Chief Standing Counsel.\n<\/p>\n<p>         In both these writ petitions, common question of law and<br \/>\nfacts are involved, hence, hence both are decided by the present<br \/>\ncommon judgment.\n<\/p>\n<p>         The respondents have attached the petitioner&#8217;s property<br \/>\nalong with certain goods and kept it under supurdagi of one Shri<br \/>\nArun Kumar Srivastava, Nazir. Feeling aggrieved, the petitioner<br \/>\nhas approached this Court under Art. 226 of the Constitution of<br \/>\nIndia.\n<\/p>\n<p>         The petitioner&#8217;s counsel took a plea against the attachment<br \/>\nand seizer of the property in question stating that while<br \/>\nseizing\/attaching the property, the respondents have also put their<br \/>\nseal on the immoveable property which is a showroom\/godown.<br \/>\nIn any case, the revenue is not entitled to seize the showroom<br \/>\ncausing irreparable loss and injury to the petitioner. He further<br \/>\nsubmits that to the most, the respondents are entitled for seizer of<br \/>\ngoods but they have no right to deprive the petitioner from his<br \/>\nimmoveable        property   by   putting   their   seal   over   the<br \/>\nshowroom\/godown. Accordingly, the petitioner claims for payment<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>of damages to the tune of Rs.36 lacs and also for issuance of a<br \/>\nwrit in the nature of mandamus directing the opposite parties to<br \/>\nunlock the showroom of the godown.\n<\/p>\n<p>      In response to the submission made by the petitioner&#8217;s<br \/>\ncounsel, learned Addl. Chief Standing Counsel has invited<br \/>\nattention of this Court to sub para (iii) of para 3 and para 13 of the<br \/>\nCounter Affidavit wherein it has been stated that for the<br \/>\nassessment year 1993-94, 1994-95, 1996-97, 1998-99 and 1999-<br \/>\n2000, the petitioner has to pay tax amounting to Rs.20,11,959,53<br \/>\nalong with interest and with intention to recover the outstanding<br \/>\ntax dues, the department has proceeded against the petitioner<br \/>\nwith attachment of property in question. It has been further stated<br \/>\nthat after attaching the goods and putting the seal in the<br \/>\nshowroom of the godown, it has been given in the supurdagi of<br \/>\nNazir Shri Arun Kumar Srivastava. It has also been submitted by<br \/>\nthe learned Addl. Chief Standing Counsel that there is no question<br \/>\nof seizer of the petitioner&#8217;s immoveable property. The property<br \/>\nhas been attached with intention to recover the outstanding tax<br \/>\ndues against the petitioner.\n<\/p>\n<p>      During pendency of the writ petition, by order dated<br \/>\n21.5.2002, passed in writ petition No.4906(M\/B) of 2001, a<br \/>\nDivision Bench of this Court has directed to open the showroom of<br \/>\ngodown with liberty to the department to take away the goods. In<br \/>\npursuance to the above order, Mr. H.P. Srivastava submits that the<br \/>\nshowroom of the godown was unlocked and the goods have been<br \/>\ntaken away by the department and presently, it has been placed in<br \/>\nthe basement of the department. Accordingly, it appears that the<br \/>\ndepartment has not proceeded to seize the petitioner&#8217;s premises;<br \/>\nrather it was a step to realise the outstanding tax dues from the<br \/>\npetitioner.\n<\/p>\n<p>      The factual averments contained in para 3(iii) and para 13 of<br \/>\nthe counter affidavit have not been denied by the petitioner..<br \/>\nThus, it is evident that the tax which the respondents have to<br \/>\nrecover are due since long.      On failure to pay the same, the<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>department has proceeded by attaching the goods and putting its<br \/>\nlock in the showroom for safe custody.\n<\/p>\n<p>      In spite of repeated queries made by this Court as to why<br \/>\nthe petitioner has not paid the outstanding tax dues to the<br \/>\nrevenue, no satisfactory reply has been given by the petitioner&#8217;s<br \/>\ncounsel. Thus, it is evident that for more than last 10 years, the<br \/>\ntax dues have not been paid by the petitioner to the revenue. The<br \/>\npetitioner does not seem to be fair in his conduct with regard to<br \/>\npayment of tax dues.\n<\/p>\n<p>      It has been stated by the learned Chief Standing Counsel<br \/>\nthat till date, the petitioner has not paid the outstanding tax dues,<br \/>\nhence the goods have not been released. Such conduct on the<br \/>\npart of the petitioner disentitles him to get any equitable relief from<br \/>\nthis Court.   He also submits that the assessment order has<br \/>\nattained finality and in spite of the fact that no appeal is pending<br \/>\nand the assessment order has attained finality, the petitioner has<br \/>\nnot paid outstanding tax. Inaction on the part of the petitioner to<br \/>\npay the outstanding tax dues, as observed above, is unjust and<br \/>\nunfair. No case for interference under extraordinary remedy under<br \/>\nArticle 226 of the Constitution of India is made out.\n<\/p>\n<p>      In view of above, both the writ petitions are dismissed in<br \/>\nlimine.
