No body has<\/p>\n<p>                  appeared on behalf of O.P. nos. 2 and 3. State is represented by<\/p>\n<p>                  learned A.P.P.\n<\/p>\n<p>                             Learned counsel for the petitioner      challenges the<\/p>\n<p>                  order impugned dated 5th February, 2007 passed in Maintenance<\/p>\n<p>                  Case no. 16\/2003 (Savitri Devi &amp; Anr. Versus Ashwini Kumar<\/p>\n<p>                  Sinha) whereby learned Principal Judge, Family Court on a<\/p>\n<p>                  consideration of the materials on record including oral and<\/p>\n<p>                  documentary evidence came to the conclusion that the applicants<\/p>\n<p>                  (wife and son of the petitioner-husband) deserve payment of<\/p>\n<p>                  maintenance in the sum of Rs. 2500\/- per month to the wife and<\/p>\n<p>                  Rs. 1,000\/- per month to his son. A lump sum of Rs. 3,000\/- as<\/p>\n<p>                  litigation cost was also directed to be paid.<\/p>\n<p>                             Learned counsel for the petitioner submits that in the<\/p>\n<p>                  application filed under Section 125       of the Code of Criminal<\/p>\n<p>                  Procedure (for short the Code), no averments\/allegation has<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>been made that the wife was tortured and neglected by the<\/p>\n<p>petitioner-husband. Learned trial court dealt with the aforesaid<\/p>\n<p>aspect of the matter in paragraph 6 of the order which reads as<\/p>\n<p>under:\n<\/p>\n<blockquote><p>           &#8221; I have gone through the statements of the applicant<br \/>\n         and her other witnesses and have also perused the<br \/>\n         maintenance       application.    In   the   maintenance<br \/>\n         application, it is not stated that the O.P. has willfully<br \/>\n         neglected to maintain the applicant and her minor son<br \/>\n         and there is also no reason assigned so as to give her a<br \/>\n         reasonable ground for living separately from the O.P.<br \/>\n         However, the applicant Sabitri Devi A.W. 1 in her<br \/>\n         statement has stated that she was married to the O.P.<br \/>\n         on 12th day of June, 1995 according to the Hindu rites<br \/>\n         and customs. She has a son through the O.P.. In the<br \/>\n         marriage, there was no demand of dowry as the O.P.<br \/>\n         was unemployed. After three or four months of the<br \/>\n         marriage, he got a Government job on compassionate<br \/>\n         ground. Thereafter, he demanded rupees two lacs and a<br \/>\n         Hero Honda Motorcycle and began to torture her<br \/>\n         physically and mentally and lastly, turned her out of the<br \/>\n         house. The L.P. has willfully neglected to maintain her<br \/>\n         and her son. He has also performed his second<br \/>\n         marriage to satisfy his greed of dowry. She is unable to<br \/>\n         support herself and her son. The O.P. is presently<br \/>\n         posted as Nazir in Singhiya block, Samastipur. Thus,<br \/>\n         her evidence contains all the ingredients required for the<br \/>\n         claim of maintenance. She is little educated and rustic<br \/>\n         lady. This proceeding is under the code of criminal<br \/>\n         procedure for maintenance where the rules of pleadings<br \/>\n         cannot be strictly applied. Therefore, in my opinion, the<br \/>\n         omissions occurred in the maintenance application as<br \/>\n         stated earlier, is not fatal to the claim of maintenance.<br \/>\n         Ram Vati Devi, A.W. 2 in her evidence has stated<br \/>\n         nothing about the torture of the applicant, but she has<br \/>\n         also supported that the O.P. has contracted his second<br \/>\n         marriage. Since this witness, as it appears from her<br \/>\n         address, does not come from the parental or<br \/>\n         matrimonial village of the applicant, therefore, she<br \/>\n         cannot be expected to have personal knowledge about<br \/>\n         the torture of the applicant. Hence, the evidence of the<br \/>\n         applicant in this regard cannot be thrown out or<br \/>\n         outrightly disbelieved. Moreover, both A.W. 1 and A.W.<br \/>\n         2 have stated that the O.P. has solemnised his second<br \/>\n         marriage. A.W. 2 appears to have been cross-examined<br \/>\n         by the O.P., but she has not been given suggestion that<br \/>\n         the O.P. has not contracted his second marriage. &#8221;<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<blockquote><p>                   This Court finds from the order impugned that the<\/p>\n<p>      petitioner willfully defaulted in appearing before the Court. No<\/p>\n<p>      evidence was adduced on his behalf. He was, however, given<\/p>\n<p>      adequate opportunity to cross-examine the witnesses adduced<\/p>\n<p>      on behalf of applicant-wife. Learned trial Court on a consideration<\/p>\n<p>      of the entire materials on record found as under in paragraph 7:\n<\/p><\/blockquote>\n<blockquote><p>                         &#8220;From the above discussions, I come to<br \/>\n             a clear conclusion and hold that the applicant<br \/>\n             Sabitri Devi and her minor son Prince Kumar are<br \/>\n             entitled to get maintenance from the O.P. Further,<br \/>\n             as regards the quantum of the maintenance, there<br \/>\n             is no dispute that the O.P. is an employee in<br \/>\n             Singhiya block, Samastipur. The record shows that<br \/>\n             the O.P. has not denied in his any application or<br \/>\n             during the reconciliation proceeding that he holds<br \/>\n             the post of the Nazir. So, I think Rs. 2,500\/-<br \/>\n             (Rupees two thousand five hundred) per month to<br \/>\n             the applicant Sabitri Devi and rupees 1,000\/- (one<br \/>\n             thousand) per month to the minor son Prince<br \/>\n             Kumar for their maintenance and a lump sum<br \/>\n             amount of Rs. 3,000\/- (Three thousand) as litigation<br \/>\n             cost to Sabitri Devi would be just and proper to<br \/>\n             serve the ends of justice. &#8220;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>                   In my view, the consideration of the matter by learned<\/p>\n<p>      court below does not suffer from any illegality and\/or impropriety<\/p>\n<p>      meriting interference.\n<\/p><\/blockquote>\n<blockquote><p>                   There is no merit in this application. It is accordingly<\/p>\n<p>      dismissed.<\/p><\/blockquote>\n<p>                               ( Kishore K.
