance\u00a0to \u00a0<\/p>\n<p>      open\u00a0and\u00a0running\u00a0the\u00a0shop.\u00a0\u00a0He\u00a0is\u00a0having\u00a0old\u00a0altercation\u00a0with\u00a0Sheesh\u00a0Pal\u00a0and\u00a0others\u00a0named\u00a0in\u00a0the \u00a0<\/p>\n<p>      complaint,\u00a0a\u00a0case\u00a0FIR\u00a0No.87\/10\u00a0U\/s\u00a0324\/34\u00a0IPC\u00a0PS\u00a0Nihal\u00a0Vihar\u00a0Delhi\u00a0has\u00a0been\u00a0registered\u00a0against \u00a0<\/p>\n<p>      Sheesh\u00a0Pal\u00a0and\u00a0others\u00a0and\u00a0the\u00a0same\u00a0is\u00a0being\u00a0sent\u00a0to\u00a0court\u00a0for\u00a0trial.\u00a0\u00a0The\u00a0complainant\u00a0is\u00a0habitual\u00a0of \u00a0<\/p>\n<p>      making\u00a0complaints.\u00a0\u00a0However,\u00a0no\u00a0cognizable\u00a0offence\u00a0is\u00a0made\u00a0out\u00a0from\u00a0the\u00a0content\u00a0of\u00a0the\u00a0complaints. \u00a0<\/p>\n<p>      Preventive\u00a0action\u00a0will\u00a0be\u00a0taken\u00a0against\u00a0the\u00a0parties\u00a0if\u00a0apprehension\u00a0of\u00a0breach\u00a0of\u00a0piece\u00a0arises\u00a0in\u00a0future&#8217;.<\/p>\n<p>      The\u00a0Applicant\u00a0filed\u00a0an\u00a0appeal\u00a0dt.19.4.11\u00a0with\u00a0the\u00a0Appellate\u00a0Authority\u00a0stating\u00a0that\u00a0the\u00a0enquiry\u00a0has\u00a0not\u00a0<\/p>\n<p>      been \u00a0 conducted \u00a0 properly. \u00a0 \u00a0 Shri \u00a0 G.S.Meena,\u00a0 Appellate\u00a0 Authority \u00a0 after \u00a0 scheduling\u00a0 the\u00a0 hearing \u00a0 on\u00a0<\/p>\n<p>      7.5.11\u00a0where\u00a0the\u00a0Applicant\u00a0was\u00a0also\u00a0present\u00a0disposed\u00a0off\u00a0the\u00a0appeal\u00a0vide\u00a0his\u00a0order\u00a0dt.12.5.11\u00a0stating\u00a0<\/p>\n<p>      the\u00a0following:\n<\/p>\n<p>      i)         On\u00a0being\u00a0asked,\u00a0the\u00a0Applicant\u00a0started\u00a0weeping\u00a0saying\u00a0that\u00a0he\u00a0is\u00a0the\u00a0owner\u00a0of\u00a0the\u00a0property \u00a0<\/p>\n<p>      No.G\u00ad45\/10\u00a0Laxmi\u00a0Park\u00a0Nangloi\u00a0Delhi\u00a0and\u00a0one\u00a0Sheeshpal\u00a0is\u00a0harassing\u00a0and\u00a0torturing\u00a0him\u00a0in\u00a0order\u00a0to \u00a0<\/p>\n<p>      evict \u00a0 him \u00a0 from \u00a0 the \u00a0 said \u00a0 property. \u00a0 \u00a0 He \u00a0 further \u00a0 stated \u00a0 that \u00a0 due \u00a0 to \u00a0 the \u00a0 threats \u00a0 extended \u00a0 by \u00a0 said \u00a0<\/p>\n<p>      Sheeshpal\u00a0and\u00a0inaction\u00a0on\u00a0the\u00a0part\u00a0of\u00a0the\u00a0local\u00a0police\u00a0he\u00a0has\u00a0to\u00a0close\u00a0his\u00a0shop.\n<\/p>\n<p>        ii)      In \u00a0 view \u00a0 of \u00a0 the \u00a0 above, \u00a0 since \u00a0 the \u00a0 information\u00a0 is \u00a0 available \u00a0 with\u00a0 the\u00a0 SHO\u00a0 Nihal\u00a0 Vihar\u00a0 the \u00a0<\/p>\n<p>       PIO\/SDM(Punjabi\u00a0Bagh)\u00a0is\u00a0directed\u00a0to\u00a0transfer\u00a0the\u00a0application\u00a0of\u00a0the\u00a0Applicant\u00a0to\u00a0the\u00a0PIO\u00a0of\u00a0Delhi \u00a0<\/p>\n<p>       Police\u00a0West\u00a0District\u00a0who\u00a0will\u00a0provide\u00a0information\u00a0to\u00a0the\u00a0Applicant\u00a0within\u00a0the\u00a0prescribed\u00a0time.<\/p>\n<p>       The\u00a0Appellate\u00a0Authority\u00a0also\u00a0advised\u00a0the\u00a0Applicant\u00a0to\u00a0apprise\u00a0the\u00a0senior\u00a0officers\u00a0of\u00a0police\u00a0department\u00a0<\/p>\n<p>       about\u00a0his\u00a0grievances.