BASANT, J.\n\n              -------------------------------------------------\n\n                      CRL.M.C.NO. 4026 OF  2006\n\n              -------------------------------------------------\n\n          Dated this the 13th day of December, 2006\n\n\n                                  ORDER\n<\/pre>\n<p>      The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Sec.498A of the IPC.  Cognizance has been taken on the basis<\/p>\n<p>of   a   final   report   submitted   by   the   police,   after   due<\/p>\n<p>investigation.  The only allegation raised against the petitioner<\/p>\n<p>is the one punishable under Sec.498A of the IPC.<\/p>\n<p>      2.     This   Crl.M.C.   has   been   filed   by   the   petitioner   &#8211;   the<\/p>\n<p>sole accused, to request this Court to invoke its powers under<\/p>\n<p>Sec.482   of   the   Cr.P.C.   to   quash   the   prosecution   initiated<\/p>\n<p>against   him   which   is   pending   as   C.C.No.879\/05   before   the<\/p>\n<p>learned Judicial Magistrate of the First Class-I, Kochi.<\/p>\n<p>      3.     It   is   submitted   that   the   petitioner   has   settled   his<\/p>\n<p>disputes   with   his   wife   and   mother-in-law,   who   are   shown   as<\/p>\n<p>respondents 1 and 2 in this Crl.M.C.   and as C.Ws.1 and 2 in<\/p>\n<p>the  prosecution  launched  against   the  petitioner.         Inasmuch<\/p>\n<p>as the matrimonial dispute has been settled harmoniously, it is<\/p>\n<p>submitted   that   there   is   absolutely   no   justification   in   the<\/p>\n<p>prosecution   under   Sec.498A   of   the   IPC   continuing.     Though<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 4026 OF  2006  -: 2 :-<\/span><\/p>\n<p>the   offence   under   Sec.498A   of   the   IPC   is   not   compoundable<\/p>\n<p>under   Sec.320   of   the   Cr.P.C.,   it   is   prayed   that   invoking   the<\/p>\n<p>dictum in B.S. Joshy v. State of Haryana (AIR 2003 SC 1386),<\/p>\n<p>powers under Sec.482 of the Cr.P.C. may be invoked to bring to<\/p>\n<p>premature termination   the prosecution.<\/p>\n<p>      4.   B.S. Joshy v. State of Haryana (AIR 2003 SC 1386) is<\/p>\n<p>authority   for   the   proposition   that   powers   under   Sec.482   of   the<\/p>\n<p>Cr.P.C. can, in an appropriate case, be invoked if the interests of<\/p>\n<p>justice   would   transcend   the   mere   interests   of   law.     This,   I   am<\/p>\n<p>satisfied, is a typically fit case where such powers under Sec.482<\/p>\n<p>of   the   Cr.P.C.   can   be   invoked.     Respondents   1   and   2   are<\/p>\n<p>represented   by   the   counsel   and   the   learned   counsel   for   the<\/p>\n<p>petitioner vouches that   respondents 1 and 2  have  settled their<\/p>\n<p>disputes   with   the   petitioner   and   have   compounded   the   offence<\/p>\n<p>allegedly committed by the petitioner.   Advocate  Sri.K.A. Jaleel<\/p>\n<p>appears for respondents 1 and 2 and vouches for the composition<\/p>\n<p>of  the   offence.     I   am, in   these   circumstances,  satisfied   that  the<\/p>\n<p>composition has, in fact, taken place and the prosecution can be<\/p>\n<p>brought to termination by invoking the powers under Sec.482 of<\/p>\n<p>the Cr.P.C.\n<\/p>\n<p>\n<span class=\"hidden_text\"> CRL.M.C.NO. 4026 OF  2006  -: 3 :-<\/span><\/p>\n<p>        5.  In the result:\n<\/p>\n<\/p>\n<p>        (a) This Crl.M.C. is allowed.\n<\/p>\n<\/p>\n<p>        (b) C.C.No.879\/05 pending before the Judicial Magistrate of<\/p>\n<p>the First Class-I, Kochi, is hereby quashed.<\/p>\n<p>                                                          Sd\/-\n<\/p>\n<p>\n                                              (R.
