JANUARY 10, 2006\n\n\n                                    ORDER\n<\/pre>\n<p>      Petitioner   who   is   the   2nd  accused   in   Crime   No.393\/2006<\/p>\n<p>of   Ranny   Police   Station   for   an   offence   punishable   under<\/p>\n<p>sec.376 read with sec.34 I.P.C., seeks anticipatory bail.\n<\/p>\n<p>      2.        The   learned   Public   Prosecutor   opposed   the<\/p>\n<p>application   submitting   inter   alia   that   the   de   facto<\/p>\n<p>complainant   who   is   the   victim   is   a   mentally   retarded   lady<\/p>\n<p>aged 26 years and that the petitioner also had ravished the<\/p>\n<p>girl.\n<\/p>\n<p>      3.     Having   regard   to   the   facts   of   the   case,   I   am   not<\/p>\n<p>inclined   to   grant   anticipatory   bail   to   the   petitioner.\n<\/p>\n<p>But,   at   the   same   time,   I   am   inclined   to   allow   the<\/p>\n<p>petitioner   to   surrender   before   the   Investigating   Officer<\/p>\n<p>and   then   have   his   bail   application   disposed   of   by   the<\/p>\n<p>magistrate   concerned.            Accordingly,   the   petitioner   is<\/p>\n<p>directed   to   surrender   before   the   Investigating   Officer   on<\/p>\n<p>any   day   between   11.1.2007   and   16.1.2007   for   the   purpose   of<\/p>\n<p>custodial   interrogation   and   subjecting   the   petitioner   to<\/p>\n<p>potency   test   etc.     Thereafter   the   petitioner   shall   be<\/p>\n<p>produced   before   the   magistrate   who   is   having   jurisdiction,<\/p>\n<p>on the same day.   The magistrate shall consider and dispose<\/p>\n<p>B.A.97\/2007                    Page numbers<\/p>\n<p>of   the   application,   if   any,   filed   by   the   petitioner   for<\/p>\n<p>regular   bail   preferably   on   the   same   day   on   which   it   is<\/p>\n<p>filed.
