MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nappeal has been preferred against the order passed by the learned<br \/>\nSingle Judge whereby allotment of fair-price shop in favour of first<br \/>\nrespondent was upheld in view of the fact that the first respondent<br \/>\nis more qualified than the appellant.\n<\/p>\n<p>\tThe<br \/>\ngrievance of the appellant is that 10% priority which was required to<br \/>\nbe given to women candidates against each category was not followed.<br \/>\nReferring to Clause 5.1.6 of Pandit  Deendayal Grahak Bhandar Yojna,<br \/>\nit was submitted that 10% priority was not given to socially and<br \/>\neducationally backward class unemployed women in the Taluka<br \/>\nconcerned.\n<\/p>\n<p>\tFrom<br \/>\nthe record it appears that original allotment was made in favour of<br \/>\nthe appellant but such allotment was set aside by the Court and the<br \/>\nmatter was remanded to the authorities.  After number of litigations,<br \/>\nthe Appellate Authority allotted fair-price shop in favour of  the<br \/>\nfirst respondent, which was upheld by the learned Single Judge, first<br \/>\nrespondent being more qualified.\n<\/p>\n<p>\tSo<br \/>\nfar as 10% priority to the women candidate is concerned, it has been<br \/>\nbrought to our notice that out of 26 fair price shops falling within<br \/>\nthe category of socially and economically backward class, 4 women<br \/>\ncandidates have been allotted fair-price shops, which is  more than<br \/>\n10%.  In these circumstances, interference with the order passed by<br \/>\nthe learned Single Judge is not called for.  There is no merit.<br \/>\nAppeal is dismissed.
