DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/07\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\nreview application, surprisingly is filed by Union of India-original<br \/>\nrespondent with a prayer to recall the order dated 21.6.2007 passed<br \/>\nin Special Civil Application NO. 6264 of 1997.\n<\/p>\n<p>2.\tBy<br \/>\nthe above order dated 21.6.2007 passed in Special Civil Application<br \/>\nNo.6264 of 1997, respondent authority of Union of India was directed<br \/>\nto pay 12% interest on retiral dues of the petitioner from the date<br \/>\nof retirement till the actual payment is paid.  It is not in dispute<br \/>\nthat the petitioner employee retired from service on 28.2.1997 and<br \/>\nretiral dues were paid on 26.12.1997 and thus there is delay of about<br \/>\n10 months.  In spite of the above fact that retiral dues have been<br \/>\npaid after 10 months of retirement and rendering of about 21 years of<br \/>\nservice with Indian Air Force, no pension papers were prepared in<br \/>\ntime as per the guidelines and directions of the Ministry and this<br \/>\nreview application is filed to recall the earlier order.\n<\/p>\n<p>3.\tBy<br \/>\nfiling such review application on a trivial ground, Union of India<br \/>\nnamely, Group Captain, Station Commander, 47 Signal Unit, Air Force<br \/>\nhas added one more Misc. Application in arrears of the cases before<br \/>\nthis Court.  From time and again, it is declared by the Law Ministry<br \/>\nthat application in nature of miscellaneous and the orders which do<br \/>\nnot cause serious prejudice and\/or grave injustice, such order need<br \/>\nnot be challenged by filing writ petition before the High Court.  In<br \/>\nthis Misc. Application, legitimate retiral dues of an employee of<br \/>\nIndian Air Force was paid belatedly by 10 months and for which, the<br \/>\nauthority thought it fit not to pay interest and instead filed this<br \/>\napplication for recall.  Admittedly, no appeal is preferred against<br \/>\nthe order dated 21.6.2007 passed in Special Civil Application NO.6264<br \/>\nof 1997.\n<\/p>\n<p>4.\tIf<br \/>\n12% interest on the retiral dues of the petitioner-Rajivkumar Gupta<br \/>\nis not paid within two weeks from today as directed in the order<br \/>\ndated 21.6.2007 in Special Civil Application NO.6264 of 1997, the<br \/>\nGroup Captain, Station Commander, 47 Signal Unit, Air Force Station,<br \/>\nVadsar, Tal. Kalol Dist. Gandhinagar, is directed to remain<br \/>\npersonally present before this Court on 23rd July, 2010.\n<\/p>\n<p>5.\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>6.\tIn<br \/>\naddition to direct service, copy of the order be handed over to<br \/>\nlearned advocate on behalf of applicants-reviewer and original<br \/>\nrespondents.\n<\/p>\n<p>[ANANT<br \/>\nS.
