He died on June 3,<\/p>\n<p>2006.   The    petitioner     submitted     an   application    for     granting<\/p>\n<p>above licence in her favour on compassionate ground. The above<\/p>\n<p>application of the petitioner was rejected by virtue of the<\/p>\n<p>impugned order on the ground that two licenses under different<\/p>\n<p>control orders under the Essential Commodities Act, 1955 could<\/p>\n<p>not be granted in respect of one and same family.<\/p>\n<p>               Having heard the learned counsel for the respective<\/p>\n<p>parties   as    also    taking    into    consideration       the     facts    and<\/p>\n<p>circumstances, I find that the above policy of the respondent<\/p>\n<p>authority has been modified by an order dated July 16, 2010<\/p>\n<p>passed by the Principal Secretary to the Government of West<\/p>\n<p>Bengal, Food &amp; Supplies Department permitting granting of two<\/p>\n<p>licenses in the above circumstances to one and same family.<\/p>\n<p>               In view of the above, I direct the respondent no.4<\/p>\n<p>to review his earlier decision in view of the modification in<\/p>\n<p>the   policy    of    the    respondent     authority    in   the     matter    of<\/p>\n<p>granting licence on compassionate ground by passing a reasoned<\/p>\n<p>order within six weeks from the date of communication of this<\/p>\n<p>order after giving an opportunity of hearing to the petitioner<\/p>\n<p>or her authorized representative.\n<\/p>\n<p>               This writ application is, thus, disposed of.<br \/>\n<span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>                  There will, however, be no order as to costs.<\/p>\n<p>                  Let    the   affidavit-in-opposition     filed     by   the<\/p>\n<p>   respondents and the affidavit-in-reply thereto filed by the<\/p>\n<p>   petitioner be kept on record.\n<\/p>\n<p>                        Urgent photostat certified copy of this order,<\/p>\n<p>   if   applied   for,    be   supplied    to   the   parties   subject   to<\/p>\n<p>   compliance with all requisite formalities.<\/p>\n<p>                                          (DEBASISH KAR GUPTA, J.)<\/p>\n<p>sb.A.R(C.R.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Calcutta High Court Chaina Bhattacharjee vs The State Of West Bengal &amp; Ors on 19 May, 2011 Author: Debasish Kar Gupta WP No. 318 of 2010 IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction ORIGINAL SIDE CHAINA BHATTACHARJEE Versus THE STATE OF WEST BENGAL &amp; ORS.