\u00a0 \u00a0Being\u00a0aggrieved\u00a0with\u00a0the\u00a0reply,\u00a0the\u00a0Applicant\u00a0filed\u00a0a\u00a0second\u00a0appeal\u00a0dt.Nil\u00a0<\/p>\n<p>       before\u00a0CIC.\n<\/p>\n<p>\nDecision<\/p>\n<p>2.     During\u00a0the\u00a0hearing,\u00a0the\u00a0Respondents\u00a0briefed\u00a0the\u00a0Commission\u00a0about\u00a0the\u00a0case.\u00a0They\u00a0stated\u00a0that\u00a0the\u00a0<\/p>\n<p>       Appellant\u00a0 owns\u00a0 a\u00a0 shop\u00a0 near\u00a0 his\u00a0residence\u00a0and\u00a0that\u00a0one\u00a0Mr.\u00a0Sheeshpal\u00a0has\u00a0been\u00a0harassing\u00a0the\u00a0<\/p>\n<p>       Appellant\u00a0and\u00a0members\u00a0of\u00a0his\u00a0family\u00a0\u00a0because\u00a0of\u00a0which\u00a0the\u00a0Appellant\u00a0is\u00a0unable\u00a0to\u00a0\u00a0run\u00a0his\u00a0shop\u00a0or\u00a0<\/p>\n<p>       live\u00a0in\u00a0that\u00a0area.\u00a0 \u00a0According\u00a0to\u00a0the\u00a0Respondents,\u00a0the\u00a0concerned\u00a0SHO\u00a0cum\u00a0PIO\/DCP(West),\u00a0Delhi\u00a0<\/p>\n<p>       Police\u00a0Rajouri\u00a0Garden,\u00a0New\u00a0Delhi\u00a0had\u00a0enquired\u00a0into\u00a0the\u00a0case\u00a0and\u00a0had\u00a0found\u00a0that\u00a0the\u00a0shop\u00a0was\u00a0locked\u00a0<\/p>\n<p>       and\u00a0that\u00a0no\u00a0cognizable\u00a0offence\u00a0could\u00a0be\u00a0made\u00a0out\u00a0from\u00a0the\u00a0content\u00a0of\u00a0the\u00a0complaints.\u00a0\u00a0<\/p>\n<p>3.     The\u00a0Appellant&#8217;s\u00a0younger\u00a0brother\u00a0who\u00a0also\u00a0was\u00a0present\u00a0at\u00a0the\u00a0hearing\u00a0complained\u00a0that\u00a0\u00a0the\u00a0enquiry\u00a0<\/p>\n<p>       was\u00a0not\u00a0done\u00a0in\u00a0a\u00a0fair\u00a0manner\u00a0since\u00a0neither\u00a0he\u00a0nor\u00a0the\u00a0Appellant\u00a0\u00a0was\u00a0called\u00a0by\u00a0the\u00a0SHO\u00a0to\u00a0hear\u00a0their\u00a0<\/p>\n<p>       point\u00a0of\u00a0view\u00a0before\u00a0coming\u00a0to\u00a0a\u00a0conclusion.\u00a0(The\u00a0Appellant\u00a0could\u00a0not\u00a0be\u00a0heard\u00a0since\u00a0he\u00a0became\u00a0<\/p>\n<p>       emotional\u00a0and\u00a0started\u00a0weeping\u00a0..\u00a0\n<\/p>\n<\/p>\n<p>4.     The\u00a0Commission\u00a0after\u00a0 hearing\u00a0the\u00a0submissions\u00a0by\u00a0both\u00a0parties\u00a0noted\u00a0that\u00a0the\u00a0Appellant\u00a0has\u00a0not\u00a0<\/p>\n<p>       sought\u00a0any\u00a0information\u00a0in\u00a0his\u00a0second\u00a0appeal\u00a0and\u00a0that\u00a0he\u00a0\u00a0has\u00a0only\u00a0expressed\u00a0his\u00a0grievance\u00a0against\u00a0<\/p>\n<p>       the\u00a0Police\u00a0for\u00a0not\u00a0having\u00a0conducted\u00a0the\u00a0enquiry\u00a0in\u00a0a\u00a0fair\u00a0manner.\u00a0\u00a0Hence\u00a0no\u00a0information\u00a0needs\u00a0to\u00a0be\u00a0<\/p>\n<p>       disclosed.\n<\/p>\n<\/p>\n<p>5.     The\u00a0Commission,\u00a0however,\u00a0\u00a0recommends\u00a0that\u00a0the\u00a0Joint\u00a0Commissioner\u00a0of\u00a0Police\u00a0direct\u00a0the\u00a0concerned\u00a0<\/p>\n<p>       SHO\u00a0call\u00a0both\u00a0sides\u00a0(Appellant\u00a0and\u00a0Mr\u00a0Sheeshpal\u00a0)\u00a0to\u00a0the\u00a0police\u00a0station\u00a0and\u00a0hear\u00a0both\u00a0of\u00a0them\u00a0,\u00a0<\/p>\n<p>       preferably\u00a0within\u00a015\u00a0days\u00a0of\u00a0receipt\u00a0of\u00a0this\u00a0order,\u00a0\u00a0and\u00a0\u00a0thereafter\u00a0to\u00a0take\u00a0appropriate\u00a0action.\u00a0\u00a0<\/p>\n<p>6.
