K.L.PANDYA, AGP for Respondent(s) : 1, \nRULE SERVED BY DS\nfor Respondent(s) : 2 - 3. \nRULE SERVED for Respondent(s) :\n3, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.C.UPADHYAYA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/10\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tPetitioner &#8211; detenue has filed the present Petition under<br \/>\n\tArticle 226  of the Constitution of India, challenging the detention<br \/>\n\torder dated 3.7.2010 (executed on 5.7.2010), passed by the<br \/>\n\tRespondent &#8211; Police Commissioner, Vadodara City, by exercising the<br \/>\n\tpowers conferred under sub-section (2) of Section 3 of the Gujarat<br \/>\n\tPrevention of Anti Social Activities Act, 1985 (&#8220;PASA Act&#8221;,<br \/>\n\tfor short). The detenue is  branded as &#8220;bootlegger&#8221;.\n<\/p>\n<p>\tHeard Ms.<br \/>\n\tBanna Dutta, learned Advocate for Mr. A.R.Shaikh, learned Advocate<br \/>\n\tfor the Petitioner and Mr.K.L.Pandya, learned AGP for the<br \/>\n\tRespondents.  Affidavit in Reply is filed by the Respondent &#8211;<br \/>\n\tCommissioner of Police, Vadodara City,  which has been taken into<br \/>\n\tconsideration.\n<\/p>\n<p>\tThe<br \/>\n\tPetitioner came to be detained as &#8220;bootlegger&#8221; on his<br \/>\n\tinvolvement in one offence arising under the Bombay Prohibition Act.\n<\/p>\n<p>It<br \/>\n\thas been submitted by the learned Counsel for the Petitioner that it<br \/>\n\tis a settled legal position that on registration of one offence, no<br \/>\n\torder of detention could have been passed, as the Petitioner cannot<br \/>\n\tbe branded as &#8220;bootlegger&#8221;. It has been further<br \/>\n\tsubmitted that the activities of the Petitioner cannot be said to be<br \/>\n\tinjurious to the public health or public order. It has been further<br \/>\n\tsubmitted by the learned Counsel for the Petitioner that there is<br \/>\n\tgross delay in passing the order of detention as well as there is<br \/>\n\tgross delay in executing the order of detention.\n<\/p>\n<p>\tPer<br \/>\n\tcontra, Mr.K.L.Pandya, learned AGP representing the Respondents<br \/>\n\tsupported the detention order dated 3.7.2010 passed by the<br \/>\n\tRespondent &#8211; Commissioner of Police, Vadodara City and<br \/>\n\tsubmitted that before passing the detention order, the detaining<br \/>\n\tauthority took into consideration all the relevant papers, and after<br \/>\n\tsubjective satisfaction, the detention order is passed, and thus the<br \/>\n\tdetention order is legal and proper, and no interference in the said<br \/>\n\torder is warranted, and consequently, the petition deserves<br \/>\n\tdismissal.\n<\/p>\n<p>\tI have<br \/>\n\tgone through the grounds of detention and considered the submissions<br \/>\n\tadvanced on behalf of both the sides.\n<\/p>\n<p>\tThe Court<br \/>\n\tis of the opinion that there is much substance in the arguments<br \/>\n\tadvanced by learned Counsel for the Petitioner. It is seen from the<br \/>\n\tgrounds that a general statement has been made by the detaining<br \/>\n\tauthority that consuming liquor is injurious to health. In fact, a<br \/>\n\tperusal of the order passed by the detaining authority shows that<br \/>\n\tthe grounds which are mentioned in the order are in reference to the<br \/>\n\tsituation of &#8220;law and order&#8221; and not &#8220;public<br \/>\n\torder&#8221;. Therefore, on this ground, the subjective satisfaction<br \/>\n\tof the detaining authority is vitiated on account of non-application<br \/>\n\tof mind and the impugned order, therefore, deserves to be quashed<br \/>\n\tand set aside.\n<\/p>\n<p>\tExcept the<br \/>\n\tgeneral statement, there is no material on record which shows that<br \/>\n\tthe  detenu is carrying on illegal activities of selling liquor or<br \/>\n\tis engaged in such activity, which is harmful to the health of the<br \/>\n\tpublic. In the case of ASHOKBHAI JIVRAJ @ JIVABHAI SOLANKI v\/s.<br \/>\n\tPOLICE COMMISSIONER, Surat, reported in 2001 (1) GLH 393, having<br \/>\n\tconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\n\tManohar Lohia v\/s. State of Bihar, reported in AIR 1966 SC<br \/>\n\t740, this Court held that the cases wherein the detention orders<br \/>\n\tare passed on the basis of the statements of such witness fall under<br \/>\n\tthe maintenance of &#8220;law and order&#8221; and not &#8220;public<br \/>\n\tOrder&#8221;.\n<\/p>\n<p>\tApplying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention, the detaining authority must come to a definite<br \/>\n\tfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\n\tclear that the present case would not fall within the category of<br \/>\n\tthreat to a public order. In that view of the matter, when the order<br \/>\n\tof detention has been passed by the detaining authority without<br \/>\n\thaving adequate grounds for passing the said order, cannot be<br \/>\n\tsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>\tIn the<br \/>\n\tresult, this petition is allowed. The impugned order of detention<br \/>\n\tdated 3.7.2010 passed by the Respondent &#8211; Police Commissioner,<br \/>\n\tVadodara City, is hereby quashed and set aside. The detenu is<br \/>\n\tordered to be set at liberty forthwith, if not required in any other<br \/>\n\tcase. Rule is made absolute accordingly.
