Chempazhanthiyil, the learned<\/p>\n<p>counsel appearing for the petitioner and Sri.P.Nandakumar, the<\/p>\n<p>learned Government Pleader appearing for the respondents.<\/p>\n<p>              2.     The petitioner is presently working as<\/p>\n<p>Architectural Head Draftsman        in the office of the second<\/p>\n<p>respondent.    He has    a Degree in Architecture.      He entered<\/p>\n<p>service on 8.10.2003 as Architectural Head Draftsman, on advice<\/p>\n<p>by the Kerala Public Service Commission.         As per the Special<\/p>\n<p>Rules for Kerala Architectural Service, the next promotion post is<\/p>\n<p>that of Architectural Assistant. However, that post was abolished<\/p>\n<p>even before the petitioner entered service. The next promotion<\/p>\n<p>post is that of Assistant Architect. In view of the abolition of the<\/p>\n<p>post  of Architectural     Assistant,   a   stalemate   arose. The<\/p>\n<p>Government thereupon issued the          clarification evidenced by<\/p>\n<p>Ext.P2 to the effect that till the Special Rules are suitably<\/p>\n<p>W.P.(C) No.29841 of 2008<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>amended, temporary promotions can be made to the post of<\/p>\n<p>Assistant Architects, either under Rule 9(a)(i) or under Rule 31(a)<\/p>\n<p>(i) of Part II of K.S. &amp; S.S.R, in accordance with seniority and<\/p>\n<p>that Architectural Head Draftsman can be temporarily promoted<\/p>\n<p>as Assistant Architect. The petitioner submits that his seniors<\/p>\n<p>have moved the Government and obtained orders enabling them<\/p>\n<p>to be temporarily promoted as Assistant Architects.           Claiming<\/p>\n<p>similar relief, the petitioner has submitted Ext.P4 representation<\/p>\n<p>before the Secretary to Government, Public Works Department.<\/p>\n<p>In this Writ Petition, the petitioner inter alia prays that        the<\/p>\n<p>respondents may be directed to consider Ext.P4 representation<\/p>\n<p>and pass orders there on, in the light of the earlier orders passed<\/p>\n<p>by the Government, and the directions issued by this Court in<\/p>\n<p>Exts.P5 and P6 to P8 judgments which were implemented by<\/p>\n<p>Exts.P9 and P10 Government orders.\n<\/p>\n<\/p>\n<p>                In the light of the fact that persons similarly situate<\/p>\n<p>have been given temporary promotion as Assistant Architect<\/p>\n<p>under Rule 31(a)(i) of Part II of the K.S. &amp; S.S.R and having<\/p>\n<p>W.P.(C) No.29841 of 2008<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>regard to the fact that the post of Architectural Assistant stands<\/p>\n<p>abolished since 1977, the claim made by the petitioner merits<\/p>\n<p>consideration at the hands of the Government. Such being the<\/p>\n<p>situation, I dispose of the Writ Petition with a direction to the<\/p>\n<p>Secretary to Government, Public Works Department, to consider<\/p>\n<p>the request made by the petitioner in Ext.P4 and pass orders<\/p>\n<p>thereon, in the light of Exts.P9 and P10 Government orders and<\/p>\n<p>having regard to the fact that persons similarly situate as the<\/p>\n<p>petitioners were given promotion as Assistant Architects.
