NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeal  by special  leave arises from the order of<br \/>\nthe High  Court of Jammu and Kashmir, made on April 23, 1992<br \/>\nin Criminal  Revision No.  6\/92. The  respondents  5  to  7,<br \/>\nnamely, Sudhir\tKumar, Sharat  Kumar and Davinder Kumar were<br \/>\ngranted lease  to extract timber from compartment No. 55-56,<br \/>\nBani Range  of Billawar\t Division. It is not in dispute that<br \/>\nthe lease  of April  28,  1978\twas  to\t be  effective\tupto<br \/>\nDecember 31,  1986. It is stated by the respondents that for<br \/>\ncertain other  purposes, it  was extended  upto December 31,<br \/>\n1987. We  need not record any findings in that behalf. It is<br \/>\nonly noted as asked for. The Government have passed an order<br \/>\non  February   22,  1985   directing  the   aforesaid  three<br \/>\ncontractors to\tcomplete the  extraction of  the timber upto<br \/>\nSeptember 3,  1984 and\tthereafter unsalvaged  timber  would<br \/>\nstand vested  in the  State. Admittedly,  this\tis  only  an<br \/>\nadministrative order.  On September  24, 1985, the Jammu and<br \/>\nKashmir State  Nationalisation of  Forest Working  Act, 1985<br \/>\nwas enacted.  Thereunder, all timber lying within demarcated<br \/>\nforests stood  vested in the State w.e.f. the aforesaid date<br \/>\nnotwithstanding any  lease or agreement subsisting as on the<br \/>\ndate. The  Government order  dated  November  22,  1984\t was<br \/>\nstayed by  the High  Court on  March 12, 1984 by an order in<br \/>\nW.P. No.  48 of\t 1983  and  C.M.P.  No.\t 2120\/84.  When\t the<br \/>\nrespondents filed  the Writ  Petition No. 968\/85 challenging<br \/>\nthe validity  of the  Act, the High Court passed an order as<br \/>\nunder:\n<\/p>\n<blockquote><p>     &#8220;The DFO  Billawar is  appointed as<br \/>\n     Commissioner who  shall go\t to  the<br \/>\n     launching sites  in respect  of the<br \/>\n     compartment  No.\t55-56\tBasohli,<br \/>\n     Bani, Range  Billawar Division  and<br \/>\n     shall  ensure  that  on  timber  is<br \/>\n     launched in  the nallah  after  the<br \/>\n     passing of\t this order i.e. 13th of<br \/>\n     November 1985  by\tthe  petitioner.<br \/>\n     The DFO  Billawar shall however not<br \/>\n     interfere with  the timber\t already<br \/>\n     launched in  the nallah.  The  said<br \/>\n     timber shall  be  permitted  to  be<br \/>\n     brought by\t the petitioner, through<br \/>\n     his labour at his own risk and cost<br \/>\n     and without prejudice to the rights<br \/>\n     of the  parties  upto  the\t western<br \/>\n     bank of river Ravi, opposite to the<br \/>\n     collection\t     point\t Shahpur<br \/>\n     Kandilocated on the eastern bank of<br \/>\n     river Ravi\t within the State of J &amp;<br \/>\n     K. The  petitioner shall  have  the<br \/>\n     timber  already   launched\t in  the<br \/>\n     nallah brought  to the western bank<br \/>\n     of river  Ravi, as\t noticed  above,<br \/>\n     under    the     supervision     of<br \/>\n     DFO\/Billawar or  his nominees.  The<br \/>\n     petitioner shall  have no\tright or<br \/>\n     lien over\tthe timber so brought to<br \/>\n     the western  bank\tof  river  Ravi.<br \/>\n     Save as may be decided subsequently<br \/>\n     by the Court on the disposal of the<br \/>\n     writ  petition.   The  timber  when<br \/>\n     brought  to  the  western\tbank  of<br \/>\n     river Ravi\t shall be  stocked there<br \/>\n     against proper  receipt  and  shall<br \/>\n     remain under the charge and control<br \/>\n     of the  Forest Department\tand  the<br \/>\n     petitioner\t shall\t not  cause  any<br \/>\n     interference in  that regard.  This<br \/>\n     may  subsequently\t be  varied   or<br \/>\n     modified in  that behalf  by either<br \/>\n     of the  parties after notice to the<br \/>\n     opposite party.&#8221;<\/p><\/blockquote>\n<p>     Thereafter, the  Act came to be struck down by the High<br \/>\ncourt  on   December  13,   1985.  The\t Jammu\tand  Kashmir<br \/>\nNationalisation of  Forest Working  Ordinance No.  5 of 1986<br \/>\nwas passed  on January\t31, 1986  with retrospective  effect<br \/>\nfrom September\t24, 1985. It would appear that the Ordinance<br \/>\nlapsed and  subsequently another  Ordinance  was  issued  on<br \/>\nDecember 16,  1986 which  was  replaced\t by  the  Jammu\t and<br \/>\nKashmir Nationalisation\t of Forest  Working Act,  1987 which<br \/>\ncame into  effect from\tApril 21,  1987\t with  retrospective<br \/>\neffect from  September 24,  1985. Since\t the Ordinance\t5 of<br \/>\n1986 was given effect from September 24, 1985.