Justice R.BASANT\n\n Dated :13\/07\/2007\n\n O R D E R\n                                   R.BASANT, J\n\n                         ------------------------------------\n\n                          Crl.M.C.No.2253 of 2007\n\n                         -------------------------------------\n\n                     Dated this the 13th day of July, 2007\n\n\n                                     O R D E R\n<\/pre>\n<p>       The   petitioners   face   indictment   in   a   prosecution  under  Section<\/p>\n<p>138  of the Negotiable Instruments Act.   Cognizance has been taken.<\/p>\n<p>Consequent   to   non   appearance   of   the   petitioners,   the   case   against<\/p>\n<p>them   has   been   transferred   to   the   list   of   Long   Pending   Cases.     The<\/p>\n<p>petitioners   find   warrants   of   arrest   issued   by   the   learned   Magistrate<\/p>\n<p>chasing them.   According to the petitioners, they are innocent.   Their<\/p>\n<p>absence   was   not   wilful   and   was   on   account   of   reasons   beyond   their<\/p>\n<p>control.  They are willing to appear before the learned Magistrate and<\/p>\n<p>seek  regular bail, but they apprehend that  their  applications for bail<\/p>\n<p>may   not   be   considered   by   the   learned   Magistrate   on   merits,   in<\/p>\n<p>accordance with law and expeditiously.     In these circumstances it is<\/p>\n<p>prayed   that   directions   under   Section   482   Cr.P.C   may   be   issued   in<\/p>\n<p>favour of the petitioners.\n<\/p>\n<\/p>\n<p>       2.     It   is   for   the   petitioners   to   appear   before   the   learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate   the   circumstances<\/p>\n<p>under   which   they   could   not   earlier   appear   before   the   learned<\/p>\n<p>Magistrate.   I have no reason to assume that the learned Magistrate<\/p>\n<p>would not consider such application on merits, in accordance with law<\/p>\n<p>and   expeditiously.     Every   court   must   do   the   same.     No   special   or<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2253 of 2007                   2<\/span><\/p>\n<p>specific   direction   appears   to   be   necessary.     Sufficient   general<\/p>\n<p>directions have already been issued in  <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<\/p>\n<p>         3.    This   Crl.M.C   is,   in   these   circumstances,   dismissed,   but<\/p>\n<p>with the specific observation that if the petitioners appear before the<\/p>\n<p>learned   Magistrate   and   apply   for   bail   after   giving   sufficient   prior<\/p>\n<p>notice to the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and expeditiously &#8211;<\/p>\n<p>on the date of surrender itself.\n<\/p>\n<\/p>\n<p>         4.    The   warrants   of   arrest   issued   by   the   learned   Magistrate<\/p>\n<p>against  the petitioners  shall  not be executed  till  23.07.2007.     Before<\/p>\n<p>that date, the petitioners shall appear  before the learned Magistrate<\/p>\n<p>and seek regular bail.\n<\/p>\n<\/p>\n<p>         5.
