(J)\n\nCITATION:\n 1994 AIR 1141\t\t  1994 SCC  (1) 370\n JT 1993 (6)   335\t  1993 SCALE  (4)414\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORDER\n<\/p>\n<p>1.By this petition, the petitioner, as proprietor of  M\/s<br \/>\nDamodar\t Engineering  &amp;\t Construction  Company,\t is  seeking<br \/>\nspecial leave to appeal against the judgment dated July\t 17,<br \/>\n1992 of the learned Single Judge of the Calcutta High  Court<br \/>\nwhereby the application filed by the respondent, namely, the<br \/>\nBoard  of Trustees for the Port of Calcutta,  challenging  a<br \/>\nreference to an arbitrator and for removal of the arbitrator<br \/>\nunder  Sections 5, 1 1 and 33 of the Arbitration  Act,\t1940<br \/>\n(hereinafter referred to as &#8216;the Act&#8217;) has been allowed\t and<br \/>\nthe reference has been superseded and the appointment of the<br \/>\narbitrator,  (respondent  2 in the said application  of\t the<br \/>\nrespondent), was revoked.\n<\/p>\n<p>2.The  petitioner  entered  into  a  contract  with   the<br \/>\nrespondent in the year 1976 for construction of a  permanent<br \/>\nroad  between Ranichak and the Main Feeder Road\t at  Haldia.<br \/>\nThe  said  contract contained an  arbitration  clause.\t The<br \/>\npetitioner,  invoking the arbitration clause,  referred\t the<br \/>\ndisputes  arising out of the contract to the arbitration  of<br \/>\nan arbitrator appointed by the Institute of Engineers India.<br \/>\nThe  Statement of Claim filed by the petitioner\t before\t the<br \/>\narbitrator  covered a number of matters including refund  of<br \/>\nsecurity deposit amounting to Rs 60,940 as well as  compound<br \/>\ninterest  at the rate of 18 per cent per annum on  the\tsaid<br \/>\namount\tfrom  February 10, 1977 till date of  payment.\t The<br \/>\narbitrator  made an award on September 26, 1984\t whereby  he<br \/>\nawarded\t a sum of Rs 4,95,000 to the petitioner.   The\tsaid<br \/>\naward  was,  however, set aside, in appeal,  by\t a  Division<br \/>\nBench of the Calcutta High Court by judgment dated  December<br \/>\nII,  1989.  Special Leave Petition (Civil) Nos.\t 2929-30  of<br \/>\n1990  filed by the petitioner against the said\tjudgment  of<br \/>\nthe  Calcutta High Court were disposed of by this  Court  by<br \/>\norder dated July 23, 1990, whereby it was directed that:\n<\/p>\n<blockquote><p>\t      &#8220;&#8230; in all these matters a sum of Rs 7,50,000<br \/>\n\t      (Rupees  Seven lakhs and fifty thousand  only)<br \/>\n\t      should  be paid to the petitioner in full\t and<br \/>\n\t      final  settlement\t of these matters  within  3<br \/>\n\t      months  from  today.  If the said sum  is\t not<br \/>\n\t      paid   within   the  prescribed\tperiod\t the<br \/>\n\t      petitioner  shall be entitled to\tinterest  at<br \/>\n\t      the rate of 12% per annum.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">372<\/span><\/p>\n<p>3.While the aforementioned proceedings for setting  aside<br \/>\nthe  arbitral award were pending the petitioner invoked\t the<br \/>\narbitration clause for a second time and the same arbitrator<br \/>\nwas  appointed\tagain  to arbitrate  on\t the  dispute.\t The<br \/>\nStatement of Claim for Rs 5,85,456.71 in the said  reference<br \/>\nrelated to refund of the security deposit of Rs 60,943.\t The<br \/>\nclaim  for Rs 2,92,526.40 for loss of profit in business  on<br \/>\naccount\t of withholding of the sum of Rs 60,943 as  well  as<br \/>\nclaim for Rs 1,94,132.31 by way of compound interest at\t the<br \/>\nrate  of  18  per cent per annum on the said  amount  of  Rs<br \/>\n60,943\t from  1978  to\t October  1986\tand  certain   other<br \/>\nincidental claims.  The second reference to the\t arbitration<br \/>\nwas  challenged by the respondent by filing  an\t application<br \/>\nunder  Sections\t 5,  11 and 33 of the  Act  which  has\tbeen<br \/>\nallowed by the learned Single Judge of the High Court.\n<\/p>\n<p>4.We  have heard the petitioner, who appeared in  person,<br \/>\nas well as Shri N.N. Gooptu, Advocate-General for the  State<br \/>\nof  West Bengal who, on the request of the  Court  presented<br \/>\nhis  case, as well as the learned Solicitor General for\t the<br \/>\nrespondent.\n<\/p>\n<p>5.Having  regard to the claim made by the  petitioner  in<br \/>\nthe first reference to arbitration which included the  claim<br \/>\nfor  refund of security deposit of Rs 60,943 as well as\t the<br \/>\nclaim  for interest on the said amount and the\torder  dated<br \/>\nJuly  23,  1990 passed by this Court on\t the  special  leave<br \/>\npetitions  filed by the petitioner whereby it  was  directed<br \/>\nthat  a sum of Rs 7,50,000 should be paid to the  petitioner<br \/>\n&#8220;in  full and final settlement of these matters&#8221;, we do\t not<br \/>\nfind any merit in the case of the petitioner.  No ground  is<br \/>\nmade  out  for\tinterference with the order  passed  by\t the<br \/>\nlearned Single Judge of the High Court.\n<\/p>\n<p>6.