\n<\/p>\n<p>     Section 3(a)  of the Ordinance 5 of 1986 envisages that<br \/>\n&#8220;notwithstanding anything  to the  contrary contained in any<br \/>\nlaw, rule  instrument,\tagreement  or  contract\t or  in\t any<br \/>\njudgment, decree  or order of any court or Authority as from<br \/>\nthe commencement of this Ordinance, no person shall fell any<br \/>\ntree or\t convert any  timber or\t carry on the felling of any<br \/>\ntree  or   conversion  or  removal  of\tany  timber  in\t any<br \/>\ndemarcated forest  of the  State &#8230;&#8221;.\tSection 9 prescribes<br \/>\npenalty and  states that  &#8220;any person  who  contravenes\t the<br \/>\nprovisions of  this Ordinance  or  abets  the  contravention<br \/>\nthereof, shall\tbe punishable  with imprisonment  for a term<br \/>\nwhich may  extend to  five years  but shall not be less than<br \/>\nthree years.&#8221;  The appellant  filed an\tFIR alleging therein<br \/>\ncertain accusations against four named officers and also the<br \/>\nrespondents lessees.  After conducting the investigation the<br \/>\ncharge sheet  was filed\t by the police against seven persons<br \/>\nincluding the aforesaid three lessee-respondents for several<br \/>\noffences and  also the\tfour officers for offences including<br \/>\nconspiracy in  permitting lessee-respondents  to remove\t the<br \/>\ntimber from  the demarcated forest etc, the details of which<br \/>\nwe are\tnot mentioning\tfor  the  reason  that\twe  are\t not<br \/>\ndisposing of  the matter  on merits at this stage. The trial<br \/>\nJudge discharged  all the  accused. On filing of a revision,<br \/>\nthe High  Court in  the impugned  order confirmed  the same.<br \/>\nThus, this appeal by special leave.\n<\/p>\n<p>     Shri Manhas,  learned counsel  appearing for the State,<br \/>\ncontends that  the trial  court and  the High Court were not<br \/>\nright in discharging the accused. It is necessary to mention<br \/>\nthat D.F.O.,  Khojaria and Chowdhary Girdhari Lal have died.<br \/>\nTherefore, the\tprosecution against  them stands abated. The<br \/>\nquestion is:  whether prima  facie case\t has been  made\t out<br \/>\nagainst the  respondents? Shri\tD.D. Thakur,  learned senior<br \/>\ncounsel appearing  for respondents  5  to  7,  the  lessees,<br \/>\ncontends that  they did\t not commit  any offence and they do<br \/>\nnot come  under the  provisions of either the Ordinance 5 of<br \/>\n1986 or\t the Act  which was quashed by the High Court or the<br \/>\nAct No.\t 7 of  1987. Therefore,\t no case  has been  made out<br \/>\nagainst them.  As stated earlier, we decline to consider the<br \/>\nmatter on  merits for  the reason that the High Court should<br \/>\nhave considered\t all the  relevant provisions of the Act and<br \/>\noffences and  the contentions  of the  parties\ttaking\tinto<br \/>\nconsideration the  averments made in the charge-sheet. It is<br \/>\nnow settled  law that  the  charge-sheet  constitutes  prima<br \/>\nfacie  evidence\t constituting  the  offence  for  proceeding<br \/>\nfurther in the matter. necessarily, therefore, the Court has<br \/>\nto look\t into the  relevant law\t and the allegations made in<br \/>\nthe charge-sheet  and then consider whether any of fence has<br \/>\nbeen committed to frame charges for trial before discharging<br \/>\nthe accused.  Since the\t High court  has not  done that,  we<br \/>\nthink it  proper that  the High\t court should reconsider the<br \/>\nmatter and  dispose it\tof in  accordance with\tlaw. All the<br \/>\ncontentions raised by the learned counsel on either side are<br \/>\nleft open.  it is open to the counsel to argue the matter in<br \/>\nthe High Court.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed  and  the  case  is<br \/>\nremitted to  the High Court for disposal. Since it is an old<br \/>\ncase, we  would request\t the High  Court to dispose it of as<br \/>\nexpeditiously as  possible  within  three  months  from\t the<br \/>\nreceipt of this Order.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of J. &amp; K vs Romesh Chander &amp; Ors on 27 November, 1996 Bench: K.
